How Long Is FMLA Leave in Massachusetts: 12, 26 Weeks, or PFML

In Massachusetts, FMLA leave is up to 12 weeks of unpaid, job-protected time in a 12-month period for most qualifying reasons, and up to 26 weeks in a single 12-month period when you’re caring for a covered servicemember. Because Massachusetts also runs its own Paid Family and Medical Leave (PFML) program, most workers who qualify for both can reach a combined ceiling of 26 weeks per benefit year, with the two laws generally running at the same time rather than back to back.

The 12-Week Federal FMLA Entitlement

The federal Family and Medical Leave Act provides eligible employees up to 12 workweeks of unpaid, job-protected leave within a 12-month period.1U.S. Department of Labor. FMLA Frequently Asked Questions Those 12 weeks cover bonding with a newborn or newly placed child, caring for a spouse, child, or parent with a serious health condition, and dealing with your own serious health condition.2U.S. Department of Labor. Eligibility is narrower than many workers assume. You must have worked for a covered employer for at least 12 months, logged at least 1,250 hours in the 12 months before leave begins, and work at a site where the employer has 50 or more employees within 75 miles.1U.S. Department of Labor. FMLA Frequently Asked Questions If you work for a smaller business, federal FMLA simply doesn’t apply.

When FMLA Stretches to 26 Weeks

One category of federal leave doubles the standard entitlement. Military caregiver leave gives an eligible employee up to 26 workweeks in a single 12-month period to care for a spouse, child, parent, or next of kin who is a covered servicemember with a serious injury or illness from active duty.3U.S. Department of Labor. How Long Massachusetts PFML Lasts

Massachusetts PFML pays a weekly benefit during leave and sets its own duration limits. The maximum combined leave in a single benefit year is 26 weeks, and the amount available depends on the reason:4Mass.gov. Paid Family and Medical Leave (PFML) Overview and Benefits

  • Up to 20 weeks of paid medical leave for your own serious health condition.
  • Up to 12 weeks of paid family leave to care for a family member or to bond with a child. Bonding leave must be used within the first 12 months after birth, adoption, or foster placement.
  • Up to 26 weeks of paid family leave to care for a family member who was injured or became ill on active military duty.
  • Up to 12 weeks of leave for a qualifying exigency related to a family member’s active duty deployment.

You can combine leave types in one benefit year, but the total tops out at 26 weeks.5Mass.gov. Types of Paid Family and Medical Leave If you used 20 weeks of medical leave for your own condition and then needed to care for a parent, you’d have 6 weeks of family leave left before the cap.

Your PFML benefit year is personal. It begins the Sunday before your first day of leave and runs 52 consecutive weeks, and your available balances reset only when that window closes.5Mass.gov. Types of Paid Family and Medical Leave

How FMLA and PFML Run Together

PFML does not replace FMLA. When you qualify for both, the two programs run concurrently.6Mass.gov. PFML Frequently Asked Questions for Employees Take 12 weeks off for your own serious health condition and both clocks tick at once: those 12 weeks come out of your 12-week FMLA bank and your 20-week PFML medical leave bank at the same time. You don’t get to add them together for 32 weeks.

The concurrent rule still leaves gaps where PFML gives you more protected time than FMLA alone. Three situations come up most often:

  • PFML runs longer for your own health condition. FMLA covers 12 weeks; PFML covers 20. Once FMLA runs out at week 12, PFML benefits and PFML’s own job protection carry you through week 20.
  • PFML covers relatives FMLA doesn’t. Federal FMLA family leave is limited to a spouse, child, or parent. PFML also extends to siblings, grandparents, grandchildren, and parents-in-law, so up to 12 weeks of paid leave can apply with no FMLA time deducted.
  • You don’t meet FMLA’s eligibility rules. Workers at small employers, or those under the 1,250-hour threshold, can still access PFML if they meet the state earnings test.

When both laws cover the same leave, your employer must give you whichever protection is greater. In practice, that usually means PFML’s longer durations and broader family definitions set the length of your time off, while FMLA layers on continued group health insurance on the same terms as active employees.7eCFR. 29 CFR 825.209 – Maintenance of Employee Benefits

Why Two Massachusetts Workers Can Get Different Amounts

Because eligibility differs, two people in the same office can end up with very different leave ceilings. FMLA’s 12-month, 1,250-hour, and 50-employee-within-75-miles thresholds knock out part-time workers, new hires, and anyone at a small business.1U.S. Department of Labor. FMLA Frequently Asked Questions

PFML is much broader. For 2026, you generally qualify if you earned at least $6,300 during your base period (the last four completed calendar quarters) and at least 30 times your potential weekly benefit amount.8Mass.gov. Paid Family and Medical Leave (PFML) Information for Employees Overview There’s no minimum employer size, no service length requirement, and no hours-worked test. Part-time employees, seasonal workers, and some former employees can qualify. Self-employed people and independent contractors aren’t automatically covered but can opt in by filing a Self-Employed Notice of Election with the Department of Family and Medical Leave and registering through MassTaxConnect.9Mass.gov. Paid Family and Medical Leave Coverage for Self-Employed Individuals

The practical result: many Massachusetts workers who don’t qualify for a single day of FMLA still have access to weeks of paid, job-protected PFML.

Intermittent Leave and Your Weekly Cap

Neither program forces you to take your weeks in one continuous block. PFML allows intermittent leave (separate chunks) and reduced-schedule leave (fewer hours per day or week) for most qualifying reasons. The main restriction: intermittent PFML bonding leave requires your employer’s agreement, so if the employer says no, that bonding time has to be taken continuously.10Mass.gov. Understanding the Different Ways You Can Schedule Your Leave

Federal FMLA follows a similar pattern. Intermittent FMLA leave is available for a serious health condition when medically necessary, and intermittent bonding leave requires employer consent. Taking leave intermittently doesn’t add to your weekly ceilings; it spreads the same 12, 20, or 26 weeks across a longer calendar window. For intermittent PFML, the seven-day waiting period starts after your first reported absence and runs for seven consecutive calendar days from that point.4Mass.gov. Claiming the Time You’re Entitled To

Notice comes first. If your leave is foreseeable (a scheduled surgery, an expected due date), give your employer at least 30 days’ advance notice. If the need is unforeseeable, notify your employer as soon as it’s practical.4Mass.gov. PFML applications go through paidleave.mass.gov, and you can file up to 60 days before your leave starts. Have your driver’s license or state ID, direct deposit information, your employer’s federal EIN, and medical documentation from a healthcare provider (or birth, adoption, or placement records for bonding leave).4Mass.gov. FMLA doesn’t have a separate application; you request it from your employer, who is then required to tell you whether the leave qualifies and to notify you of your rights and responsibilities.
