How Many Dogs Can You Have in Houston? Limits and Breeder Permits

Houston limits you to three adult dogs per residential property when that property sits within 100 feet of another building where people live. The rule comes from Chapter 6, Article IV, Section 6-22 of the City of Houston Code of Ordinances, which makes it unlawful to keep four or more adult dogs on a residential lot that close to neighboring homes. If your property is farther than 100 feet from the nearest occupied building, the standard limit doesn’t apply the same way, though other city rules still do.

The 100 feet is measured in a straight line from the nearest point of your dog’s enclosure to the nearest point of the closest building used for human habitation. On standard Houston lots, almost every home falls inside that distance. For most owners and renters in the city, the practical rule is three.

What Counts as an Adult Dog

Houston treats any dog four months of age or older as an adult for counting purposes. That lines up with Texas rules requiring rabies vaccination by 16 weeks of age.1Cornell Law Institute. 25 Texas Admin Code 169.29 – Vaccination Requirement Once a puppy hits four months, it counts toward your three.

Puppies under four months don’t count. If one of your dogs has a litter, you have until those puppies reach four months to rehome them or otherwise bring the adult count back to three. You’re still responsible for every animal’s welfare in the meantime, and noise, sanitation, or neglect complaints can bring enforcement regardless of how the numbers add up.

Breeder Permits for Keeping More Than Three

Houston issues breeder permits that let you legally keep more than three adult dogs. The city recognizes three types:2Houston Permitting Center. BARC

  • Commercial breeder, for anyone breeding dogs for sale as a business.
  • Hobby or conformation breeder, for people breeding for shows, competitions, or personal interest rather than large-scale sales.
  • Non-commercial breeder, for anyone who simply allows a dog in their possession to produce offspring.

All three cost $120 and are governed by Section 6-114 of the Code of Ordinances.3City of Houston. Apartments and Condos

The three-dog limit applies to apartments and condominiums the same way it applies to single-family homes. The ordinance doesn’t draw different lines based on property type. The BARC director does have discretionary authority to impose additional restrictions on the number of animals allowed per unit or across a multi-family complex, so a lower cap can apply to a specific building.

Most Houston apartment complexes also set their own pet policies in the lease, often restricting the number of pets, breeds, or weight. Lease rules run alongside the city ordinance, and you have to follow whichever one is stricter.

When Federal Law Allows a Fourth Dog

Federal housing law can override the city’s limit in a rental setting. Under the Fair Housing Act, a person with a disability can request a reasonable accommodation to keep an assistance animal even where a landlord has a no-pets policy or a pet number cap applies. That covers both service animals trained for specific tasks and emotional support animals recommended by a healthcare provider.5U.S. Department of Housing and Urban Development (HUD). Assistance Animals

A housing provider must grant the request unless they can show the specific animal poses a direct threat to health or safety, would cause significant property damage, or that the accommodation would impose an undue financial burden.5U.S. Department of Housing and Urban Development (HUD). Assistance Animals Landlords also cannot charge pet deposits or fees for assistance animals. If you have a legitimate disability-related need for a fourth dog, the three-dog cap may not be the final word on a rental.

Vaccination and Microchipping Apply to Every Dog

Whatever your count, Houston requires every dog four months and older to have a current rabies vaccination. Texas law sets the vaccination deadline at 16 weeks of age.1Cornell Law Institute. 25 Texas Admin Code 169.29 – Vaccination Requirement The city also requires microchipping for dogs in this age group.

If you apply for a breeder permit, you’ll need vaccination certificates for every animal on the property. And when animal control responds to a complaint, current vaccination records are the first thing they check. Keeping those up to date is the simplest way to stay out of enforcement trouble, whether you have one dog or three.
