How Many Types of Disabilities Does Florida Recognize?

Florida does not maintain a single official list of the types of disabilities recognized in the state. Each program, protection, or benefit uses its own definition. The civil rights statutes cast the widest net, developmental disability services name only seven qualifying conditions, special education lists more than a dozen, and parking permits, workers’ compensation, and property tax exemptions each apply their own criteria. A condition that qualifies you under one framework will not always qualify you under another, so the practical question is not “am I disabled in Florida” but “am I disabled for this specific program.”

The Broad Civil Rights Definition

Two Florida statutes carry the widest definitions and cover the most people. Section 413.08 defines an individual with a disability as someone with a physical or mental impairment that substantially limits one or more major life activities, and lists those activities as caring for yourself, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning, and working.1FindLaw. Section 760.22, part of the Florida Civil Rights Act, uses a three-prong version of the same idea: you are covered if you have a physical or mental impairment that substantially limits a major life activity, if you have a record of such an impairment, or if you are regarded as having one.2Florida Senate. Florida Code 760.22 – Definitions That third prong protects people who face discrimination based on perception, even when the perception is wrong.

The federal Americans with Disabilities Act uses the same three-prong structure and adds a longer list of major life activities, including eating, sleeping, standing, lifting, bending, reading, concentrating, thinking, and communicating, plus major bodily functions like immune, digestive, and neurological function.3Office of the Law Revision Counsel. 42 USC 12102 – Definition of Disability Because federal law applies alongside Florida law, you can rely on whichever framework provides broader coverage for your situation.

Neither Florida definition requires that your condition last 12 months. The one-year rule belongs to Social Security, not to Florida’s own antidiscrimination and service animal protections.

Where These Definitions Apply

Section 760.10 makes it illegal for employers, employment agencies, labor organizations, and licensing bodies to discriminate on the basis of disability, using the 760.22 definition.4The Florida Legislature. Florida Code 760.10 – Unlawful Employment Practices The Fair Housing provisions of Chapter 760 require landlords and housing providers to make reasonable changes to rules and policies for equal access, such as waiving a no-pets policy for an assistance animal. If your disability or need is not obvious, a housing provider can ask for documentation from a licensed healthcare provider, but cannot demand a specific diagnosis, a registration certificate, or proof of training. The Seven Developmental Disabilities

For services through the Agency for Persons with Disabilities under Chapter 393, Florida law names exactly seven qualifying conditions:5Justia Law. Florida Code 393.063 – Definitions

  • Intellectual disability
  • Cerebral palsy
  • Autism
  • Spina bifida
  • Down syndrome
  • Phelan-McDermid syndrome
  • Prader-Willi syndrome

Two additional requirements apply: the condition must have appeared before age 18, and it must constitute a substantial handicap reasonably expected to continue indefinitely. If your condition is not on this list, APD cannot serve you under Chapter 393 no matter how severe the functional limitations. Meeting APD eligibility does not guarantee immediate services. The iBudget Home and Community-Based Services Medicaid waiver has a substantial waitlist, and placement depends on funding and whether your situation qualifies as a crisis.

Educational Disability Categories

Florida’s Exceptional Student Education program recognizes a wider set of disabilities than APD. Under Section 1003.01, a student qualifies as an “exceptional student” with any of the following:7The Florida Legislature. Florida Code 1003.01 – Definitions

  • Intellectual disability
  • Autism spectrum disorder
  • Speech impairment
  • Language impairment
  • Orthopedic impairment
  • Other health impairment
  • Traumatic brain injury
  • Visual impairment
  • Emotional or behavioral disability
  • Specific learning disability, including dyslexia, dyscalculia, and developmental aphasia
  • Deaf or hard of hearing
  • Dual sensory impairment

Children who are hospitalized or homebound also qualify, as do children from birth through age 9 with documented developmental delays. A child could qualify for school-based services without meeting APD’s developmental disability criteria, and a child on APD’s list still accesses school services through ESE rather than APD.

Disabled Parking Permit Conditions

Section 320.0848 issues disabled parking permits based on mobility, not disability category. A physician, podiatrist, or the VA must certify legal blindness or one of the following:8Florida Senate. Florida Code 320.0848 – Disabled Parking Permits

  • Inability to walk 200 feet without stopping to rest
  • Inability to walk without a brace, cane, crutch, prosthetic, or similar device, unless the device restores walking ability enough to eliminate severe limitation
  • Permanent wheelchair use
  • Lung disease with a forced expiratory volume under 1 liter per second, or arterial oxygen below 60 mm/Hg at rest
  • Portable oxygen use
  • Cardiac condition classified as Class III or IV under American Heart Association standards
  • Severe walking limitations from an arthritic, neurological, or orthopedic condition

Someone with a developmental disability who walks independently will not qualify. Someone with severe arthritis and no formal disability classification will.

Workers’ Compensation Disability

Florida’s workers’ compensation system under Chapter 440 uses its own classifications for injuries that cause lasting impairment. Permanent total disability, the most serious classification, pays two-thirds of average weekly wages for as long as the disability continues.   • Spinal cord injury involving severe paralysis of an arm, leg, or trunk
  • Amputation of an arm, hand, foot, or leg with effective loss of use
  • Severe brain or closed-head injury causing major sensory, motor, communication, or neurological disturbances
  • Burns covering at least 25% of the body (second- or third-degree) or 5% of the face and hands (third-degree)
  • Total or industrial blindness

For less severe permanent injuries, a licensed physician assigns a percentage rating using the American Medical Association’s Guides to the Evaluation of Permanent Impairment. Injuries rated 1–10% get two weeks of benefits per percentage point, with more generous scales at higher ratings.

Property Tax Exemption Categories

Florida offers full homestead property tax exemptions to residents with certain specific disabilities. If you are a quadriplegic, your homestead is completely exempt with no income restriction. If you are a paraplegic, hemiplegic, or another totally and permanently disabled person who uses a wheelchair for mobility or is legally blind, you also qualify for a full exemption, but only if total gross household income was $14,500 or less in the prior year, counting VA benefits and Social Security.10Florida Senate. Veterans with a service-connected total and permanent disability certified by the VA qualify for a separate full homestead exemption with no income cap, and surviving spouses may also be eligible.11Florida Senate. The Federal Social Security Standard

Social Security disability benefits use a stricter test than any Florida definition. This standard matters for Floridians because qualifying for SSI often opens the door to Medicaid, which funds many APD-coordinated services. You can qualify for Florida civil rights protections under Section 760.22 without meeting Social Security’s test, and you can meet Social Security’s test without fitting APD’s seven-condition list.

Finding the Right Framework for Your Situation

Start with what you need. If you are looking at workplace or housing discrimination, use the broad Section 760.22 definition and the parallel federal ADA standard. If you need long-term developmental disability services through APD, your condition must appear on the seven-item list in Section 393.063 and have started before age 18. If you are seeking school services for a child, work from the ESE list under Section 1003.01, which is broader. For a parking permit, the question is mobility as measured by the specific medical criteria in Section 320.0848. For workplace injuries, the workers’ compensation categories in Section 440.15 apply. For property tax relief, the qualifying conditions are narrow and named in Sections 196.101 and 196.081. And for cash benefits and Medicaid access, the Social Security standard applies, separate from all of the above.

The same person can be disabled for one purpose and not another, and that is by design. Each framework was built for a specific kind of support, and each answers a different question about what the state or federal government owes you.
