A deposition in Florida typically costs between $1,000 and $5,000, and complex cases involving expert witnesses can run well beyond that. There is no single fee that controls the price. The final bill is a stack of separate charges from the court reporter, the videographer, the attorneys, and the witnesses, each billed on its own terms. Attorney time is almost always the largest piece.
Court Reporter and Transcript Charges
The court reporter creates the word-for-word record of the deposition, and their charges form the baseline cost. Reporters in Florida bill two separate fees: an appearance fee for sitting through the session, and a per-page fee for producing the transcript afterward.
Appearance rates vary by judicial circuit. The Tenth Judicial Circuit’s rate sheet, effective July 1, 2024, sets the first hour at $75 and each additional hour at $50.1Justice Administrative Commission. Circuit 10 – Court Reporter Rates Other circuits publish their own schedules, and private reporters working outside the court-appointed system often charge more. For a three-hour session, the appearance portion alone generally runs $175 to $300.
The transcript is where the numbers quietly climb. Under the Tenth Circuit’s current schedule, standard delivery runs $5.95 per page, five-day rush is $7.95 per page, and 24-hour turnaround jumps to $10.95 per page.1Justice Administrative Commission. Circuit 10 – Court Reporter Rates An hour of testimony usually produces 30 to 60 pages, so a three-hour deposition can generate 90 to 180 pages. At the standard rate, that is roughly $535 to $1,070 just for the original transcript. Additional copies cost $2.00 per page.
Video is a separate decision. A legal videographer typically charges $300 to $600 for a standard session, plus extra for synchronizing video to the transcript. Florida Rule of Civil Procedure 1.310 places the initial recording cost on the party who requests it.2The Florida Bar. Florida Rules of Civil Procedure – Rule 1.310 Depositions Upon Oral Examination If you do not need video, skipping it is one of the easiest ways to shrink the bill.
Attorney Time Is the Largest Expense
Attorney fees routinely outweigh every other line item, and they are the charge people most often underestimate. A Florida Bar survey found that 85 percent of responding attorneys bill over $275 per hour, and more than half charge above $350.3The Florida Bar. Bar Survey Examines Wages, Profitability, and Hourly Rates In Miami and other major markets, rates above $700 per hour are not unusual for experienced litigators.
The hours your lawyer bills for a deposition extend well beyond the time spent in the room. Preparation includes reviewing case files, organizing exhibits, and mapping out a questioning strategy, and it can take as long as the deposition itself. Afterward, the attorney reviews the transcript, flags admissions and inconsistencies, and works the testimony into the broader case strategy. A three-hour deposition can easily generate six to ten billable hours. At $350 per hour, that is $2,100 to $3,500 in attorney fees for one session.
Witness Fees
What you pay the person being questioned depends on whether they are a fact witness or a hired expert. The gap between the two is enormous.
Fact Witnesses
A fact witness is someone who saw or experienced something relevant to the case. Florida law pays them $5 per day of attendance and 6 cents per mile for travel.4Justia Law. Florida Code 92.142 – Witnesses; Pay If the witness is not a party to the lawsuit, you will also need to serve them with a subpoena. Process server fees in Florida generally run $40 to $100 for routine local service, more if the person is hard to find.
Expert Witnesses
Experts are a different budget category entirely. Doctors, engineers, economists, and accident reconstructionists commonly charge $300 to $750 per hour for deposition testimony, and specialists in high-demand fields can exceed $1,000 per hour. The national average for expert deposition time hovers around $450 per hour, with Florida rates varying by specialty and market.
The meter does not stop at the deposition itself. Experts also charge for reviewing case materials, forming opinions, and travel. A four-hour deposition with two hours of preparation at $500 per hour comes to $3,000 from the expert alone.
If you want to recover expert fees from the other side later, Florida imposes a specific procedural requirement. You must give the opposing party a signed written report summarizing the expert’s opinions and supporting materials at least 5 days before the expert’s deposition, or 20 days before the discovery cutoff, whichever comes first.5Online Sunshine. Florida Statutes 57.071 – Costs; Expert Witness Fees Miss that deadline and the court may refuse to award those fees as recoverable costs.
Other Charges to Expect
Several smaller items can appear on the final bill that people do not plan for.
- Conference room rental: depositions often happen in rented office space rather than a courtroom. Rates in Florida typically run $35 to $75 per hour, more for premium downtown locations.
- Interpreter services: when a witness does not speak English fluently, a certified interpreter is required, usually at $25 to $75 per hour depending on the language. Translation of foreign-language exhibits adds further cost.
- Cancellation fees: court reporters and videographers generally require 24 hours’ notice to cancel without charge. Short-notice cancellations usually trigger a minimum appearance fee, and private reporting firms sometimes bill for half or all of the estimated session.6Twelfth Judicial Circuit Court of Florida. Administrative Order 2005-4.2 – Rates and Fees for Official Twelfth Judicial Circuit Court Reporters
- Exhibits: copying, binding, and organizing documents for a deposition can add $50 to $200 or more in a document-heavy case.
How Remote Depositions Change the Bill
Florida’s Rules of Civil Procedure allow depositions to be taken by communication technology if the parties agree or a court orders it.7FindLaw. In Re Amendments to Florida Rules of Civil Procedure 1.080 and 1.310 Video platforms have been a routine option since 2020. A remote deposition eliminates travel for attorneys, experts, and witnesses, and it removes the conference room charge entirely. Court reporters and videographers still bill their normal rates for remote sessions, but when out-of-town participants are involved, the overall savings can be substantial.
Who Pays Upfront and What You Can Recover
The party that notices the deposition pays the upfront costs: the reporter’s appearance fee, the transcript, and any videographer charges.2The Florida Bar. Florida Rules of Civil Procedure – Rule 1.310 Depositions Upon Oral Examination If the other side wants a copy of the video, they pay for that copy separately. Each party pays its own attorney.
Those upfront costs do not necessarily stay where they land. Under Florida Statute 57.041, the party that wins the lawsuit recovers legal costs from the losing side.8Online Sunshine. Florida Statutes 57.041 – Costs; Recovery From Losing Party Deposition expenses qualify as taxable costs under the Florida Supreme Court’s Uniform Guidelines for Taxation of Costs, which specifically list the original transcript and one copy, electronic deposition costs, and technician fees as recoverable items.9Supreme Court of Florida. Florida Supreme Court Opinion SC21-1581 – Amendments to Florida Rules of Civil Procedure – Uniform Guidelines for Taxation of Costs The prevailing party has to show each cost was reasonably necessary to prosecute or defend the case when it was incurred. A deposition that turned out to be irrelevant or duplicative can be denied. Courts look at whether taking the deposition was a reasonable strategic choice at the time, not whether it proved decisive at trial.
Expert fees follow a separate rule under Florida Statute 57.071, and the signed expert report must be delivered on time for those fees to become taxable.5Online Sunshine.
