A ticket for going 10 mph over the speed limit in Virginia costs $111 to prepay on an ordinary road: a $60 base fine plus a $51 court processing fee. That’s the sticker price. The real cost usually runs higher once demerit points, insurance increases, and location-based surcharges enter the picture.
How the $111 Breaks Down
Virginia sets prepayable speeding fines by statute at $6 for each mile per hour over the posted limit.1Virginia Code Commission. Virginia Code 46.2-878.3 – Prepayment of Fines for Violations of Speed Limits At 10 over, that’s $60. Every traffic infraction in a Virginia district court also carries a fixed $51 processing fee, whether you prepay or appear before a judge.2Virginia Code Commission. Virginia Code 16.1-69.48:1 – Fixed Fee for Misdemeanors, Traffic Infractions and Other Violations in District Court Add them together and prepayment totals $111.
Pay with a credit or debit card and the court tacks on a 4% convenience fee, bringing the card total to roughly $115.3Virginia Judicial System Court Self-Help. Pay Your Traffic Ticket Online Cash, check, or money order avoids the surcharge.
$111 is the floor, not the ceiling. A judge at a hearing can impose a higher fine than the prepayment schedule allows, and certain zones carry their own elevated fine structures.
Where 10 Over Costs More Than $111
The $6-per-mph rate applies on most Virginia roads. Three types of zones override it.
Highway Work Zones
Speeding through a highway work zone when workers are present and the signs show both the reduced limit and the penalty pushes the rate to $7 per mph, capped at a $500 maximum fine.4Virginia Code Commission. Virginia Code 46.2-878.1 – Maximum Speed Limits in Highway Work Zones; Penalty For 10 over, that’s $70 plus the $51 fee, so $121 total.
School Crossing Zones
In an active, properly marked school crossing zone, the rate is also $7 per mph, with a $250 maximum.5Virginia Code Commission. Virginia Code 46.2-873 – Maximum Speed Limits at School Crossings; Penalty At 10 over, prepayment comes to $121. A judge can go higher at a hearing, up to that $250 cap.
Virginia also uses photo speed cameras in school zones. A camera-issued ticket caps the civil penalty at $100 and adds no demerit points to your record.6Virginia Code Commission. Virginia Code 46.2-882.1 – Use of Photo Speed Monitoring Devices in Highway Work Zones, School Crossing Zones, and High-Risk Intersection Segments; Civil Penalty
Residence Districts
This is the surprise. Speeding in a posted residence district carries a flat $200 fine on top of $8 per mph over the limit, and no part of that $200 can be suspended unless the court orders 20 hours of community service.7Virginia Code Commission. Virginia Code 46.2-878.2 – Maximum Speed Limits in Certain Residence Districts; Penalty For 10 over: $200 + $80 + $51 = $331. Three times the standard rate.
Demerit Points
A conviction for 10 over adds four demerit points to your Virginia driving record. The conviction itself stays visible on your record for five years.8Virginia Department of Motor Vehicles. Four Point Violations The demerit points themselves affect your DMV standing for two years from the offense date.9Virginia Department of Motor Vehicles. Virginia also awards one safe driving point for every full calendar year of clean driving on a valid license, up to a maximum of five.10Virginia Department of Motor Vehicles. The Points System Those positive points cushion the four-point hit for drivers with clean records. A driver already carrying points from an earlier ticket has less margin.
If demerit points reach 12 in any 12-month period, or 18 in 24 months, the DMV Commissioner will require attendance at a driver improvement clinic.11Virginia Code Commission. Virginia Code 46.2-498 – Driver Improvement Clinics; Voluntary Attendance Keep piling them on past that and the license can be suspended.
What It Does to Your Insurance
The $111 fine is one and done. The insurance increase isn’t. Virginia insurers typically look at a three-to-five-year window of driving history when setting rates, and a four-point speeding conviction inside that window usually triggers a surcharge. Industry data from Virginia rate filings suggests a single moderate speeding ticket can raise premiums anywhere from 15% to 30%, depending on the carrier and your prior record. On a $1,500 annual policy, a 20% bump means an extra $300 a year. Stretch that over three to five years and you’re looking at $900 to $1,500 in added premiums on top of the ticket.
This is where the real cost hides. The fine is fixed; the insurance impact is larger and compounds. A driver with an otherwise clean record may want to weigh the cost of contesting the ticket or seeking a reduction against the premium hit of a guilty plea.
When Speeding Becomes Reckless Driving
A 10-over ticket is a traffic infraction, not a criminal charge. But Virginia’s reckless-driving-by-speed threshold is unusually low: 20 mph or more over the limit, or any speed over 85 mph regardless of the limit, is reckless driving.12Virginia Code Commission. Virginia Code 46.2-862 – Exceeding Speed Limit13Virginia Code Commission. Virginia Code 46.2-868 – Reckless Driving; Penalties14Virginia Code Commission. Virginia Code 46.2-393 – Suspension of License on Conviction of Reckless Driving
If you were cited on a road with a low posted limit, or if you suspect the officer’s radar reading was actually higher than 10 over, check the summons carefully to confirm the charge. The difference between an infraction and a misdemeanor is substantial.
Paying or Fighting the Ticket
A prepayable ticket gives you two choices: pay it or appear in court. Prepaying is an admission of guilt. You can prepay online through the Virginia court system, by mail at least seven days before your court date, or in person at the General District Court clerk’s office listed on the summons.15Virginia Court System. How to Pay Traffic Tickets and Other Offenses – General District Court Prepaying closes the case and locks in the conviction, the four demerit points, and the insurance consequences.
Going to Court
Court doesn’t guarantee a better outcome, but it opens options prepayment forecloses. A judge can reduce the charge, dismiss it, or offer alternatives such as a driver improvement course. For a standard 10-over infraction, the common courtroom result is negotiating down to a lower speed — say, 5 over — which lightens both the fine and the demerit points.
If You Don’t Pay
Missing the deadline triggers a cascade. If the court hasn’t received payment within 90 days of your court date and you haven’t set up a payment plan, the account goes to collections and interest begins accruing.15Virginia Court System. Virginia Code 16.1-69.48:1 – Fixed Fee for Misdemeanors, Traffic Infractions and Other Violations in District Court
Worse, Virginia law allows the court to suspend your driving privilege for unpaid fines and costs. The suspension takes effect 15 days after conviction if the amount remains unpaid and stays in place until you pay in full. If you can’t pay all at once, ask the court for a deferred payment or installment plan; the administrative fee is capped at $10.16Virginia Code Commission. Virginia Code 19.2-354 – Authority of Court to Order Payment of Fine in Installments That’s a better path than a suspended license and the legal and financial problems that come with it.
