If you were exposed to asbestos in New York and later diagnosed with mesothelioma, lung cancer, or another asbestos-related disease, your civil claim will almost certainly be filed in state court, and if the exposure happened in the five boroughs it will land on a specialized Manhattan docket called the New York City Asbestos Litigation, or NYCAL. New York asbestos lawsuits run on short, diagnosis-based deadlines, usually name dozens of defendants at once, and in the great majority of cases end in settlement rather than trial.
Deadlines to File
New York uses a discovery rule for asbestos claims. The statute of limitations does not start when you were exposed; it starts when you are diagnosed, or when you reasonably should have known about the disease.1Weitz & Luxenberg. Mesothelioma Statute of Limitations in New York From that point:
- A personal injury claim must be filed within three years of diagnosis.1Weitz & Luxenberg. Mesothelioma Statute of Limitations in New York
- A wrongful death claim brought by the family must be filed within two years of the date of death.1Weitz & Luxenberg. Mesothelioma Statute of Limitations in New York
If a defendant has filed for bankruptcy, the clock may be tolled while that proceeding is pending, and a family member can file on behalf of a victim who is hospitalized or incapacitated.1Weitz & Luxenberg. Mesothelioma Statute of Limitations in New York Cases are generally filed where the exposure occurred, which for New York City exposures means Supreme Court, New York County.
Where the Case Is Heard: NYCAL
NYCAL was created in 1988 under a Case Management Order to handle the volume of asbestos cases concentrated in New York County.2NY Courts. In Re New York City Asbestos Litigation Every case on the docket is governed by that periodically revised order, and a Special Master, currently Philip Goldstein, oversees discovery disputes and settlement conferences.3NYCAL. The Accelerated Docket
Reserved for living plaintiffs diagnosed with mesothelioma or others who are terminally ill with a life expectancy under one year. Two clusters are scheduled each year, in April and October, and cases on this track can resolve in a year or less.3NYCAL. Case Management Order
The Active (FIFO) Docket
Cases involving deceased plaintiffs, or living plaintiffs whose conditions don’t meet the accelerated threshold, move on a first-in, first-out basis through eight clusters a year. These cases typically take longer.3NYCAL. What Cases Are Worth
Roughly 95 percent of asbestos cases settle before trial. For mesothelioma, pre-trial settlements typically fall between $1 million and $2 million per plaintiff once the amounts recovered from all defendants are added together, while the median jury award nationally was about $7.7 million as of 2022. Settlements for non-malignant conditions such as asbestosis or pleural plaques are much lower, generally $10,000 to $50,000.6SWMW Law. Average Settlement Asbestos Claim NYCAL is widely regarded as a plaintiff-friendly venue, which tends to push settlement figures above what the same claim might command elsewhere.
The cases that do go to verdict can be very large. In May 2025, a New York County jury awarded $117 million to William and Victoria Durbec, the largest single-plaintiff asbestos verdict in state history. Durbec, a 75-year-old former Local 28 sheet metal worker and Marine, was diagnosed with pleural mesothelioma in 2022 after exposure to asbestos-containing spray-on fireproofing during construction of the original World Trade Center between 1968 and 1983. The jury found the sole remaining defendant, Mario & DiBono Plastering Co., 80 percent at fault, with the Port Authority and Tishman Realty & Construction each assigned 10 percent. Damages included $40 million for past pain and suffering, $38 million for future pain and suffering, and $39 million combined for loss of consortium.7Weitz & Luxenberg. Who Gets Sued
The identity of asbestos defendants has shifted. Most manufacturers of the most hazardous amphibole-containing products have gone through bankruptcy and now compensate victims through dedicated trusts. The defendants that remain in the tort system tend to be manufacturers or suppliers of chrysotile asbestos products, together with premises owners such as building operators and landlords where asbestos was present. As of 2015, the dominant plaintiff firm named an average of 38 defendants per lawsuit, with one case naming as many as 157.9Institute for Legal Reform. On the Edge: NYCAL at a Tipping Point A plaintiff’s total recovery is typically built from many separate settlements plus whatever is paid by any applicable trusts.
Bankruptcy Trusts
More than 60 asbestos bankruptcy trusts exist nationally, holding an estimated $30 billion for victim compensation.10Belluck & Fox. New York Asbestos Companies You can pursue civil claims against solvent defendants and file trust claims in parallel. NYCAL’s Case Management Order sets timing: accelerated-docket plaintiffs must file their trust claims at least 90 days before trial, and FIFO plaintiffs must file within 10 days of being placed in a trial cluster.2NY Courts. In Re New York City Asbestos Litigation A study of 175 New York trial cases found that only 54 percent of eligible plaintiffs disclosed their trust filings during discovery; the average eligible trust recovery was over $440,000 per plaintiff, and three plaintiffs were entitled to trust awards over $1 million. A pending Assembly bill, A00053, would require plaintiffs to file all trust claims within 45 days of filing suit and notify civil defendants within 30 days of the start of discovery.11McGivney & Kluger. What You Have to Prove
New York’s causation standard tightened in 2018. In Juni v. A.O. Smith Water Products Co., the Court of Appeals affirmed the reversal of an $11 million plaintiff verdict and held that general evidence linking asbestos to mesothelioma is not enough to prove that a specific defendant’s product caused a particular plaintiff’s disease. Expert testimony must offer a scientifically grounded assessment of the dose and duration of exposure attributable to that defendant’s product.12U.S. Chamber of Commerce. Juni v. A.O. Smith Water Products Co. The ruling rejected the “cumulative exposure” or “every exposure” theory that any amount of exposure suffices.13vLex. Juni v. A.O. Smith Water Products Co. A 2022 decision in Nemeth v. Brenntag North America reinforced that standard, and the First Department has since applied these precedents to reject several low-dose cases, with the practical effect that NYCAL claims increasingly turn on documented, substantial exposure to specific products.
A Boundary: Take-Home Exposure
New York does not recognize a duty owed by employers or premises owners to the household members of workers who carried asbestos fibers home on their clothing. In a 2005 ruling in In re New York City Asbestos Litigation, the Court of Appeals held that an employer’s duty to provide a safe workplace runs only to employees, not to their spouses or families, and that foreseeability alone does not create a duty here.14Irwin LLC. Take-Home Asbestos Exposure Duty Family members who were exposed secondhand can still bring claims under other theories, as the $75 million 2017 verdict for a maintenance worker’s wife shows, but the straightforward duty-based theory recognized in some other states is not available in New York.7Weitz & Luxenberg. Where Exposure Typically Happened
New York ranks fourth nationally for asbestos-related deaths, with approximately 15,200 deaths reported between 1999 and 2017, including 2,830 from mesothelioma.15Weitz & Luxenberg. Mesothelioma Lawyers New York The exposure sites that come up most often in New York cases include:

The mix of plaintiffs has shifted over the years. Many early NYCAL claimants were industrial workers at places like the Navy Yard or the utility powerhouses. More recent claims increasingly involve exposures from home remodeling, automotive repair, and general construction.9Institute for Legal Reform. On the Edge: NYCAL at a Tipping Point If your own exposure fits one of these patterns and you have a diagnosis, the practical next step is to document the job history and product contact in as much detail as possible, because under Juni that record is what a NYCAL case now rises or falls on.
