In West Virginia, how old you have to be to buy a gun depends on what you’re buying and from whom. At a licensed dealer, you must be 21 to buy a handgun and 18 to buy a rifle or shotgun. In a private sale between individuals, the federal floor drops to 18 for handguns, and there is no federal age minimum for long guns, though state possession rules still apply.
Buying a Handgun
At a Licensed Dealer
Federal law prohibits any federally licensed firearms dealer from selling a handgun to anyone under 21.1Bureau of Alcohol, Tobacco, Firearms and Explosives. Minimum Age for Gun Sales and Transfers Before the sale closes, the dealer runs a background check through the National Instant Criminal Background Check System.2Office of the Law Revision Counsel. 18 USC 922 For buyers under 21, that check can take longer than the usual three business days because the system also reviews juvenile records.
In a Private Sale
The 21-year floor is a dealer rule. In a private handgun sale between two West Virginia residents, federal law sets the minimum at 18. It is illegal for any person to sell or transfer a handgun to someone they know or have reasonable cause to believe is under 18.2Office of the Law Revision Counsel. 18 USC 922 An 18-year-old can legally buy a handgun from a neighbor or family friend. A 17-year-old cannot. No background check is required, but the seller still cannot complete the sale if the buyer is prohibited from possessing a firearm under state or federal law.3West Virginia Legislature. West Virginia Code 61-7-10 – Deadly Weapons for Sale or Hire; Sale to Prohibited Persons; Penalties
Buying a Rifle or Shotgun
At a Licensed Dealer
A licensed dealer can sell a long gun to anyone 18 or older, with the same NICS background check.1Bureau of Alcohol, Tobacco, Firearms and Explosives. Minimum Age for Gun Sales and Transfers
In a Private Sale
Federal law sets no age minimum for private long gun sales, and West Virginia does not add one.1Bureau of Alcohol, Tobacco, Firearms and Explosives. Minimum Age for Gun Sales and Transfers The practical limit is the state prohibition on transferring any firearm to someone barred from possessing one.3West Virginia Legislature. West Virginia Code 61-7-10 – Deadly Weapons for Sale or Hire; Sale to Prohibited Persons; Penalties Because unemancipated minors under 18 generally cannot possess deadly weapons under state law, a private seller who knowingly hands a rifle to a 15-year-old with no qualifying exception risks criminal liability.
Buying Ammunition
Ammunition follows the same age split as the firearm it’s meant for. A licensed dealer cannot sell handgun ammunition to anyone under 21 or long gun ammunition to anyone under 18.1Bureau of Alcohol, Tobacco, Firearms and Explosives. Minimum Age for Gun Sales and Transfers
Some calibers fit both handguns and rifles. The ATF’s position is that a dealer can sell interchangeable ammunition like .22 rimfire to a buyer at least 18, as long as the dealer is satisfied it is intended for a rifle. If the buyer intends to use it in a handgun, the 21-year threshold applies.4Bureau of Alcohol, Tobacco, Firearms and Explosives. Firearms Questions and Answers
Being Given a Gun Is Not the Same as Buying One
This is where people get tripped up. The age to buy a firearm and the age to possess one are different. An 18-year-old in West Virginia cannot walk into a gun store and buy a handgun, but that same person can lawfully own one that was given to them.
Gifts to Adults 18 and Older
West Virginia does not prohibit adults 18 and older from possessing handguns. A parent, grandparent, or other family member can gift a handgun to an 18-year-old, and the recipient can lawfully keep it. Federal law also permits bona fide gifts as long as the recipient is not a prohibited person. The gift has to be genuine. If the older relative walks into a store and buys a handgun with money the 18-year-old handed them, that’s a straw purchase, not a gift.
Minors Under 18
West Virginia prohibits unemancipated minors under 18 from possessing any deadly weapon, with narrow exceptions:5West Virginia Legislature. West Virginia Code 61-7-8 – Possession of Deadly Weapons by Minors; Prohibitions
- On property owned by the minor or their family.
- On someone else’s property with permission from both a parent or guardian and the property owner.
- While lawfully hunting, or traveling between a place they can legally possess the weapon and the hunting site.
Federal law adds another layer. Under 18 U.S.C. ยง 922(x), it is illegal to transfer a handgun to anyone under 18 or for a juvenile to possess one, with exceptions covering employment, farming, target practice, hunting, and safety courses, all with prior written parental consent.2Office of the Law Revision Counsel. 18 USC 922
Straw Purchases
A straw purchase happens when someone buys a firearm from a dealer on behalf of another person who is either prohibited from buying one or trying to avoid the background check. It is a separate federal crime carrying up to 15 years in prison.6Office of the Law Revision Counsel. 18 USC 932 If the firearm is later used in a felony, terrorism, or drug trafficking, the penalty jumps to up to 25 years. A real gift, where you spend your own money and the recipient can legally possess the firearm, is not a straw purchase. Buying a handgun at a store “as a gift” for someone who handed you the cash is exactly the transaction federal prosecutors pursue.
Who Cannot Buy or Possess Regardless of Age
Meeting the age requirement doesn’t matter if you’re in a prohibited category. Federal law bars several groups from possessing firearms or ammunition, including anyone who:7Bureau of Alcohol, Tobacco, Firearms and Explosives. Identify Prohibited Persons
- Has been convicted of a crime punishable by more than one year in prison.
- Is a fugitive from justice.
- Is an unlawful user of or addicted to any controlled substance.
- Has been adjudicated as mentally defective or committed to a mental institution.
- Is in the United States unlawfully.
- Was dishonorably discharged from the military.
- Has renounced U.S. citizenship.
- Is subject to certain domestic restraining orders.
- Has been convicted of a misdemeanor crime of domestic violence.
West Virginia’s prohibited categories overlap substantially with the federal list and add state-specific grounds, including habitual addiction to alcohol.8West Virginia Legislature. West Virginia Code 61-7-7 – Persons Prohibited From Possessing Firearms
The controlled substance category catches more people than expected. Marijuana remains a Schedule I drug under federal law, and the federal government treats any current marijuana user as a prohibited person regardless of state legalization. As of early 2026, the Supreme Court is considering a challenge to this prohibition. Until that case is decided, using marijuana while possessing a firearm is a federal crime carrying up to 15 years in prison.
Carrying a Handgun at 18
West Virginia is a constitutional carry state, so no permit is required to carry a concealed handgun if you’re legally eligible to possess one. Permitless carry was limited to those 21 and older until 2026, when the legislature passed and the governor signed a bill extending it to adults 18 and older who are not prohibited persons. If you’re 18 or older, a U.S. citizen or legal resident, and not otherwise barred, you can carry a concealed handgun in West Virginia without a license.
An optional Concealed Handgun License is still useful for travel, since many other states recognize West Virginia’s CHL through reciprocity but don’t honor permitless carry by non-residents. The standard CHL is available at 21; a provisional CHL covering the same reciprocity purposes is available to adults 18 to 20 through the county sheriff.9West Virginia Legislature.
