How Old Do You Have to Be to Buy Delta 8 in NC?

There is no state-mandated minimum age to buy delta-8 in NC. North Carolina law does not set an age limit for purchasing hemp-derived THC products, so whether a store asks for ID is left to the retailer. Most responsible shops voluntarily card buyers and require them to be 21, but that is store policy, not a legal requirement.

Why North Carolina Has No Legal Age Limit

When the General Assembly passed the North Carolina Farm Act of 2022, it permanently excluded hemp and hemp-derived cannabinoids from the state’s definition of marijuana, so long as the delta-9 THC concentration stays at or below 0.3%.1North Carolina General Assembly. Senate Bill 762 – North Carolina Farm Act of 2022 Delta-8 THC falls within that legal hemp category. But neither G.S. 90-87 nor any other section of the Controlled Substances Act attaches an age restriction to buying these products.

The gap is not hypothetical. A 16-year-old can legally walk into a gas station in North Carolina and buy delta-8 gummies. Legislators, doctors, and law enforcement have raised the issue publicly, and the FDA has specifically pointed out that delta-8 products are sold at gas stations and similar outlets “where there may not be age limits on purchases.”2U.S. Food and Drug Administration. 5 Things to Know about Delta-8 Tetrahydrocannabinol – Delta-8 THC

What Stores Actually Require

In practice, the age you’ll be held to depends on where you shop. Specialty hemp shops and established online sellers are generally consistent about checking ID and refusing sales to anyone under 21. Convenience stores and gas stations are far less reliable, and some don’t card at all. If you want a clear answer before you walk in, call ahead and ask the store’s policy.

Bills That Would Set 21 as the Legal Floor

Two bills in the current session would change this. House Bill 328, “Regulate Hemp-Derived Consumables,” would prohibit selling any hemp-derived consumable to a person under 21.3North Carolina General Assembly. House Bill 328 – Regulate Hemp-Derived Consumables House Bill 680 goes further, requiring businesses that sell THC products to obtain a license and imposing penalties for sales to anyone under 21.4North Carolina General Assembly. House Bill 680 Similar efforts stalled in the Senate during earlier sessions, so passage isn’t guaranteed. As of early 2026, neither has become law.

Two Things to Know Before You Buy

Delta-8 Will Show Up on a Drug Test

Standard workplace urine screens cannot tell delta-8 apart from delta-9. A National Institute of Justice study tested six commercial immunoassay screening kits and found that every one of them cross-reacted with delta-8 THC and its metabolites, producing results indistinguishable from illegal marijuana use. The researchers called this “forensically significant” because a legal substance can trigger a result with “detrimental legal ramifications.”5National Institute of Justice. The Cross-Reactivity of Cannabinoid Analogs (Delta-8-THC, Delta-10-THC, and CBD) and Their Metabolites in Urine For pre-employment screens, DOT physicals, or court-ordered monitoring, delta-8 use carries the same practical risk as marijuana use.

You Can Still Be Charged With DWI

North Carolina’s impaired driving statute, G.S. 20-138.1, makes it illegal to drive “while under the influence of an impairing substance,” and delta-8 qualifies.6North Carolina General Assembly. North Carolina General Statutes 20-138.1 – Impaired Driving There’s no specific THC threshold the way there is for alcohol. If an officer concludes you’re impaired based on behavior or field sobriety performance, that can be enough for a charge. The fact that delta-8 is legal to buy is no defense.

Checking Product Quality on Your Own

Because North Carolina doesn’t regulate delta-8 the way it regulates alcohol or tobacco, quality control falls on the buyer. Ask for a Certificate of Analysis from an independent, accredited lab before you purchase. A legitimate COA shows the full cannabinoid profile, confirms delta-9 THC is at or below 0.3%, and reports results for pesticides, heavy metals, and residual solvents. The lab should be named with its credentials.

Reputable online sellers link lab reports directly from the product page. A physical shop should have them ready on request. If a store can’t or won’t produce test results for what they’re selling, buy somewhere else. The FDA has warned that most delta-8 is produced by chemically converting CBD, sometimes with household chemicals in uncontrolled settings, and the process can leave harmful byproducts in the finished product.2U.S. Food and Drug Administration. 5 Things to Know about Delta-8 Tetrahydrocannabinol – Delta-8 THC A COA is how you tell the difference.
