Florida sets no minimum age requirement for a medical marijuana card in Florida. If You Are 18 or Older
The process is direct. A qualified physician diagnoses you with a qualifying condition, decides that medical marijuana would help more than harm, and enters a certification for you into the state’s Medical Marijuana Use Registry. You then apply for the identification card yourself. No one else’s consent is required, and you can purchase and possess your own marijuana once the card and certification are both active.2Online Sunshine. If the Patient Is Under 18
Minors can legally use medical marijuana in Florida. The statute layers on safeguards that don’t apply to adults, and every one of them involves another person in the process.
A Second Physician Has to Agree
Before a minor can be certified, a second physician must independently review the case and concur that the benefits outweigh the risks. That concurrence has to be documented in the patient’s medical record.2Online Sunshine. Florida Statutes 381.986 – Medical Use of Marijuana For most product forms, any qualified physician can serve as the second opinion.
Smokable marijuana is a narrower question. It can only be recommended for a minor when the patient has a terminal condition, the certifying physician determines smoking is the most effective delivery method, and a board-certified pediatrician concurs with both conclusions. The certifying physician also has to obtain written informed consent from the parent or legal guardian using a standardized form that spells out the health risks of smoking for someone under 18.2Online Sunshine. A Parent or Guardian Has to Act as Caregiver
A minor cannot buy or possess medical marijuana on their own. A parent or legal guardian must be designated as the patient’s caregiver in the registry, and only that caregiver can purchase marijuana from a dispensary and administer it to the child.2Online Sunshine. Adult patients are generally limited to one caregiver. Minors are an exception: both parents or legal guardians can register as caregivers for the same child.2Online Sunshine. Florida Statutes 381.986 – Medical Use of Marijuana
Qualifying Conditions Apply at Any Age

- Cancer
- Epilepsy
- Glaucoma
- HIV or AIDS
- PTSD
- ALS (amyotrophic lateral sclerosis)
- Crohn’s disease
- Parkinson’s disease
- Multiple sclerosis
- Chronic nonmalignant pain
- A terminal condition diagnosed by a physician other than the one issuing the certification
The statute also allows conditions comparable in kind or class to those listed, which gives physicians some discretion for severe cases not named directly.
Florida Residency Is Also Required
Age isn’t the only threshold. You have to be a Florida resident. Full-time residents need a valid Florida driver’s license or state identification card.3Office of Medical Marijuana Use. Registry Identification Cards
Seasonal residents without a Florida ID can still qualify by providing two documents proving a Florida address, such as a deed or lease, utility bills no more than two months old, bank statements, or mail from a government agency.3Office of Medical Marijuana Use. Registry Identification Cards Florida does not recognize medical marijuana cards from other states, so an out-of-state card will not work at a Florida dispensary.
Two Clocks to Watch After Approval
The identification card is valid for one year from approval, and you can submit a renewal up to 45 days before it expires. The fee is $75, plus a small convenience charge if you pay online.3Office of Medical Marijuana Use. Registry Identification Cards
The physician certification runs on a different clock. It’s valid for 210 days, roughly seven months, and both the card and the certification have to be active before a dispensary will sell to you or your caregiver.2Online Sunshine. Florida Statutes 381.986 – Medical Use of Marijuana The certification usually lapses first. If it does, purchases stop until your doctor renews it, even if the card itself still has months left.
