Do You Actually Need a License

Be aware that Pennsylvania taxes an unusually long list of services, including computer programming and data processing, building cleaning and maintenance, pest control, lawn care, secretarial and editing work, employment agency and temporary staffing services, credit reporting, debt collection, and lobbying. What to Gather Before You Start

Pennsylvania uses a single form, the PA-100, completed digitally through myPATH, to set up all your state business tax accounts at once. Having your information ready keeps most applicants under 30 minutes. You’ll need:

  • Your business legal name and any trade name or DBA
  • Physical address and mailing address, if different
  • Employer Identification Number from the IRS (sole proprietors without employees can use a Social Security Number instead)
  • Business structure: sole proprietorship, partnership, LLC, corporation, and so on
  • The date your business started or will start selling in Pennsylvania
  • A description of your business activities and the products or services you sell
  • Your six-digit NAICS industry classification code, which you can look up on the Census Bureau’s website if you don’t already have it

Registering Through myPATH

If you’ve never registered a business with Pennsylvania before, use the “Pennsylvania Online Business Tax Registration” service. You don’t need to create a myPATH account first. A paper PA-100 can be mailed to the Pennsylvania Department of Revenue, Bureau of Business Trust Fund Taxes, at the address printed on the form. Paper takes longer to process, and the department clearly directs applicants online.

What Happens After You Apply

Online applications are typically processed within a few business days. You’ll get an email confirmation with your 8-digit License ID, and the physical certificate arrives by mail afterward. Keep it. Pennsylvania expects the certificate to be available at your place of business.

Once you’re registered, the Department of Revenue assigns your filing frequency based on how much sales tax you collect, measured against your third-quarter (July through September) activity:

  • Monthly filing if you report $600 or more in sales tax during Q3
  • Quarterly filing if you report between $75 and $599.99
  • Semi-annual filing if you report less than $75

Your license is valid for five years. If your returns and payments are current when renewal time comes, the Department of Revenue automatically issues a new license with a fresh expiration date. What Happens If You Skip Registration

Under Act 46 of 2003, Department of Revenue enforcement agents can cite anyone selling taxable goods or services without a valid sales tax license. Each violation carries a fine between $300 and $1,500, and a person who refuses to pay can be jailed for 5 to 30 days. One more thing worth knowing before you start collecting: the sales tax you collect from customers is not your money. Pennsylvania treats it as funds held in trust for the state. If you collect it and spend it instead of remitting it, you face personal liability regardless of your business structure. Forming an LLC or corporation won’t fully shield you here.
