How to Apply for Child Support in Oklahoma: Forms, Filing, and Next Steps

To apply for child support in Oklahoma, fill out the Application for Child Support Services (Form 03EN001E) and submit it to Oklahoma Child Support Services (CSS) online at okbenefits.org, by mail to the Case Initiation Center, or in person at a local CSS office.1Oklahoma Department of Human Services. Application for Child Support Services Overview CSS, a division of Oklahoma Human Services, then handles locating the other parent, establishing paternity if necessary, and getting a support order in place.

Who Can Apply

CSS provides services to custodial parents, noncustodial parents, and any person responsible for paying or receiving child support.2Oklahoma Department of Human Services. Child Support Services Frequently Asked Questions The most common applicant is the custodial parent, the person the child lives with most of the time.

A noncustodial parent can also open a case. Doing so creates a formal record of every payment made. Without a CSS case or court order, there is no official proof of what has been paid, and a custodial parent could later claim arrears.

Guardians and other caretakers with legal custody can apply for support from one or both biological parents. In a minor guardianship, both parents typically owe support to the guardian.2Oklahoma Department of Human Services. Child Support Services Frequently Asked Questions

One group does not need to apply at all. If the child receives Temporary Assistance for Needy Families (TANF), Title IV-E foster care benefits, or TANF-related Medicaid, CSS automatically opens a child support case without a separate application.3Justia. What to Gather Before You Start the Form

The application asks for detailed information about both parents and the child. Pull these items together before you sit down with Form 03EN001E:

  • The child’s full legal name, date of birth, and Social Security number, plus a certified copy of the birth certificate.
  • Both parents’ full legal names, dates of birth, Social Security numbers, current and past addresses, phone numbers, and employment details including employer names, addresses, and pay frequency.
  • Copies of any existing court documents: divorce decrees, prior support orders, paternity orders, or a signed Acknowledgment of Paternity.

The more you can provide about the other parent, the faster the case moves. If you don’t know their current employer or address, include whatever you do have. CSS has access to state and federal databases that can fill in gaps, but every detail you supply saves time.

An incomplete application may be returned for additional information, which delays everything that follows.1Oklahoma Department of Human Services. Application for Child Support Services Overview Check every field before you submit.

What CSS Does After You Apply

Once CSS receives a complete application, it opens a case and works through up to three stages before a support order is in place.

Locating the Other Parent

If the noncustodial parent’s whereabouts are unknown, CSS searches state and federal databases to find an address and employer. That can include tax records, motor vehicle records, and employer-reported wage data. The search sometimes takes weeks, but CSS has tools individual parents typically don’t.

Establishing Paternity

When the parents were not married at the time of the child’s birth and paternity has never been legally established, CSS must resolve that before creating a support order. Either parent can sign an Acknowledgment of Paternity voluntarily, but Oklahoma Human Services warns against signing unless both parents are certain about the child’s biological father.4Oklahoma Department of Human Services. Paternity Frequently Asked Questions When there is any doubt, CSS arranges DNA testing. If the alleged father doesn’t cooperate, CSS can ask the court to enter a default paternity order.5Legal Information Institute. Oklahoma Administrative Code 340:25-5-176 – Establishment of Parentage

Setting the Support Order

After paternity is established and the noncustodial parent is located, CSS works to create a legally binding order. This can happen through an administrative hearing conducted by the Office of Administrative Hearings: Child Support, or through a district court action.6Justia. Oklahoma Code 56-240.3 – Appeals The order sets a specific monthly amount, designates who receives payment, and includes a medical support provision covering health insurance for the child.

How the Payment Amount Is Calculated

Oklahoma uses an income-shares model. The support amount is based on what both parents earn combined, not just the paying parent’s income. The obligation is computed as a percentage of the combined gross income of both parents using the Child Support Guideline Schedule.7Justia. Oklahoma Code 43-118D – Computation of Child Support as Percentage of Parents Combined Gross Income

Gross income is defined broadly. It includes wages, salaries, tips, commissions, bonuses, severance pay, and military pay. It also covers passive income such as dividends, pensions, rental income, Social Security benefits, workers’ compensation, unemployment benefits, gambling winnings, and royalties. Self-employment income counts after ordinary business expenses are subtracted. Fringe benefits like a company car or employer-provided housing count if they significantly reduce personal living expenses.8Justia. Oklahoma Code 43-118B – Computation of Gross Income

Each parent’s share of the base obligation is proportional to their share of the combined income. If one parent earns 60 percent of the combined total, that parent is responsible for 60 percent of the base obligation.7Justia. Oklahoma Code 43-118D – Computation of Child Support as Percentage of Parents Combined Gross Income The court then factors in childcare costs and health insurance premiums. Health insurance is considered reasonable in cost when the providing parent’s share of the premium doesn’t exceed 5 percent of that parent’s gross monthly income.9Oklahoma Department of Human Services. How Payments Move Once the Order Is in Place

All child support payments in Oklahoma flow through the Centralized Support Registry, whether CSS established the order or a private attorney did. Direct payments between parents don’t count toward the obligation unless a court order specifically allows it.

Most payments happen automatically through income withholding. Every child support order is subject to income withholding, meaning the employer deducts the payment from the noncustodial parent’s paycheck and sends it to the registry. A child support withholding order takes priority over virtually all other garnishments. The only thing that outranks it is a federal tax levy entered before the support order was established.10Oklahoma Department of Human Services. Employer FAQ

When income withholding isn’t possible, the noncustodial parent can pay through SMART e-Pay (a free online option that accepts bank accounts or debit and credit cards), MoneyGram ($1.99 fee), US Payments kiosks located throughout the state ($2 for cash or check), or a check mailed to the Oklahoma Centralized Support Registry at P.O. Box 268849, Oklahoma City, OK 73126-8849.11Oklahoma Department of Human Services. Child Support Payment Options

CSS no longer issues paper checks to custodial parents. Payments arrive either by direct deposit into a bank account or on an Oklahoma MasterCard debit card. Every custodial family automatically receives the debit card until direct deposit is set up.12Oklahoma Human Services.
