To apply for disability in New York, you file through one of two separate systems depending on how long your condition will keep you from working. For a temporary illness or injury expected to resolve within six months, you file Form DB-450 with your employer’s disability insurance carrier within 30 days of becoming disabled. For a condition expected to last at least 12 months or result in death, you apply to the Social Security Administration for SSDI, SSI, or both. The programs use different forms, different deadlines, and different eligibility rules, so the first decision is which one fits.
Which Program Fits Your Situation
New York State short-term disability covers off-the-job illness or injury for up to 26 weeks in any 52 consecutive weeks.1Workers’ Compensation Board. Disability Benefits – What are Disability Benefits? If your doctor expects you back on your feet within that window, this is your program.
Federal disability (SSDI or SSI) applies when your condition has lasted or is expected to last at least 12 months or result in death, and it prevents you from doing substantial work.2Social Security Administration. Disability Benefits – How Does Someone Become Eligible? SSDI is for workers who have paid into Social Security long enough to earn work credits (generally 40 credits, with 20 earned in the last 10 years, though younger workers may qualify with fewer). SSI is a need-based program with strict income and resource limits and no work-history requirement. Some people qualify for both.
Two boundaries matter. If your injury or illness happened at work or because of your work, that goes through Workers’ Compensation, not state disability.3Workers’ Compensation Board. Applying for NYS Short-Term Disability
The application is Form DB-450, the “Notice and Proof of Claim for Disability Benefits.” You can get a blank form from your employer’s HR office, from your employer’s insurance carrier, or by downloading the PDF from the Workers’ Compensation Board website.5Workers’ Compensation Board. DB-450 Notice and Proof of Claim for Disability Benefits
The form has three parts. You complete the employee section with your personal information, the date your disability began, and every employer you worked for during the eight weeks before you became disabled. That work history is how the carrier verifies eligibility and calculates your average weekly wage. Your healthcare provider (which can be a licensed physician, chiropractor, podiatrist, psychologist, dentist, or certified nurse midwife) completes Part B with the diagnosis, their license number, and an estimate of how long you’ll be unable to work.4Workers’ Compensation Board. Employee Eligibility / Benefits The onset date in the provider’s statement must match the date in your section. Mismatches give the carrier a reason to delay the claim. The employer completes the third part.
Submit the completed form to your employer or directly to your employer’s insurance carrier within 30 days of the date your disability began.6New York State Insurance Fund. Filing a Claim – NYSIF Late filing can reduce or delay benefits, so treat 30 days as firm. The Workers’ Compensation Board does not receive the initial filing unless there is a dispute or your employer lacks coverage.
If you are unemployed when you become disabled, where you file depends on timing. Workers unemployed less than four weeks file through their last employer’s insurance carrier. Workers unemployed more than four weeks who are collecting unemployment file through the Workers’ Compensation Board’s Special Fund for Disability Benefits, and the usual seven-day waiting period is waived.4Workers’ Compensation Board. The carrier has 45 days to approve your claim or send you a Notice of Rejection.3Workers’ Compensation Board. Disability Benefits for Workers
What State Benefits Pay and When They Start
The benefit equals 50 percent of your average weekly wage from the last eight weeks worked, capped at $170 per week.1Workers’ Compensation Board. Disability Benefits – What are Disability Benefits? This is partial wage replacement and will not come close to your full paycheck.
Payments do not begin on day one. There is a seven-day waiting period with no benefits paid; payments start on the eighth consecutive day of disability. The maximum is 26 weeks in any 52 consecutive weeks. If you work for wages or profit during your claim (even from home), you lose eligibility, and elective procedures like elective sterilization are not covered.4Workers’ Compensation Board. One overlap worth flagging for new parents: you may qualify for both short-term disability and New York’s Paid Family Leave after giving birth, but not at the same time. You can take them back-to-back (disability during recovery, then Paid Family Leave to bond), as long as the combined total does not exceed 26 weeks in a 52-week period.7NY.Gov. Applying for SSDI or SSI
You can start a federal disability application three ways: online through the SSA website, by phone, or in person at a local Social Security field office. The online system issues a confirmation number, which you will need for every follow-up.
Before you start, gather:
- Your Social Security number and proof of age, usually a birth certificate (other documents may be accepted).8Social Security Administration. Documents You May Need When You Apply – Supplemental Security Income (SSI)
- Names, addresses, phone numbers, and treatment dates for every doctor, hospital, clinic, and therapist you have seen, going back at least a year.
- A list of jobs held in the five years before you became unable to work, with titles, duties, and physical requirements like lifting, standing, and walking.9Social Security Administration. SSA-3368-BK – Disability Report – Adult
- A broader work history covering the 15 years before your disability began, requested on Form SSA-3369.10Office of Management and Budget. Work History Report – Form SSA-3369-BK
- For SSI only: bank statements, proof of income, and documentation of your living arrangements.
The main form is the SSA-3368, the Adult Disability Report. It asks you to describe each medical condition that limits your ability to work and to explain in concrete terms how your symptoms prevent you from doing your past job or any other work.9Social Security Administration. SSA-3368-BK – Disability Report – Adult Specifics carry weight. “I can only stand for 10 minutes before the pain becomes severe” is far more useful than “I have trouble standing.” The SSA publishes a free disability starter kit to help organize these materials before you file.
One eligibility threshold to understand before you file: if you are earning more than $1,690 per month in 2026 ($2,830 if you are blind), the SSA generally considers you capable of substantial gainful activity and will deny the claim.11Social Security Administration. Substantial Gainful Activity
After intake, the SSA forwards your file to the New York Division of Disability Determinations, a state agency within the Office of Temporary and Disability Assistance that performs the medical review on behalf of the federal government.12Office of Temporary and Disability Assistance. Division of Disability Determinations You may be scheduled for an independent medical examination at no cost. Expect roughly six to eight months for an initial decision.13Social Security Administration. How Long Does It Take to Get a Decision After I Apply for Disability? Respond to every request for records or exam appointments promptly; delays on your end push the decision back by the same amount.
When Federal Payments Actually Start
Approval does not mean an immediate check. SSDI has a mandatory five-month waiting period, and your first payment arrives in the sixth full month after the disability onset date the SSA assigns.2Social Security Administration. Disability Benefits – How Does Someone Become Eligible? If your onset date is January 15, your first payment covers July. This is a strong reason to apply as soon as you become unable to work. Every month of delay is another month before money arrives.
SSI has no five-month waiting period. In 2026, the maximum federal SSI payment is $994 per month for an individual and $1,491 for a couple, and other income you receive can reduce it.14Social Security Administration. SSI Federal Payment Amounts for 2026
If your condition is on the SSA’s Compassionate Allowances list (which includes certain cancers, ALS, early-onset Alzheimer’s, and over 200 other severe diagnoses), the agency flags your file automatically during review and decisions often come in weeks rather than months.15Social Security Administration. Compassionate Allowances (CAL) Conditions You do not need to request it.
If Your Claim Is Denied
Initial denials are common at the federal level, so plan for the possibility before you need it.
Federal Appeals
The SSA uses four appeal levels, and the deadline at each is 60 days from the date of the denial notice.16Social Security Administration. Understanding Supplemental Security Income Appeals Process
- Reconsideration: a different examiner reviews your entire file from scratch.17Social Security Administration. Request Reconsideration
- Hearing before an administrative law judge, where many denied claims are approved. You appear in person or by video before a judge who was not involved in earlier decisions.
- Appeals Council review, which may decline to hear your case.
- Federal district court.
Missing the 60-day deadline generally means starting over. If you have been denied at reconsideration, consider getting a representative before the hearing. You can hire an attorney or non-attorney representative at any stage, and most work on contingency. Federal law caps the fee at 25 percent of your past-due benefits or $9,200, whichever is less, with the cap remaining at $9,200 for 2026.18Federal Register. Maximum Dollar Limit in the Fee Agreement Process You pay nothing if the claim loses.
State Appeals
If your DB-450 claim is rejected, the carrier must send you a Notice of Rejection stating the reason, and you can request a hearing before the Workers’ Compensation Board.3Workers’ Compensation Board. Disability Benefits for Workers A vague rejection is worth pushing back on if your medical documentation is solid and your filing was timely.
