There is no application to file for Washington’s homestead exemption. Protection is automatic: the moment you occupy real or personal property as your principal residence, your equity is shielded from most creditor judgments under state law.1Washington State Legislature. A recorded declaration is only needed in two narrow situations, described below.
Why There Is No Form to File
Washington law defines a homestead as real or personal property, including a mobile home whether or not it sits on land you own, that you actually use or intend to use as your principal residence.2Washington State Legislature. Every homestead created under the chapter is presumed valid until a creditor successfully challenges it in court.3Washington State Legislature. Chapter 6.13 RCW – Homesteads – Section: RCW 6.13.070 The burden sits with the creditor to prove your property doesn’t qualify, not on you to prove it does.
Married couples and registered domestic partners can claim the exemption on community property, jointly owned property, or the separate property of either spouse. Both spouses can’t claim the same property separately to double the amount beyond what the statute allows for a single homestead.4Washington State Legislature. When You Do Need to Record a Declaration
Two situations require paperwork with the county recording officer. These are the closest things Washington has to an “application.”
Vacant Land You Plan to Build On
If you own vacant land, or land with a structure you haven’t moved into yet, and you want homestead protection before occupancy, you must file a declaration of homestead with the recording officer in the county where the property sits. If you already claim a homestead on a different property, you also have to file a declaration of abandonment for that other property at the same time.5Washington State Legislature. An Absence Longer Than Six Months
If you leave your homestead for more than six continuous months, the law presumes abandonment. To prevent that, record a declaration of nonabandonment before you leave. The declaration must state that you claim the property as your homestead, intend to return, and claim no other property as a homestead. It also needs to include where you’ll be living during your absence, how long you expect to be gone, why you’re leaving, and a legal description of the property.6Washington State Legislature. This matters in more circumstances than people expect. Military deployments, extended medical stays, sabbaticals, or a long renovation that forces you to live elsewhere can all start the six-month clock. Without the recorded declaration, a creditor who moves against your property during your absence can argue the exemption no longer applies, and you may end up litigating your intent to return.
How Much Equity Is Protected Automatically

- $125,000, the statutory floor that every Washington homeowner receives.
- The median sale price of a single-family home in your county for the preceding calendar year, if that figure is higher.
- An unlimited amount if a state is trying to collect income tax on pension or retirement benefits you received while living in Washington.
Courts use data from the Washington Center for Real Estate Research to determine the county median. You don’t need to look that number up unless a creditor moves to execute against your property, at which point the court handles the calculation. In many Puget Sound counties, the median comfortably exceeds $500,000, which is why most homeowners in those areas are protected well beyond the statutory floor.
Before 2021, the exemption was a flat $125,000 statewide. The legislature tied it to local home values, sharply increasing protection in high-cost counties. There is no separate cap above the county median; the statute simply says you get whichever number is greater.
Debts the Exemption Doesn’t Block

- Mortgages and deeds of trust you signed on the property. Both spouses or domestic partners must have signed, or the borrower must be unmarried.
- Mechanic’s and construction liens filed by contractors, laborers, or material suppliers who worked on your property.
- Court-ordered child support and spousal maintenance.
- Unpaid homeowners’ association or condominium association assessments.
- State Medicaid estate recovery for medical assistance paid on your behalf.
- Sales or use taxes you collected but failed to remit to the Department of Revenue.

If You Meant the Property Tax Exemption
Washington has a separate program that reduces property taxes for seniors, people with disabilities, and certain veterans. That one does require an application, income verification, and periodic renewals through your county assessor’s office. It’s governed by a different statute and has its own rules, including a minimum age of 61 (or 57 for surviving spouses) and income thresholds that vary by exemption level.9Washington State Legislature.
