Watch the Video Before You Decide Anything

Every Notice of Violation comes with a notice number and a PIN and a web address for the violation review portal. Log in and watch the clip. Most people don’t, and it’s the single most useful thing you can do.

What you’re checking for:

  • Did the light actually turn red before your front tires crossed the stop line, or were you already in the intersection when it changed?
  • Is the license plate in the still images clearly legible and actually yours?
  • Were you turning right?
  • Did you come to a stop after the line but before completing a right turn?
  • Was an emergency vehicle or an officer directing traffic visible in the frame?

If the video shows a clean straight-through violation with a sharp plate image, contesting it is likely to cost you more than the $158. If anything in the footage looks off, you have something to work with.

Defenses Written Into the Statute

Florida Statute 316.0083 lists the situations in which a red light camera ticket cannot stand. These aren’t arguments you have to invent.

You Weren’t the Driver

The notice goes to the registered owner, not the driver. If someone else was behind the wheel, or the vehicle had been stolen, you can submit a notarized sworn affidavit identifying the actual driver or stating the theft. Legal Right Turn on Red

This is where a large share of unjustified tickets come from. The statute forbids issuing a red light camera ticket when the driver made a right turn on red in a careful and prudent manner at an intersection where right turns are permitted. It also protects you if you came to a complete stop after crossing the stop line but before completing the turn.1Justia Law. The Notice Was Mailed Late

The issuing authority has 30 days from the alleged violation to mail the Notice of Violation.1Justia Law. If the postmark is beyond 30 days, the notice is untimely on its face. Save the envelope. People throw it away and lose this defense before they know they had it.

Emergency Vehicle or Funeral Procession

If you entered the intersection to yield to an authorized emergency vehicle, or as part of a funeral procession, the ticket should be dismissed. Bring documentation: a funeral program, a statement from the funeral home, or a record of an emergency response in the area at that time.

An Officer Waved You Through

If a law enforcement officer was directing traffic and signaled you through, the camera may still trigger, but the ticket should be dismissed. Documenting the officer’s presence after the fact is the hard part.

Unclear or Illegible Plate

The government has to prove the vehicle is yours from its own images. A blurry, obscured, or partially blocked plate leaves that link unproven. Look closely at the still images, not only the video.

Yellow Light Too Short

Florida requires a minimum yellow change interval of 3.4 seconds at all red light camera intersections, with longer intervals required at higher-speed approaches under the federal Manual on Uniform Traffic Control Devices.2Federal Highway Administration. Calibration and Maintenance Gaps

The camera system is supposed to have documented, regular testing and calibration. If those records are missing or overdue, the reliability of the evidence is open to attack. Request them from the local government or the camera vendor.

How to File Your Challenge

For any other defense, request the hearing in writing before the deadline. The hearing is administrative, run by a local hearing officer rather than a judge. If the officer upholds the violation, you’ll owe the $158 plus county or municipal costs that can reach $250. If the officer dismisses it, you owe nothing.

If It Already Became a Uniform Traffic Citation

If the 60 days ran out without a response, the Notice of Violation escalates into a Uniform Traffic Citation issued by law enforcement and pushed into county court. The fine goes up and court costs get added. The good news is that even a UTC at this stage still doesn’t add points to your license or get reported to your insurance.

Contact the Clerk of Court in the county where the violation occurred within 30 days of receiving the UTC to request a hearing. Missing that 30-day window brings additional fees and puts your license at risk.

Before the hearing, pull everything together: screenshots or recordings from the review portal, the envelope with the postmark if you’re arguing untimely notice, signal timing records, funeral or emergency documentation. If the government or vendor won’t hand over photos, video, calibration records, or maintenance logs, file a written discovery request with the court. If they ignore it, a motion to compel asks the court to order production. At the hearing, the government carries the burden of proving the violation from its own evidence. Skip the hearing and you can expect additional fines and a possible license suspension.

Do Not Ignore the Notice

The escalation is steep. Ignore the $158 Notice of Violation for 60 days and a UTC issues with a larger fine. Ignore the UTC for 30 days and the court clerk sends notice that your driver’s license will be suspended unless you comply and pay a delinquency fee within another 30 days.3Florida Legislature. A $158 notice can turn into hundreds of dollars, a suspended license, and reinstatement fees. Even if you’re sure the ticket is wrong, respond within the deadlines and contest it through the process.

What Isn’t at Stake

A red light camera violation in Florida, at either the Notice of Violation stage or the UTC stage, does not add points to your driving record and is not reported to the Department of Highway Safety and Motor Vehicles as a moving violation. Your insurer generally won’t see it and won’t raise your rates on the basis of it. That’s a real difference from a red light ticket written by an officer at the scene, which does go on your record. The one way the camera ticket bites your license is if you ignore it long enough to trigger a suspension.
