How to Become a Lawyer in Virginia: Steps and Requirements

To become a lawyer in Virginia, you need an approved legal education, a passing score on the Virginia bar exam, a passing score on the Multistate Professional Responsibility Examination, a clean character and fitness review, and formal admission through a swearing-in ceremony followed by registration with the Virginia State Bar. The Virginia Board of Bar Examiners, an agency of the Supreme Court of Virginia, runs the licensing process and sets the standards at each stage.1Virginia Board of Bar Examiners. Home: Virginia Board of Bar Examiners Virginia writes its own essay exam rather than using the Uniform Bar Examination, so a passing score here does not transfer to other states.

Complete Your Legal Education

The standard route is a Juris Doctor from a law school approved by the American Bar Association. Rule 1A:1 of the Rules of the Supreme Court of Virginia treats graduation from an ABA-approved program as the baseline educational qualification.2Virginia Board of Bar Examiners. Minimum Threshold Requirements You will need a bachelor’s degree from an accredited four-year college first, because ABA-approved law schools require one. Your law school must send official transcripts directly to the Board.

If your law school was not ABA-approved when you graduated, you generally cannot sit for the Virginia bar exam through the standard path. Two narrow alternatives exist.

The Law Reader Program

Virginia is one of a few states that lets you qualify for the bar exam without going to law school. Under the Law Reader Program, authorized by Code of Virginia ยง 54.1-3926, you study law under the supervision of a practicing Virginia attorney for three years.3Virginia Code Commission. Code of Virginia 54.1-3926 – Preliminary Proof of Education Required of Applicant The statute requires a minimum of 18 hours of study per week for at least 40 weeks per year across all three years. Your supervising attorney must be an active Virginia State Bar member in good standing throughout the entire supervision period and must meet additional Board qualifications.4Virginia Code Commission. Chapter 20 – Law Reader Program Rule

You apply to the Board with a proposed course of study and a signed agreement from your supervising attorney. The program covers core subjects including torts, contracts, domestic relations, and Virginia civil procedure. After three years, you sit for the same bar exam as law school graduates.

Foreign Law Degrees

If you earned your law degree outside the United States, the pathway is narrower than it looks. You must earn an LL.M. from an ABA-approved law school and be admitted to the highest court in at least one U.S. state or territory before Virginia will let you take its exam.5National Conference of Bar Examiners. Foreign Legal Education – Virginia In practice, that means passing a bar exam somewhere else first, then applying to take Virginia’s on top of it.

Pass the Virginia Bar Examination

Virginia gives its bar exam twice a year, in February and July. Applications are due by December 15 for the February exam and May 10 for the July exam. If you miss the deadline, your application may still be accepted if you sent it by priority, express, registered, or certified mail (or next-day commercial carrier) on or before the deadline date.6Virginia Code Commission. Code of Virginia 54.1-3925 – Application for Examination Late submissions outside those channels are not accepted.

The application fee for first-time takers is $575.7Virginia Board of Bar Examiners. Fees To type your essay answers, add $175 for regular laptop registration or $225 if you register late.8Virginia Board of Bar Examiners. Laptop Registration

Day two is the Multistate Bar Examination, a 200-question multiple-choice test on foundational legal subjects.9Virginia Board of Bar Examiners. Exam Dates, Locations, Deadlines Virginia weights the essay at 60 percent and the MBE at 40 percent. You need a combined scaled score of at least 140 to pass.10Virginia Board of Bar Examiners. Retakes

If you fail, you may retake the exam up to four more times, for a total of five attempts. Each retake requires a new application, updated character and fitness information, and payment of the fees again. You must also certify that you studied at least 90 hours in the four months before the exam.12Virginia Board of Bar Examiners. Rules of the Virginia Board of Bar Examiners

Pass the MPRE

Separately from the bar exam, you must pass the Multistate Professional Responsibility Examination, which tests legal ethics. Virginia requires a scaled score of at least 85.13Virginia Board of Bar Examiners. MPRE Score Report You can take the MPRE at any time before the bar exam or before your passing bar exam score expires. Passing bar exam scores stay valid for five years, and you will not be licensed until the MPRE requirement is satisfied.

Clear the Character and Fitness Review

Every applicant must clear a background investigation. You complete a detailed Character and Fitness Questionnaire and pay an investigation fee set by the Board.14Legal Information Institute. 18 Va. Admin. Code 35-10-30 – Character Requirements The questionnaire asks for a full history of your residences, employment, and education since age 18, with contact information for supervisors and references. You must disclose any criminal history, including traffic offenses, and any financial problems such as neglected debts or bankruptcy. Omissions and misrepresentations are themselves grounds for denial, independent of whatever you failed to disclose.

If the Character and Fitness Committee denies your application, you can appeal to the full Board of Bar Examiners by filing a Notice of Appeal within 30 days.15Virginia Board of Bar Examiners. Character and Fitness Procedures You are responsible for ordering and paying for a hearing transcript, and the Board gives substantial weight to the Committee’s findings when they are supported by the evidence. A final appeal lies with the Supreme Court of Virginia.

Get Sworn In and Registered

Passing the exams and clearing character review does not, by itself, make you a licensed Virginia attorney. You still have to be sworn in. The Supreme Court of Virginia and the Virginia State Bar Young Lawyers Section hold an Admission and Orientation Ceremony each June and December.16Virginia State Bar. Requirements for New Lawyers Until you take the oath of qualification at that ceremony, or are qualified by an individual circuit court, you cannot appear in any court in the Commonwealth.

After being sworn in, you register with the Virginia State Bar and pay dues. Active membership dues are $250 per year, plus a $5 Clients’ Protection Fund assessment and a $30 Attorney Wellness Fund assessment, for an annual total of $285.17Virginia State Bar. Annual Dues and Fees The annual dues deadline is July 31. Admission through the Supreme Court qualifies you for all Commonwealth courts but does not cover federal courts sitting in Virginia, which run their own admission processes.16Virginia State Bar.
