To become a West Virginia resident, you make the state your permanent home and then complete a short list of official steps: get a West Virginia driver’s license within 30 days, title and register your vehicles within 30 days, register to vote, and start filing West Virginia income tax returns. Below is how each step works, what it costs, and the rules that apply if you’re in the military, enrolling in college, or holding a professional license.
What Residency Actually Means
West Virginia treats “residency” and “domicile” as the same thing: your true, permanent home, the place you intend to return to whenever you’re away.1Cornell Law School. You can only have one domicile at a time. A domicile already established somewhere else stays in place until you take concrete steps to build a new one here.1Cornell Law School. The more of them you complete, the stronger your position when any agency asks where you really live.
Get a West Virginia Driver’s License Within 30 Days
If you plan to drive, you must apply for a West Virginia license within 30 days of moving.2WV Division of Motor Vehicles. Driver’s Licenses and ID Cards You have to go to a DMV office in person; there’s no online path. Bring your out-of-state license, which you’ll surrender, and expect a vision screening and a brief alcohol awareness course.3WV Division of Motor Vehicles. New Residents If your out-of-state license is valid and unexpired, you won’t have to take a written or road test.
A standard Class E license costs $5 per year of validity. A Class D license, which covers heavier vehicles, costs $6.25 per year.4West Virginia Legislature. West Virginia Code 17B-2-8 – Issuance and Contents of Licenses; Fees
Standard License or REAL ID
Since May 7, 2025, a REAL ID-compliant license, marked with a gold star, is required to board domestic flights and enter secure federal facilities like military bases.5TSA. West Virginia Residents Will Need a REAL ID to Board an Airplane A standard West Virginia license without the star no longer works for those purposes. Request the REAL ID version if you fly or enter federal buildings.
Both versions require two proofs of West Virginia residency showing your name and physical address. The REAL ID version also requires a proof-of-identity document: an original or certified birth certificate, a valid unexpired U.S. passport, or qualifying Department of Homeland Security documents if you were born outside the United States.6West Virginia Driver’s Licenses and ID Cards. If your name has ever changed from what appears on your identity document, bring the supporting paperwork for every change.
Title and Register Your Vehicle Within 30 Days
Vehicles also have to be titled and registered with the West Virginia DMV within 30 days of establishing residency.3WV Division of Motor Vehicles. New Residents Bring your out-of-state title, a completed West Virginia title application, an odometer disclosure statement, and proof of West Virginia auto insurance.
The 6% titling sales tax has been eliminated for new residents who bring a vehicle already titled in their name from another state.3WV Division of Motor Vehicles. New Residents You’ll still owe:
- Registration: $51.50
- Title: $15
- Lien recording: $10, only if a lender holds a lien on the vehicle
Plan for the Annual Vehicle Property Tax
This is the expense that catches most newcomers off guard. West Virginia imposes an annual personal property tax on motor vehicles, and it applies to every car, truck, motorcycle, and boat you own. The vehicle is appraised using the NADA guide’s loan value, then assessed at 60% of that appraised value. Your county multiplies the assessed value by local levy rates, which vary from county to county.
Vehicle property taxes can be paid in two installments. The first is due September 1 and becomes delinquent October 1. The second is due March 1 and becomes delinquent April 1. Paying on or before the due date earns a 2.5% discount. Miss the deadline and 9% annual interest runs from the delinquency date until you pay.7West Virginia Legislature. If you’re moving from a state that doesn’t tax vehicles annually, budget for this before you’re surprised by the bill.
Register to Vote
You can register to vote online, by mail, or in person at your County Clerk’s office. Online registration asks for your West Virginia driver’s license or state ID number and the last four digits of your Social Security number. The deadline to register is 21 days before any election.
One side effect worth knowing: West Virginia draws jurors from both voter registration lists and DMV records. Completing either step puts you in the jury pool.
When You Owe West Virginia Income Tax
Once you’re a West Virginia resident, the state’s income tax applies to you, and the definition of resident is broader than most people expect. If you’re domiciled in West Virginia and spend more than 30 days in the state during the tax year, you must file a resident return that reports all your income, including income earned elsewhere.8West Virginia Legislature. You can also trigger resident status without domicile. Anyone who maintains a permanent home in West Virginia and spends more than 183 days in the state during the tax year is taxed as a resident regardless of where they claim domicile.8West Virginia Legislature. Effective January 1, 2025, West Virginia’s income tax rates run from 2.22% on the first $10,000 of taxable income up to 4.82% on income above $60,000.9West Virginia State Tax Division. About the Income Tax Rate Cut If you’re coming from a state with no income tax, factor this in.
Documents That Prove You Live Here
Various agencies will ask for proof of residency, and the DMV alone requires two documents. Acceptable proofs include:10WV DMV. Acceptable Proof Documents
- Current utility bills showing a West Virginia address
- West Virginia income tax returns or property tax receipts
- A lease agreement or mortgage documents for a West Virginia property
- A W-2 form no more than 18 months old with a West Virginia address
- A valid West Virginia motor vehicle registration card
- A West Virginia voter registration card
- Proof of West Virginia public assistance or a Homestead tax exemption
If nothing is in your name yet, which is common in the first weeks, a notarized affidavit from the homeowner or leaseholder you’re staying with, combined with two of their proofs of residency, may be accepted instead.
Military Members and Spouses
If West Virginia was your home of record when you entered military service, being stationed elsewhere doesn’t change your West Virginia residency for tax purposes. You remain a West Virginia resident and continue filing West Virginia returns on your military pay.
The Military Spouses Residency Relief Act lets a civilian spouse claim the same state of legal residence as the service member.11Military OneSource. The Military Spouses Residency Relief Act If a service member’s legal residence is West Virginia and the couple is stationed elsewhere, the spouse can remain a West Virginia resident for voting and income tax rather than being pulled into the state where they physically live. It works the other way too: a spouse stationed in West Virginia can keep residency in a different home state.
In-State Tuition Is a Separate Standard
Establishing residency for daily life is not the same as qualifying for in-state tuition at West Virginia’s public colleges. For tuition, you need at least 12 continuous months of presence in the state before you register for classes, and that presence cannot be primarily for the purpose of attending college.12WV Secretary of State. Title 135 Series 25 – Residency Classification for Admission and Fee Purposes Moving in and enrolling immediately at the resident rate isn’t allowed.
Establishing domicile in less than 12 months is possible but takes strong evidence of “positive and unequivocal action,” such as buying a home, working full-time, and switching driver’s license, voter registration, and tax filings all at once. The burden is on you to show the move wasn’t about tuition.
Nonresident military service members and their dependents assigned to a duty station in West Virginia qualify for in-state tuition regardless of how long they’ve lived here.
Professional Licenses
If you hold a professional license, whether in nursing, accounting, law, teaching, or a trade, moving to West Virginia almost certainly means applying for a new state license or a reciprocal certificate before you can practice. Each profession has its own licensing board, application process, fees, and timelines, and some boards require a criminal background check. Start the process well before your move date. Waiting until you arrive can leave you unable to work legally for weeks or months.
