To change your last name in Idaho, you have three options: take a spouse’s name through marriage, restore a former name during divorce, or file a petition in the district court where you live. The court route costs $166 to file, requires publishing a notice in a local newspaper for four weeks, and ends with a judge’s signed order. Marriage and divorce skip the petition entirely.
Marriage or Divorce: The Shortcut Routes
If you’re getting married, your certified marriage license from the County Recorder is all you need. No petition, no hearing, no judge. Take that certified copy to each agency, bank, and employer to update your records. The change isn’t automatic anywhere; you still have to show up with the document.
If you’re divorcing and want to go back to a former name, ask for it in your divorce filings. When the judge approves, the restoration gets written into your final Decree of Divorce, and that decree is your legal proof of the name change. Miss that window and you’re back to filing a full court petition later.
Filing a Court Petition
Every name change outside of marriage or divorce goes through the district court in the county where you live.1Idaho State Legislature. Idaho Code Section 7-802 – Petition for Change The Idaho Supreme Court’s Court Assistance Office posts the forms for free.2Idaho Court Assistance Office. Name Change
Your petition has to state your current legal name and the one you want, your place of birth, your current residence, and your reason for the change. You’ll sign a sworn statement that the change isn’t for a fraudulent purpose like evading creditors, and you have to disclose any criminal history.
Registered sex offenders face a flat bar: no name change will be granted if it would help someone avoid their registration obligations under Idaho Code Title 18, Chapter 83, or equivalent laws in another state.3Idaho State Legislature. Idaho Code 7-805 – Restrictions on Name Changes for Convicted Sexual Offenders If a change is granted for other reasons, the court must notify the Idaho State Police registry.
You’ll file two versions of the petition with the district court clerk: a redacted copy for the public record and an unredacted copy for the judge. The filing fee is $166.4Idaho Supreme Court. Filing Fee Schedule – District Court and Magistrate Division
Publication and the Hearing
Once your petition is filed, the court sets a hearing date and tells you which local newspaper to use. You then publish a Notice of Hearing in that paper once a week for four consecutive weeks.2Idaho Court Assistance Office. Name Change This is the window in which anyone who objects can file an objection with the court. Publication costs vary by paper and county and typically run a few hundred dollars on top of the filing fee, so plan for that expense.
After the four weeks, the newspaper gives you an Affidavit of Publication. File it with the court before your hearing. At the hearing, the judge reviews the petition, confirms publication, and considers any objections. If the judge finds the change reasonable, they sign a Judgment for Name Change. Ask the clerk for several certified copies on the spot. You’ll need them.
Changing a Child’s Last Name
A minor’s name change uses the same court petition, with extra protections. A parent or legal guardian files it. The petition must include the name and address of the other parent (if only one parent is filing) or the names and addresses of the parents or grandparents (if a guardian is filing).1Idaho State Legislature. Idaho Code Section 7-802 – Petition for Change
The key added step is notice. If only one parent signs and the other is alive but hasn’t consented, the filing parent has to serve the other parent with notice of the hearing at least 30 days ahead. The same 30-day notice rule applies when a guardian files and must notify the parents or grandparents.
Judges decide these cases under a “best interests of the child” standard, weighing the child’s own preference (with age and maturity in mind), how long they’ve used the current name, and whether the current name causes them difficulty or embarrassment. The $166 fee and four-week publication still apply.
Updating Your Records After the Change
A court order or marriage certificate changes your name legally, but every agency and institution has to be updated one at a time. Order matters, because some agencies verify against others.
Social Security First
Start with the Social Security Administration. Most other agencies pull from SSA records, so doing this first prevents problems everywhere else. Complete an Application for a Social Security Card and bring it to an SSA office with your name change document (marriage certificate, divorce decree, or court order) and a photo ID like a driver’s license or passport. Documents must be originals or copies certified by the issuing agency.5Social Security Administration. Idaho Driver’s License or ID
After SSA processes the change, visit your county sheriff’s DMV office. The DMV verifies your information with SSA electronically, which is why that step has to come first.7Bonneville County Sheriff. U.S. Passport
Which form you use depends on your passport’s age and when your name changed. Form DS-5504 covers passports issued less than a year ago when the name change also happened within that year. Form DS-82 covers mail-in renewal if your passport is undamaged, was issued in the last 15 years, and was issued when you were 16 or older. Everyone else applies in person on Form DS-11.9U.S. Department of State. Professional Licenses and the Rest
If you hold a professional license in Idaho, most boards require written notification within 30 days. Contact your board through the Division of Occupational and Professional Licenses for the right form. After that, work through your employer, banks, credit cards, insurance providers, and your county voter registration office. Keep a few extra certified copies of your name change document on hand; the process goes faster when you don’t have to request more partway through.
