How to Change Your Last Name in Nebraska: Petition, Notice, and Decree

To change your last name in Nebraska, you file a petition with the district court in the county where you live, publish notice of the change in a local newspaper for four consecutive weeks, and appear at a short hearing where a judge signs the decree. Most cases move from filing to signed decree in about six to eight weeks. You must have lived in the county for at least one year before you file.

Who Can File

Nebraska Revised Statute § 25-21,271 requires at least one full year of residency in the county where you file.1Nebraska Legislature. Nebraska Revised Statutes 25-21,271 – Change of Name; Persons; Procedure; Clerk of the District Court; Duty If you recently moved counties, the clock starts over in your new county, and filing too soon will get your petition dismissed.

Your petition has to include five things: confirmation of the one-year county residency, your current address, your date of birth, the reason for the change, and the new name you want.1Nebraska Legislature. Nebraska Revised Statutes 25-21,271 – Change of Name; Persons; Procedure; Clerk of the District Court; Duty The reason doesn’t have to be elaborate. Personal preference, cultural reasons, or family reasons are all acceptable. What the court is checking for is that you aren’t changing your name to defraud creditors or escape a criminal matter.

The Forms You’ll Need

The Nebraska Judicial Branch publishes a name-change packet on its self-help site. Two forms start the case: the Petition for Name Change (Form DC 6:9.1) and the Confidential Party Information form (Form DC 6:9.4).2Nebraska Judicial Branch. Adult Name Change The confidential form keeps sensitive personal details out of the public record.

Enter your current legal name exactly as it appears on your birth certificate or Social Security card. If those two documents already show different names because of an earlier change, note the discrepancy on the form. Inaccurate or incomplete information can derail the petition and, if it looks intentional, expose you to penalties for a false statement under oath.

You should also fill out (but not sign) the Decree for Name Change (Form DC 6:9.3) in advance so it’s ready for the judge to sign at your hearing.3Nebraska Judicial Branch. Name Change – Adult The packet includes instructions for each form; read them before you write anything.

Filing the Petition

Bring the completed forms and the filing fee to the Clerk of the District Court in your county.2Nebraska Judicial Branch. Adult Name Change The clerk assigns a case number and enters your petition on the docket. Fees are set by statute and can vary, so confirm the current amount with your clerk’s office or the Judicial Branch fee schedule before you go.

If you can’t afford the fee, Nebraska law lets you ask the court to waive costs by filing an application to proceed in forma pauperis, with authority in Nebraska Revised Statutes §§ 25-2301 through 25-2310.4FindLaw. Nebraska Revised Statutes 25-21,273 – Change of Name; Effect; Costs; How Taxed; Exception You’ll need to show financial hardship, and the judge decides.

Publishing Notice

Once the petition is filed, you have to publish a notice of the intended name change in a newspaper of general circulation in your county. The notice runs once a week for four consecutive weeks. Not every local paper qualifies as one of general circulation for court purposes, so confirm with the clerk’s office or with the paper before you place the notice.

Publication costs depend on the paper and the length of the notice. After the four-week run, the newspaper gives you an Affidavit of Publication, a sworn statement that the notice ran on schedule. File it with the Clerk of the District Court. The court will not set your hearing until that affidavit is on file.

The Hearing and Your Decree

After the proof of publication is filed, the court schedules a hearing, and you must appear in person.3Nebraska Judicial Branch. Name Change – Adult Hearings are usually brief. The judge places you under oath and asks you to confirm your identity, your residency, and your reason for changing your name. The purpose is to verify the petition and rule out a fraudulent motive.

If the judge is satisfied, they sign the Decree for Name Change.3Nebraska Judicial Branch. Name Change – Adult Request several certified copies from the clerk right away. Each costs a small fee, and you’ll need multiple originals for the agencies and institutions you’ll update. Picking up enough on the first trip saves later visits.

Updating Your Records

The decree is your legal proof, but it doesn’t push the change through any database on its own. You have to notify each agency and institution. Start with Social Security and the Nebraska DMV, because so much else keys off those records.

Social Security

The Social Security Administration accepts a court order as proof of a legal name change.5Social Security Administration. U.S. Citizen – Adult Name Change on Social Security Card Submit an Application for a Social Security Card (Form SS-5) with your certified decree and proof of identity. There’s no fee for a new card. Do this first: many other agencies verify names against SSA records, and a mismatch causes delays everywhere else.

Nebraska Driver’s License or State ID

Nebraska requires you to update your driver’s license or state ID within 60 days of the name change. Visit a driver’s licensing office in person with your previous license and a certified copy of the decree so staff can tie your old name to the new one.6Nebraska DMV. How Do I Change My Name on My Driver’s License? Don’t miss the 60-day window. Driving on ID that doesn’t match your legal name creates problems at traffic stops and any time you need to verify who you are.

IRS

Tell the IRS so the name on your tax return matches your Social Security record. Use Form 8822, which has a line for reporting a prior name.7IRS. Form 8822, Change of Address A mismatch between your return and SSA records can delay refunds and trigger processing errors.

Passport

How you update a passport depends on how recently it was issued. If it was issued less than a year before your name change, mail Form DS-5504 with no application fee. If it’s been more than a year, renew by mail with Form DS-82 or apply in person with Form DS-11; a standard adult passport book costs $130, plus a $35 acceptance fee if you apply in person.8U.S. Department of State. Passport Fees In every case, include the certified court decree as evidence of the change.9U.S. Department of State. Change or Correct a Passport

Banks and Credit Bureaus

Financial institutions want a certified copy of the decree to update accounts, debit cards, and loan records. Contact each bank and lender directly. For credit reporting, reach out to Equifax, Experian, and TransUnion separately, because updating one doesn’t update the others. Make clear it’s a legal name change, not a dispute over an error. Each bureau can take up to 30 days to process it.

Estate Planning Documents

If you have a will, power of attorney, or health care directive, those documents still reference your old name. They don’t become invalid, but ambiguity about who they name can create trouble for your family later. The cleanest fix is a new will that revokes the old one. A codicil can update a name in an existing will, but it must be signed and witnessed with the same formalities as the original. Update beneficiary designations on life insurance, retirement accounts, and payable-on-death accounts too.

Debts and Legal Obligations Don’t Disappear

A name change does not erase what you owe. Nebraska law is explicit that a name change “shall not in any manner affect or alter any right of action, legal process, or property.”4FindLaw. Nebraska Revised Statutes 25-21,273 – Change of Name; Effect; Costs; How Taxed; Exception Creditors can pursue collections under your new name, and existing judgments remain enforceable. A judge who suspects a petition is aimed at evading creditors may deny it.

Special Situations

Changing a Minor’s Name

The general name-change authority applies to minors, but the court uses a different standard when a child is involved. Instead of accepting a stated reason like personal preference, the judge asks whether the change serves the child’s best interests. Courts weigh each parent’s level of involvement, how long the child has used the current name, whether the surname matches the custodial parent’s, and the child’s own preference if they’re old enough to express one.10Nebraska Legislature. Nebraska Revised Statutes 25-21,270 Expect more questions from the court and, in most cases, notice to the other parent.

Registered Sex Offenders

Nebraska does not bar a registered sex offender from petitioning for a name change, but failing to report the change to the registry violates registration requirements.11Nebraska Sex Offender Registry. Frequently Asked Questions Under the federal Sex Offender Registration and Notification Act, a registered offender must appear in person to update their registration within three business days of a name change.12eCFR.
