How to Change Your Name in Maryland: Petition, Hearing, and Records

To change your name in Maryland, you file a Petition for Change of Name of an Adult in the Circuit Court for the county where you live, work, do business, or were born, pay a $165 filing fee, and wait at least 30 days before a judge can sign the order. Maryland no longer requires newspaper publication, so the process is cheaper and quicker than it once was. The signed court order is what every agency and bank will ask to see when you update your records.

When a Court Petition Isn’t Needed

If your name is changing because of marriage or divorce, you likely don’t need to file a separate petition. A certified marriage certificate is itself legal proof of a name change and is accepted by the Social Security Administration, the Maryland MVA, and other agencies.

Divorce works similarly. You can ask the court to restore your former name in your divorce complaint, amend the papers up to 30 days before your hearing to add the request, or file a separate request to restore your former name for up to 18 months after the final divorce decree. That later request does not require posting or publication.1Maryland Courts. How to File for a Name Change in Maryland For every other reason, the full petition process applies.

Who Can File

Any adult can petition. Maryland law imposes only two real limits: the change cannot be for an illegal or fraudulent purpose, and it cannot interfere with the rights of others.2New York Codes, Rules and Regulations. Rule 15-901 – Action for Change of Name Trying to dodge debts, criminal prosecution, or a judgment would count as fraudulent. Petitions for personal, cultural, religious, or gender-identity reasons are routinely approved.

A name change doesn’t erase existing obligations. Debts, contracts, and judgments follow you because those records are tied to your Social Security number and credit history, not your name.

If you’ve ever been required to register as a sex offender, the petition requires you to disclose that and list every name and state involved, and if your change is granted you must notify local law enforcement within three days.3Maryland Department of Public Safety and Correctional Services. What Goes in the Petition

Maryland uses a standardized form, the Petition for Change of Name of an Adult, governed by Rule 15-901.4Maryland Courts. Petition for Change of Name of an Adult You sign it under oath. The form asks for:

  • Your current legal name, home address, date of birth, and place of birth.
  • The new name you want and the reasons for the change.
  • Every other name you have used and the circumstances (maiden name, prior marriage, informal use).
  • A sworn statement that the change is not for any illegal or fraudulent purpose.
  • Whether you have ever been required to register as a sex offender.

Attach a document proving your current legal name. A birth certificate is the most common choice, but a state-issued driver’s license, passport, or other government ID works too.2New York Codes, Rules and Regulations. Rule 15-901 – Action for Change of Name

Where to File and What It Costs

File in the Circuit Court of the county where you live, work, regularly conduct business, or were born.2New York Codes, Rules and Regulations. Rule 15-901 – Action for Change of Name Most people file where they live.

The filing fee is $165.5Maryland Courts. Name Change If you cannot afford it, file Form CC-DC-089, Request for Waiver of Costs, alongside your petition. The form collects your household income, debts, and assets under oath so the court can decide whether you qualify.6Maryland Courts. Request for Waiver of Costs

Budget for certified copies of the final order too. You’ll need several to update different agencies, and the circuit court charges a per-page fee plus a certification fee for each copy. Asking for three to five certified copies when the order is granted saves return trips to the clerk’s office.

The 30-Day Wait and the Hearing Question

Once the clerk accepts your petition, the court cannot sign your order for at least 30 days.2New York Codes, Rules and Regulations. Rule 15-901 – Action for Change of Name That window exists so anyone who believes the change would harm them can object. Because Maryland eliminated the publication requirement, you no longer need to arrange or pay for a legal ad.

If no one objects and nothing in the paperwork raises concerns, the judge can sign the order without a hearing. That is the typical outcome for a straightforward adult petition. A hearing becomes necessary only if someone files an objection or the judge wants more information. The court cannot deny your petition without giving you a hearing first.2New York Codes, Rules and Regulations. Rule 15-901 – Action for Change of Name

Updating Your Records After the Order

The signed court order is your proof, but nothing updates automatically. You carry certified copies to each institution yourself, and the order you do this in matters.

Social Security Administration First

Start with the SSA. Other agencies verify your identity against Social Security records, so updating here first prevents mismatches that slow everything else down.7USAGov. How to Change Your Name and What Government Agencies to Notify Bring your certified court order to a local Social Security office and complete an application for a replacement card. If more than two years have passed since the name change, the SSA may also ask for an identity document in your prior name.8Social Security Administration. Maryland MVA

Once your SSA record is updated, visit the MVA with your certified court order and current license or ID. The MVA requires a government-issued document explaining any name discrepancy between its records and the name you’re requesting.9Maryland Motor Vehicle Administration. How to Apply – Documents Required An updated license then serves as photo ID in your new name for everything that follows.

U.S. Passport

If you hold a passport, the process depends on timing. When your passport was issued less than one year ago and your name change also happened within that year, you can mail Form DS-5504 with your court order and current passport at no charge, unless you pay $60 for expedited processing. If more than a year has passed since either event, you’ll need to renew using Form DS-82 by mail or Form DS-11 in person, both of which carry standard passport fees.10U.S. Department of State. Naturalization Certificate

Naturalized citizens who want an updated Certificate of Naturalization file Form N-565 with USCIS, with the certified court order as evidence of the change.11U.S. Citizenship and Immigration Services. Instructions for Application for Replacement Naturalization/Citizenship Document (Form N-565)

Credit Bureaus

Updating your Social Security record does not fix your credit reports. Contact Equifax, Experian, and TransUnion individually; correcting your name at one bureau has no effect on the others. Each has an online dispute process where you submit your court order or updated ID. Register using your former name so the bureau can find your file, then file the update as a legal name change rather than a name dispute. Allow up to 30 days at each bureau.

Everything Else

You’ll also want to update your bank and other financial accounts, your employer and payroll department, your health insurance, the IRS (which pulls from SSA records but may need direct notification if you’re filing taxes soon), voter registration, and your Maryland birth certificate if you were born in the state.1Maryland Courts. If You’re Changing Your Name to Escape Abuse

If the reason for your name change is domestic violence, stalking, sexual assault, human trafficking, or harassment, contact the Secretary of State’s office about Maryland’s Address Confidentiality Program before you file.
