To claim unemployment benefits in Mississippi, file an initial claim with the Mississippi Department of Employment Security (MDES) through its online portal at accessmstax.mdes.ms.gov or by calling 1-866-633-7041, then file a weekly certification every week and document at least three job contacts. Weekly payments run from $30 to $235 for up to 26 weeks, and the first eligible week is an unpaid waiting week.
Check That You Qualify Before You File
Two tests decide whether MDES will pay you: how much you earned recently, and why you left your job.
On earnings, MDES looks at a “base period” covering the first four of the last five completed calendar quarters before you file. You need at least $780 in your highest-paid quarter, and total base period wages of at least 40 times your weekly benefit amount.1Justia Law. Mississippi Code Title 71 Chapter 5 Article 11 Section 71-5-511
On the reason for separation, you must be out of work through no fault of your own: a layoff, reduction in force, or business closure. If you quit, you have to show good cause. If you were fired, your employer has to prove misconduct. A disqualification locks you out until you earn at least eight times your weekly benefit amount at a new job.2Justia Law. Mississippi Code Title 71 Chapter 5 Article 11 Section 71-5-513 – Disqualifications You also have to be physically able to work, available for full-time work, and actively looking. Anything that would stop you from accepting a suitable job, like no transportation or no childcare, can make you ineligible.3Mississippi Department of Employment Security. Benefit Eligibility Requirements
What to Have in Front of You
Pull these together before you start the application:
- Your Social Security number.
- Name, mailing address, and phone number for every employer you worked for in the last 18 months.
- Exact start and end dates for each job.
- The specific reason you left each employer (layoff, discharge, quit, and so on).
- Your Alien Registration or Visa number, if you are not a U.S. citizen.
- Your gross earnings for the current week, if you worked at all during the week you file.
Accuracy matters here. Misstating any of this, especially why you left a job, is treated as fraud.4Mississippi Department of Employment Security. Filing UI Claims Online
Filing Your Initial Claim
File online at accessmstax.mdes.ms.gov or by phone at 1-866-633-7041. The online portal walks you through fields that mirror the list above. When you submit, the system issues a confirmation number. Save it.
MDES then sends a Monetary Determination notice showing the wages found in your base period, your calculated weekly benefit amount, and your maximum total benefits. The notice is not a guarantee of payment; it describes what you would get if you meet the other requirements.5Mississippi Department of Employment Security. Frequently Asked Questions If there are questions about why you left your job, MDES may schedule a fact-finding interview before deciding.
The Unpaid Waiting Week
Your first otherwise-eligible week is an unpaid waiting week. It is not reimbursed later. You still have to file a weekly certification for that week to start the clock on your claim.6Mississippi Department of Employment Security. Benefit Rights Summary Statement
Weekly Certification and the Three Job Contacts
Every week, log in to the MDES portal and file a Weekly Certification covering Sunday through Saturday. It asks whether you were able and available to work, whether you turned down any job offers, and what you earned. If you earned more than $40, MDES deducts the amount over $40 from your weekly benefit, dollar for dollar.5Mississippi Department of Employment Security. Frequently Asked Questions
You must also make at least three job contacts each week and keep a record of each: the date, the company, the method (phone, in person, online), and the position. Some claimants are exempt, including workers on temporary layoff with a definite return date and people in approved training programs.5Mississippi Department of Employment Security. Frequently Asked Questions
If you are not scheduled to return to work within 30 days, you also have to register with the WIN Job Center in your area. Skipping this can delay or stop payments. If you live outside Mississippi, register with your home state’s workforce agency within nine days of filing.6Mississippi Department of Employment Security. Benefit Rights Summary Statement
How Much You’ll Get and How It Arrives
MDES calculates your weekly benefit by dividing your highest-quarter wages by 26 and rounding down. The result is capped at a minimum of $30 and a maximum of $235, and benefits run up to 26 weeks per benefit year.7Mississippi Department of Employment Security. Once your claim is approved, you choose how to be paid in the online portal: direct deposit to a checking or savings account, or an Electronic Payment Card mailed to the address on your account. Payments are issued after each weekly certification is processed and approved.
Taxes on Your Benefits
Unemployment benefits are federally taxable. MDES reports what it paid you on Form 1099-G and sends a copy to the IRS.8Internal Revenue Service. About Form 1099-G, Certain Government Payments To avoid a bill at tax time, you can submit IRS Form W-4V to MDES asking for voluntary withholding. The only rate available is a flat 10%.9Internal Revenue Service. Form W-4V Voluntary Withholding Request Without withholding, you may need to make quarterly estimated payments to avoid an underpayment penalty.
If MDES Denies Your Claim
You have 14 calendar days from the mailing date on the determination notice to appeal.10Mississippi Department of Employment Security. Appeals Process Miss that window and the denial typically stands. You can appeal by:
- Phone at 1-866-633-7041.
- In person at your local WIN Job Center.
- Mail or fax: a signed letter to the MDES Appeals Department, P.O. Box 1699, Jackson, MS 39215-1699, or fax 877-994-6329.
Put your Social Security number on anything you send. MDES will schedule a hearing before an Administrative Law Judge and mail you written notice of the date, time, and location. The judge usually issues a written decision within 14 days and can reverse, modify, or uphold the original determination.10Mississippi Department of Employment Security. Appeals Process Keep filing your weekly certifications during the appeal. If you stop and later win, you can lose benefits for the weeks you skipped.
Fraud Penalties
Giving MDES false information or hiding facts to collect benefits is a crime. Fines run from $100 to $500, with up to 30 days in jail, and each false statement is a separate offense.11Justia Law. Mississippi Code Title 71 Chapter 5 Article 1 Section 71-5-19 MDES also adds a 20% penalty on any overpayment caused by fraud, requires full repayment, and can reduce future benefit payments to recover what you owe.
