How to Claim Unemployment in Missouri: Eligibility, Pay, and Appeals

To claim unemployment in Missouri, file an initial claim through the state’s UInteract portal at uinteract.labor.mo.gov, then submit a Weekly Request for Payment every week you want benefits. If you lost your job through no fault of your own and earned enough during a recent work history, the Division of Employment Security pays up to $320 a week for a maximum of 20 weeks.

Who Qualifies

Missouri runs two separate checks on every claim: one on your past wages, one on why your job ended.

The Wage Test

The state looks at a “base period” covering the first four of the last five completed calendar quarters before you file.1Missouri Revisor of Statutes. Revised Statutes of Missouri, RSMo Section 288.030 You have to clear all three of these marks:

  • At least $1,500 in wages from an insured employer in one quarter of the base period.
  • At least $2,250 in total base period wages, with at least $750 earned outside your highest quarter.
  • Total base period wages equal to at least one and a half times your highest single-quarter earnings.

That last rule is where high earners sometimes fail. If your best quarter was $5,000, your full base period has to reach $7,500 or more.2Missouri Department of Labor and Industrial Relations. Eligibility for Unemployment Benefits

The Separation Test

You have to be out of work through no fault of your own. A layoff, reduction in force, or position elimination qualifies. Quitting without a work-related reason that would compel a reasonable person to leave disqualifies you until you earn wages at a new job equal to ten times your weekly benefit amount, and being fired for misconduct connected to the job triggers the same disqualification.3Missouri Revisor of Statutes. Revised Statutes of Missouri, RSMo Section 288.050 Narrow exceptions apply for quitting to accept a better-paying job you actually started, leaving temporary work to return to your regular employer, or relocating for a spouse’s mandatory military reassignment.

You also have to be physically able to work, available for full-time work, and either living in Missouri or have a recent Missouri work history.

How Much You’ll Get and for How Long

Your weekly benefit amount is four percent of the average of your two highest-earning base-period quarters. Two quarters of $6,000 and $5,000 average to $5,500, and four percent of that is $220 a week. The ceiling is $320, no matter how high your prior earnings were.

The most you can collect in a benefit year is 20 weeks.4Missouri Department of Labor and Industrial Relations. How Are My Benefits Figured At the top rate, that works out to $6,400 over the life of the claim.

Missouri also imposes one unpaid waiting week per benefit year. The first week you are unemployed and file a claim counts as a qualifying period rather than a payable week. If your claim runs long enough that your remaining balance drops to or below the amount of that first week, the waiting week becomes payable retroactively.5Missouri Revisor of Statutes. Revised Statutes of Missouri, RSMo Section 288.040

Severance or termination pay does not reduce your weekly benefit. Vacation pay, holiday pay, and payments required under the federal WARN Act do, and pensions may reduce benefits depending on the circumstances.6Missouri Department of Labor and Industrial Relations. Will Other Income Reduce My Benefits Part-time earnings while you collect are offset against your weekly amount after a small disregard of $20 or 20 percent of your weekly benefit, whichever is greater, and you must report gross wages each week even if the employer has not yet paid you.7Missouri Revisor of Statutes. What to Have Ready Before You File

Pull these together first. The online session can time out, and reopening it with the wrong employer address or a missing date usually means starting the section over.8Missouri Department of Labor and Industrial Relations. How to File for Unemployment

  • Your Social Security number.
  • The full legal name, mailing address, and your start and end dates for every employer you worked for in the last 18 months. The payroll address on your W-2 is usually the right match for the state’s records.
  • The reason each job ended. You will choose from a list of codes during filing, such as “Lack of Work” for a layoff.
  • Any gross wages, holiday pay, or vacation pay earned in the current week.
  • Your DD-214 if you are separating from military service.
  • Standard Form 8 if you were a federal employee, so your federal wages are credited to the claim.

Filing the Initial Claim

Go to uinteract.labor.mo.gov and click “New User Registration.” Choose the option to file an unemployment claim, enter your Social Security number, name, and date of birth, then set a username, password, and security questions.

Once registered, log in and select “Unemployment Claim,” then “File Unemployment Claim.” Work through the screens for employer history, personal details, and separation reasons. At the end, the system shows a summary. Review every entry before you submit. False information, even if unintentional, can trigger a fraud investigation and penalties.9Missouri Revisor of Statutes. Revised Statutes of Missouri, RSMo Section 288.380

After you confirm, a printable claim confirmation appears. Save or print it. Your claim’s effective date is the Sunday of the week you submit. If you cannot file online, the Regional Claims Center accepts claims by phone.8Missouri Department of Labor and Industrial Relations. How to File for Unemployment

Weekly Certifications and Work Search

The initial claim does not pay anything by itself. To receive benefits, you have to submit a Weekly Request for Payment for every week you want paid. The certification window opens each Sunday and covers the seven days ending the previous Saturday at midnight.

Each week, you confirm you were able and available to work, report any gross wages, and document your work search. Missouri requires a minimum of three work search contacts per week unless a claims deputy tells you otherwise.5Missouri Revisor of Statutes. Revised Statutes of Missouri, RSMo Section 288.040 Keep a log with the date, employer name, and position for each contact. The state audits these records. Falling short of the three contacts or skipping a weekly certification can close the claim and force you to go through a formal reinstatement.

One more rule to know while you are certifying: once you are on benefits, refusing a suitable job offer disqualifies you until you earn wages at new work equal to ten times your weekly benefit amount. In the first few weeks of a claim, you cannot be penalized for turning down work that pays significantly less than your prior job, requires skills you do not have, or has substantially less favorable conditions.3Missouri Revisor of Statutes. How You Get Paid

You can choose a Money Network Visa debit card, which is mailed to the address on file in UInteract, or direct deposit to a personal checking or savings account linked inside UInteract.10Missouri Department of Labor and Industrial Relations. Once a weekly certification is approved, the payment usually posts within two to three business days.

Taxes on Your Benefits

Missouri unemployment counts as taxable income on both federal and state returns.11Missouri Department of Labor and Industrial Relations. Are My Benefits Taxable Early in the following year, you will receive IRS Form 1099-G showing total benefits paid, which you report on your federal return.12Internal Revenue Service. Topic No. 418, Unemployment Compensation

You can have 10 percent withheld from each payment for federal tax by filing IRS Form W-4V with the Division of Employment Security, not the IRS. No other withholding rate is available for unemployment benefits.13Internal Revenue Service. Form W-4V, Voluntary Withholding Request If you skip withholding, set aside money for the tax bill or make quarterly estimated payments.

If Your Claim Is Denied

You have 30 days from the date of the determination to appeal to the Appeals Tribunal. A referee hears the case from scratch, so you need to present all your evidence again even if you already gave it to the claims deputy.14Missouri Department of Labor and Industrial Relations. Unemployment Appeals Tribunal Most hearings are by phone, with in-person hearings available on request. Bring pay stubs, your termination letter, relevant emails, and the names of any witnesses who can speak to your separation.

If the referee rules against you, you have another 30 days to appeal to the Labor and Industrial Relations Commission, which reviews the hearing record rather than taking new testimony. From there, a further appeal goes to the appropriate Missouri Court of Appeals, again within 30 days. Miss any 30-day deadline and you lose the right to appeal at that level.

Overpayments and Fraud Penalties

Any benefits you received but were not entitled to have to be repaid, even if the mistake was honest. Missouri does not offer a waiver program for overpayments.

Intentional fraud carries a 25 percent penalty on top of the repaid amount, and a second fraud overpayment pushes the penalty to 100 percent.9Missouri Revisor of Statutes. Revised Statutes of Missouri, RSMo Section 288.380 You are ineligible for any benefits, including waiting-week credit, while a fraud penalty is outstanding on your account.5Missouri Revisor of Statutes. Revised Statutes of Missouri, RSMo Section 288.040 Report every dollar of earnings on your weekly certification, including small or one-time payments, and respond quickly to anything the Division of Employment Security sends you.
