How to Complete and File a Wisconsin Lien Release Form

Which Office Handles Your Release

Sending a satisfaction to the wrong office does not clear the title, so start by identifying which lien you have.

A mechanic’s lien (also called a construction lien) sits on the judgment and lien docket kept by the clerk of circuit court. A mortgage or other security interest was recorded with the county Register of Deeds. The release must be recorded with that same Register of Deeds office, in the county where the property sits.2Wisconsin State Legislature. Completing Form GF-129 for a Mechanic’s Lien

The Wisconsin Court System publishes form GF-129, “Satisfaction of Judgment or Partial Release/Satisfaction of Lien,” for circuit court filings.4Wisconsin Court System. Wisconsin Statutes GF-129 – Satisfaction of Judgment The form itself cannot be modified, though you may attach supplemental material.

You will need to fill in:

  • The name of the lien creditor — the contractor or supplier who filed the claim.
  • The name of the lien debtor, usually the property owner.
  • The date the original lien was docketed or filed.
  • The original lien amount and the amount of payment received.

Pull the original lien claim before you start. Wisconsin requires that claim to include the property’s legal description, a statement of the contract or demand, the name of the person against whom the claim is made, and the last date labor or materials were provided.6Wisconsin State Legislature. The form has a built-in notary block. Sign in front of a notary public who witnesses your signature and applies their seal.

Preparing a Mortgage or Security Interest Satisfaction

Wisconsin does not require a single universal form for a mortgage release recorded with the Register of Deeds. What the statute does require is a signed certificate that identifies the mortgage or security interest and states it has been paid or satisfied, in whole or in part, and is properly authenticated.2Wisconsin State Legislature. In practice, the satisfaction should contain:

  • The original recording information — the document number, or the volume and page number, assigned by the Register of Deeds when the mortgage was first recorded.
  • The name of the lender or lienholder releasing the claim and the name of the borrower or property owner.
  • The formal legal description from the original mortgage. Lot and block, or metes and bounds. A street address alone will not work; check your deed, the original mortgage, or your county’s online real estate records for the correct wording.
  • Plain language stating that the debt has been paid and the lien is released.

Templates from the Wisconsin State Bar or your county Register of Deeds office already meet these content and formatting rules and are the easiest starting point.

Getting the Signature Authenticated

The signature on the satisfaction has to be authenticated by someone the state recognizes. Any of the following can do it: a notary public, any public officer authorized to administer oaths, or any member in good standing of the Wisconsin State Bar.7Wisconsin State Legislature. The authenticator endorses the document with “Acknowledged,” “Authenticated,” or “Signatures Guaranteed,” and adds the date, their signature, and their official or professional title. Bring valid government-issued identification. Notaries are widely available at banks, shipping stores, and law offices.

Formatting Rules for Register of Deeds Recording

If the satisfaction is going to the Register of Deeds, it must meet Wisconsin’s standard recording format or the office can reject it.8Wisconsin State Legislature. Wisconsin Code 59.43(2m) – Standard Document Format

  • White paper, at least 20-pound weight, sized 8.5 by 11 inches or 8.5 by 14 inches, with up to a 0.25-inch deviation.
  • Black, blue, or red ink.
  • The instrument name clearly stated between 0.5 and 3 inches from the top of the first page.
  • A blank area of at least 0.5 by 2 inches in the upper left of the first page for the document number, within 3 inches of the top.
  • A blank area of at least 3 by 3 inches in the upper right for recording information.
  • A return address area of at least 1 by 3 inches, placed below the recording area or the document number area.
  • Top margin of 0.5 inch on each page; bottom and side margins of at least 0.25 inch.
  • Text legible enough for a copy machine, microfilm camera, or optical scanner.

Do not staple or bind multi-page documents along the full top or side edge.

Filing and Recording the Release

For a mechanic’s lien satisfaction, bring or mail the completed GF-129 to the clerk of circuit court in the county where the original lien was filed. The clerk enters the satisfaction on the judgment and lien docket alongside the original lien.1Wisconsin State Legislature. Wisconsin Code 779.13 – Satisfaction of Judgment or Lien; Correction of Errors Call the clerk’s office first to confirm accepted payment methods and any local procedures.

For a mortgage satisfaction, submit the document to the Register of Deeds in the county where the property is located. You have three options:

  • In person at the Register of Deeds office, usually processed the same day.
  • By mail, sending the original document with a check for the fee and a self-addressed stamped envelope for return of the recorded copy.
  • Electronically, through a third-party vendor the county works with. Availability varies by county.

The recording fee is $30, set by state statute and uniform across all Wisconsin counties.9Wisconsin State Legislature. Wisconsin Code 59.43(2) – Register of Deeds Fees Payment methods vary. Most offices accept checks; some accept credit cards. A wrong payment amount means the document comes back unrecorded, so confirm the accepted method before you send anything.10Jefferson County, Wisconsin. Once recorded, you receive a copy stamped with a unique document number and timestamp. Keep it permanently. It is your proof the lien no longer affects the title, and you will want it for any future sale or refinance.

If the Claimant Won’t Release After Payment

Wisconsin does not let a paid claimant sit on a satisfaction indefinitely. Under Section 779.13, once a mechanic’s lien claimant has received full payment (or a valid tender of the amount owed plus any litigation costs), the claimant must execute and deliver the satisfaction to any interested person who requests it and covers the cost of preparing it.1Wisconsin State Legislature. A claimant who refuses becomes liable to the person requesting the satisfaction for a penalty equal to half the amount originally claimed in the lien. On a $40,000 lien, that is a $20,000 exposure.

Collecting that penalty takes legal action, so escalate in order:

  • Send a written demand by certified mail so you have a clear record of the request and any refusal.
  • Cite Section 779.13 and the half-the-lien-amount penalty in the demand. Many claimants cooperate quickly once they see the exposure.
  • Petition the circuit court to order the lien discharged. Depending on the circumstances, you may also seek the statutory penalty and attorney’s fees.

If the claimant has gone out of business or cannot be located, a court order discharging the lien from the docket may be the only way to clear the title. An attorney who handles Wisconsin construction lien work can usually move that through in most counties.

Federal Tax Liens Are Different

If the lien on your property was placed by the IRS, you do not prepare or file the release yourself.
