DC Form FR-130 is the District of Columbia’s extension request for the Unincorporated Business Franchise Tax Return (Form D-30). Filing it by your D-30 due date gives you a six-month extension to submit the return, or seven months if you file on a combined basis. The extension covers filing only. You still have to pay the full estimated tax with the FR-130 itself, and the Office of Tax and Revenue (OTR) will deny the extension if payment isn’t included.1Office of Tax and Revenue. Who Files FR-130 and When
Any unincorporated business that owes DC franchise tax and can’t file its D-30 by the deadline should file FR-130. The D-30 is due April 15 for calendar-year filers, or the fifteenth day of the fourth month after a fiscal year closes.2Office of Tax and Revenue. 2024 D-30 Unincorporated Business Franchise Tax Return FR-130 has to be in by that same date to be effective.
One point worth flagging up front: DC does not accept the federal extension in its place. Form 7004 or Form 4868 won’t cover you here. You have to use the DC-specific FR-130.1Office of Tax and Revenue. FR-130 Extension of Time to File a DC Unincorporated Business Franchise Tax Return
Each return needs its own form. OTR’s instructions state that blanket requests covering multiple returns won’t be accepted.3Office of Tax and Revenue. Instructions for Form FR-130
Filling Out the Form
FR-130 is a single page: a few identification fields on top, a five-line payment worksheet on the bottom.1Office of Tax and Revenue. FR-130 Extension of Time to File a DC Unincorporated Business Franchise Tax Return
The identification section asks for your FEIN or Social Security Number (check the box for whichever you provide), the legal business name or designated agent’s name, the tax period ending date in MMDDYYYY format, and your current mailing address with ZIP+4. Three checkboxes sit alongside those fields:
- Combined Report, if you file on a combined basis. This box is what gets you the seven-month extension instead of six.
- Living or Traveling Outside the U.S., if you’re outside the continental United States.
- 52-53 week filer, if your fiscal year follows that cycle.
The Payment Worksheet
The bottom half of the form calculates what you owe with the extension. Underestimating here is where filers get hurt, because the extension doesn’t shield you from penalties on unpaid tax.
- Line 1: Your total estimated unincorporated business franchise tax liability for the tax period. The current rate is 8.25 percent of taxable income, and the minimum tax is $250 if your DC gross receipts are $1 million or less, or $1,000 if they exceed $1 million.4Office of Tax and Revenue. - Line 2: Estimated tax payments already made this year, including any prior-year overpayment credits carried forward.
- Line 3: Any other payments already remitted.
- Line 4: Lines 2 and 3 added together.
- Line 5: Line 1 minus Line 4. This is the balance due, and it must accompany the FR-130.
If Line 5 is zero or negative, file the FR-130 anyway to get the extension on record. Just submit it without a payment. If Line 5 is positive and you don’t include the full amount, OTR will deny the extension request outright.1Office of Tax and Revenue. How to Submit It
You have two options:
- By mail: Send the completed FR-130 with a check or money order to Office of Tax and Revenue, PO Box 96020, Washington, DC 20090-6020. Make the payment out to the DC Treasurer and write your TIN, “FR-130,” and the tax year on the check.3Office of Tax and Revenue. Instructions for Form FR-130
- Electronically via MyTax.DC.gov: If your payment exceeds $5,000, electronic filing is mandatory. Below that threshold it’s still faster and gives you immediate confirmation.1Office of Tax and Revenue. FR-130 Extension of Time to File a DC Unincorporated Business Franchise Tax Return
What Happens If You Underpay
The extension protects you from late-filing penalties. It does nothing about unpaid tax. If the amount you send with FR-130 falls short of what you actually owe, OTR will assess failure-to-pay penalties and interest on the shortfall running from the original due date, not from the extended date.1Office of Tax and Revenue. Under DC Code ยง 47-4213:
- Failure to file: 5 percent of the unpaid tax for each month or partial month the return is late, capped at 25 percent total.5D.C. Law Library. District of Columbia Code 47-4213 – Failure to File Return or to Pay Tax
- Failure to pay: 5 percent of the unpaid tax per month, also capped at 25 percent. When both penalties hit the same month, the failure-to-file portion is reduced by the failure-to-pay amount to avoid double-charging.5D.C. Law Library. District of Columbia Code 47-4213 – Failure to File Return or to Pay Tax
- Interest on estimated tax underpayment: 10 percent, compounded daily, on any shortfall.6Office of Tax and Revenue. Underpayment of Estimated Tax Interest
The safer play is to overestimate on the worksheet. Overpayments get refunded or credited forward when you file the D-30. Underpayments start accruing interest the day after the original deadline.
After You File
Attach a copy of your FR-130 to the D-30 when you eventually file it. That lets OTR match the return to the extension record.1Office of Tax and Revenue. FR-130 Extension of Time to File a DC Unincorporated Business Franchise Tax Return
For calendar-year filers, the extended deadline is October 15. Combined filers who get the seven-month extension have until November 15. No further extensions are available unless you’re physically outside the continental United States during the extension period, in which case you can request up to another six months. The total extension can never exceed one year from the original due date.3Office of Tax and Revenue. Instructions for Form FR-130
When you file the D-30, pay any remaining balance with the return to stop penalties from continuing to accrue. If the return shows you overpaid, you can claim a refund or apply the credit to next year’s estimated tax.
