Who Has to Register

Ohio Revised Code Section 5747.06 requires every employer maintaining an office or transacting business in Ohio and paying compensation to an employee to deduct and withhold Ohio income tax from that pay.2Ohio Legislative Service Commission. Ohio Revised Code 5747.06 – Employers Duty to Withhold Tax The rule reaches private businesses, nonprofits, and government entities. If you hire your first Ohio employee, or an out-of-state business starts having employees perform work in Ohio, the 15-day clock to register begins with that first payroll.1Ohio Department of Taxation. The withholding obligation applies to common-law employees, meaning workers whose work you control. Independent contractors handle their own tax, so you do not register on their behalf. Ohio also has reciprocal income tax agreements with Indiana, Kentucky, Michigan, Pennsylvania, and West Virginia; residents of those states working in Ohio can claim exemption from Ohio withholding by filing the appropriate form with you.

The Fastest Way: Register Online

OH|TAX eServices is the Department of Taxation’s online portal, and it is the quickest route to an active account. You need three things: your Federal Employer Identification Number, the legal name of the business, and an email address. The account is live as soon as you finish, so you can file returns and make payments the same day.1Ohio Department of Taxation. Employer Withholding

The withholding account number assigned at registration covers both state income tax withholding and school district income tax withholding, so you do not need a separate registration for school district taxes.1Ohio Department of Taxation. Employer Withholding

  • The date of your first Ohio payroll, meaning the first date you paid or will pay wages subject to Ohio withholding.
  • Your six-digit NAICS code and a plain-language description of your business activity.
  • The legal business name, any trade name or DBA, the primary business address, and a separate mailing address if that differs.

Ohio Employer Withholding Tax General Guidelines Your initial filing frequency, which can be quarterly, monthly, or partial-weekly, is driven by the estimated annual withholding range you chose on Form IT 1. The Department then recalculates that frequency each calendar year based on the combined state and school district taxes you actually withheld during the 12-month look-back period ending June 30 of the preceding year.1Ohio Department of Taxation. A boundary worth knowing at registration: school district income tax is based on where the employee lives, not where they work, and if an employee resides in one of Ohio’s taxing school districts you have to withhold that tax too.7Ohio Department of Taxation. Why the Responsible Person Field Matters

The individual you list as the responsible person on Form IT 1 is not just an administrative contact. Under Ohio Revised Code Section 5747.99, an employer who fails to remit withheld state income tax faces a fine of $100 to $1,000, up to 60 days in jail, or both, and a second offense is a fifth-degree felony.8Ohio Legislative Service Commission. Ohio Revised Code 5747.99 – Penalties The responsible person named on the form can be held personally liable for unremitted tax. Pick that name with care, and update it if the role changes.
