A Missouri small estate affidavit lets you collect and transfer a deceased person’s property without opening a full probate case, provided the net estate is $40,000 or less and at least 30 days have passed since the death. You file the sworn affidavit with the probate division of the circuit court in the county where the decedent lived, pay a $35 filing fee, and typically post a surety bond. The process is set out in Missouri Revised Statutes § 473.097.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee
Who Qualifies to File
Two conditions have to be met. The total value of the estate, after subtracting liens and debts such as mortgages or car loans, cannot exceed $40,000. And at least 30 days must have passed since the date of death without anyone applying for or receiving letters testamentary or letters of administration.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee
If there is a will, the person named as personal representative files the affidavit. If there is no will, any distributee entitled to inherit under Missouri’s laws of descent and distribution can file.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee
What Counts Toward the $40,000 Cap
Only property that would normally pass through probate counts. Add up the decedent’s assets, then subtract liens. Property held as joint tenants or tenants by the entirety at the time of death is excluded entirely.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee Other assets that bypass probate and do not count toward the cap:
- Life insurance and retirement accounts with named beneficiaries, including 401(k)s, IRAs, and pensions
- Payable-on-death bank accounts and transfer-on-death investment accounts
- Property held in a living trust
A car worth $12,000 with a $5,000 loan against it counts as $7,000. Run that math for every asset carrying a lien. If the net total crosses $40,000, the small estate route is closed and you need standard probate.
Getting the Right Form
Missouri does not publish a single statewide form. Each county’s probate division uses its own version. Contact the probate clerk in the county where the decedent lived, or check the court’s website. Some counties, including Jackson County (16th Circuit) and St. Louis City (22nd Circuit), post downloadable forms online.216th Circuit Court of Jackson County, Missouri. Affidavit to Establish Title of Distributee Others require you to pick up the form in person. Most counties have separate forms for estates with a will (testate) and without a will (intestate), so ask the clerk which one you need before you start filling anything out.
What the Affidavit Must Contain
The statute requires six categories of information. Missing any of them will get your filing bounced back.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee
- A statement about the will: either that there is none, or that the will was presented for probate within the time limits of § 473.050.
- A statement that all unpaid debts, claims, and estate taxes have been or will be paid. Your personal liability for unpaid claims is capped at the value of what you receive.
- An itemized description and valuation of every probate asset. For bank accounts, include the last four digits of the account number, the account type, and the balance. For vehicles, include the VIN. For real estate, include the full legal description from the deed.322nd Judicial Circuit Court of Missouri. Affidavit for Collection of a Small Estate
- The names and addresses of everyone currently holding the decedent’s property: banks, brokerages, whoever has the car keys.
- The names, addresses, and relationship to the decedent of every distributee who will receive property after debts are paid.
- The facts establishing why each distributee is entitled to their share, whether by will or by Missouri intestacy rules.
If you cannot locate an heir, some counties require a separate affidavit of due and diligent search describing what you did to find them.322nd Judicial Circuit Court of Missouri. Affidavit for Collection of a Small Estate Most counties want the property list and the distributee list on separate exhibit pages, usually labeled Exhibit A and Exhibit B, rather than crammed into the body of the affidavit.
The Surety Bond
Before the court processes the affidavit, you usually have to post a surety bond. The amount must be at least equal to the value of the personal property in the estate, rounded up to the next thousand dollars in some counties.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee The bond guarantees that you will pay the decedent’s debts and distribute property correctly. You buy it from a surety company and pay a premium that is a small percentage of the bond’s face value.
The court can waive the bond if it decides one is not necessary.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee Some county forms include a line where all distributees can waive the bond by written consent.216th Circuit Court of Jackson County, Missouri. Affidavit to Establish Title of Distributee Whether a judge will accept that waiver without more depends on the county. Ask the probate clerk before assuming you can skip the bond.
Filing with the Court
Sign the completed affidavit under oath before a notary. Bring a current government-issued photo ID. Then submit the package to the probate division of the circuit court in the county where the decedent lived at death.
Your filing package should include:
- The notarized affidavit with the property and distributee exhibits attached
- The original will, if there is one
- The surety bond, unless the court has agreed to waive it
- A certified copy of the death certificate, if your county requires one (ask ahead)
- The $35 statutory filing fee4FindLaw. Missouri Revised Statutes Title XXXII Courts 488.012
If the estate includes property worth more than $15,000, the clerk arranges publication of a notice to creditors in a local newspaper, and you pay the publication cost on top of the filing fee.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee Publication costs vary by newspaper. Estates valued at $15,000 or less skip publication.
The published notice tells creditors that § 473.444 gives them one year from the date of death to file a claim, and that a creditor may request the estate be opened for full administration if they think the small estate process is inadequate.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee
Using the Certificate to Transfer Assets
Once the clerk reviews and accepts the affidavit, the clerk issues a certificate attached to or endorsed on it. The certificate lists the people entitled to the property and notes whether a will was probated.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee The affidavit plus the certificate is your proof of authority to collect and distribute the property.
Bank and Investment Accounts
Present a certified copy of the affidavit and certificate to each financial institution. Under § 473.100, any bank or brokerage that releases property based on the affidavit is released from liability as if it had paid an executor or administrator.5Missouri Revisor of Statutes. Missouri Code 473.100 – Effect of Acquittances by Distributees of Small Estate If an institution refuses to honor the affidavit, you can bring a court action to compel release.
Vehicles
Take the certified affidavit and certificate, along with the existing title, to a Missouri Department of Revenue license office. You will also need a completed Application for Missouri Title and License (Form 108).6Missouri Department of Revenue. Motor Vehicle Titling and Registration Call ahead to confirm what else that office wants for a transfer based on a small estate affidavit, since requirements vary.
Real Estate
File a copy of the affidavit and the clerk’s certificate with the recorder of deeds in each county where the property sits.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee That is why the affidavit needs the full legal description of every parcel. Recording establishes the distributees’ rights in the public land records. The recorder’s office charges a separate recording fee.
Paying Debts Before You Distribute
Collecting assets is only half the job. As the affiant, you are legally required to use the decedent’s property to pay outstanding debts before distributing anything to heirs. If the assets fall short, shares to distributees are reduced in the order of abatement set by § 473.620.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee You may need to sell property to raise cash for debts.
Your personal exposure is capped at the value of the property you received, but that is still real money. If you hand out assets to heirs before paying legitimate creditors, a creditor can pursue you personally for the shortfall up to that amount.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee The bond backs that obligation up. Pay debts first, then distribute, and keep records of every transaction.
Creditors have up to one year from the date of death to file claims.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee If you distribute everything immediately and a creditor appears six months later with a valid claim, you may have to recover funds from distributees or cover the claim yourself. Holding back a reasonable reserve for potential claims, especially in the first few months, is the safer approach.
What Can Derail the Small Estate Route
A creditor who sees the published notice can ask that the estate be opened for full probate administration instead.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee A heir who objects could also file for full administration during the 30-day waiting period. If either happens, the simplified path closes and you move to standard probate, which is slower and more expensive.
Once the small estate process is completed properly, the property can no longer be seized by creditors for debts against the decedent, and the distributees’ rights are the same as if a full administration had run its course.1Missouri Revisor of Statutes. Missouri Code 473.097 – Small Estate, Distribution of Assets Without Letters, When, Affidavit, Procedure, Fee Secured creditors keep their rights to the specific property securing their loans regardless of the affidavit.
