The Oregon Uniform Support Declaration, Form 8.010.5, is a sworn financial disclosure that each party files in any domestic relations case where child support or spousal support is at issue. It captures your income, payroll deductions, childcare costs, health insurance premiums, monthly expenses, and debts so the court can calculate a support obligation. When the Declaration Is Required
Under Uniform Trial Court Rule 8.010, every party must file a USD whenever child support or spousal support is requested in a case brought under ORS chapters 107 (dissolution, annulment, separation), 108 (separate maintenance), or 109 (child support and parentage).2Oregon Judicial Department. Modifications work the same way. If you file a motion to change an existing support order, you attach a current USD to the motion. If you’re on the receiving end and the court issues an order to show cause, you file your own USD within 30 days of being served with that order.2Oregon Judicial Department. Two exceptions matter. No USD is needed when the motion asks only to terminate child support because a child has aged out or is otherwise no longer legally entitled to support. And if both parties have stipulated to all judgment terms, neither side files a USD. “All terms” means all of them: support amounts, parenting time, property division. An informal handshake on a number does not qualify, and if any term is still contested, the USD is required.2Oregon Judicial Department. Filing and Service Deadlines
In an initial case, UTCR 8.010 requires the USD to be filed and served within 30 days after service of a petition or other pleading that seeks support on anything other than a temporary basis. In a modification case, the party seeking the change files the USD together with the motion, and the responding party has 30 days from service of the order to show cause to file and serve their own. Completing the Income Section
The form asks for gross monthly income, meaning what you earn before taxes and deductions. Fill in every line, even if the amount is zero. Items marked with an asterisk transfer to the summary on page one, and that summary is what the judge and the Oregon Child Support Calculator use.3Oregon Judicial Department. Employment income goes first: wages, salary, tips, commissions, bonuses. Convert every pay period into a monthly figure. If you’re paid biweekly, multiply one check by 26 and divide by 12, rather than doubling a single check, so the two extra paychecks per year are accounted for. Report an average over time, not just your most recent stub.
The next part covers non-employment income: Social Security, disability payments, workers’ compensation, unemployment, dividends, interest, annuity income, trust distributions, and TANF. The form also has a line for expense reimbursements or per diem allowances that reduce your personal living costs.4Oregon Judicial Department. Uniform Support Declaration If your employer covers a car payment or pays a housing allowance, that generally belongs here because it frees up money you’d otherwise spend on those costs.
Payroll deductions come after income: federal and state taxes, Social Security, Medicare, and any mandatory retirement contributions. Only list what’s actually withheld. Voluntary 401(k) contributions and union dues go on separate lines and are handled differently in the support calculation.
Self-Employed Filers
If you’re self-employed, Schedule C from your tax return is the primary document the court uses to verify business income. Supplement it with a year-to-date profit-and-loss statement if your last return is stale, along with several months of business bank statements showing actual deposits. Invoices and client contracts help show that your current income lines up with the return, or explain why it has changed.
If Records Are Missing
Where you don’t provide enough income documentation, the court can impute income, meaning the judge assigns you an earning capacity rather than using your self-reported numbers. Under OAR 137-050-0715, when there isn’t sufficient information to determine a parent’s actual or potential income, the default is full-time work at the lowest minimum wage in the state where the parent lives.5Oregon Secretary of State. The rate adjusts each July based on the Consumer Price Index.
Childcare and Health Insurance
These two figures carry heavy weight in Oregon’s child support formula, so precision here matters more than almost anywhere else on the form.
For childcare, report the monthly cost you actually pay for joint children age 12 or younger so you can work or look for work. Use out-of-pocket costs, not projected ones. The form asks for the city or ZIP code where care is provided and whether anyone else shares the cost. For health insurance, the form walks you through a specific formula to isolate the cost attributable to the joint children. Start with your total monthly premium (A), subtract the cost to cover only yourself (B), divide by the total number of other people on the plan (C), and multiply by the number of joint children enrolled (D). The result, (A − B) ÷ C × D, is what transfers to page one.3Oregon Judicial Department. Monthly Expenses and Debts
The declaration includes lines for recurring monthly expenses: housing, utilities, transportation, food, clothing. These figures matter most in spousal support cases. Debts get their own table. For each obligation, list the creditor’s name, the total balance owed, and the minimum monthly payment. Student loans, car loans, credit cards, medical debt, and personal loans all belong here, and so do back taxes or past-due support on another case.4Oregon Judicial Department. What to Attach

- Your four most recent pay stubs or benefit statements showing current earnings and deductions.
- Your most recently filed state and federal tax returns with all applicable schedules, including Schedule C for self-employment income and Schedule E for rental income.
- Proof of insurance premiums showing the breakdown of coverage and cost.
- Proof of childcare costs, such as receipts, invoices, or a statement from the provider.
- Proof of medical costs if you’re claiming extraordinary medical expenses for a child.
- Copies of existing spousal and child support orders from this case or any other.
- Your most recent parenting plan or written custody agreement.
The USD checklist asks for your “most recently filed” tax returns, not multiple years’ worth. Note that ORS 107.089 imposes a separate, broader document-exchange requirement in dissolution and separation cases: each party must give the other federal and state returns for the last three calendar years, along with W-2s, financial statements, records of debts, and retirement plan statements.6Oregon Public Law. Redacting Personal Information
Before you file or serve any attachment, black out Social Security numbers, financial account numbers, and dates of birth on every document.4Oregon Judicial Department. Uniform Support Declaration The form itself reminds you in bold. Court filings can become part of the public record, and leaving those identifiers exposed creates identity theft risk. Use a thick black marker on paper copies or a redaction tool in your PDF software before uploading electronically. If the court needs full account numbers, you can provide them through the Confidential Information Form process, which keeps them out of the public file.
Filing and Serving the Declaration
File your completed USD and attachments with the circuit court clerk in the county where the case is pending. Oregon circuit courts accept electronic filing through the OJD eFile system on the Oregon Judicial Department’s website, and this is the most common route when you or your attorney are already using the system for other case documents.7Oregon Judicial Department. You must serve a copy of the USD and all attachments on the other party or their attorney, usually by mail or through the electronic filing system. Keep proof of service, whether a certificate of service or the electronic service confirmation, in case the other side later claims your financial information never arrived.
What Happens If You Don’t File, or File Inaccurately
Skipping the USD or missing the deadline can stall the case. The court may exclude your financial evidence from the hearing, which leaves the judge relying on the other party’s numbers or on imputed income based on your work history or minimum wage. Either result gives you no voice in how support is set.
Accuracy carries its own stakes. You sign the declaration under penalty of perjury, certifying that every figure is true to the best of your knowledge and belief.4Oregon Judicial Department. Uniform Support Declaration If the other side’s attorney spots a discrepancy between your declared income and your tax returns or bank records, the court can sanction you, adjust the support amount, and in extreme cases refer the matter for perjury prosecution.
