Is Form 1358 the Right Application for You

California requires anyone who generates, transports, treats, stores, or disposes of hazardous waste to hold a hazardous waste identification number before shipping or receiving that waste.2Department of Toxic Substances Control. Hazardous Waste Generator Requirements Whether that number comes from the state or from EPA depends on how much federally regulated waste you produce.

Form 1358 is for handlers who generate less than 220 pounds (100 kilograms) of RCRA hazardous waste per month and less than 2.2 pounds (1 kilogram) of RCRA acutely hazardous waste per month, or who generate any amount of non-RCRA hazardous waste.1Department of Toxic Substances Control. Permanent State ID Number Application (DTSC Form 1358) Instructions California regulates many waste streams the federal RCRA program does not, so a business can handle no federally listed waste at all and still need a state ID.

Two situations call for a different process. If your facility produces 220 pounds or more of RCRA hazardous waste per month, you need a federal EPA ID number through EPA’s myRCRAid tool, not Form 1358.3Department of Toxic Substances Control. Hazardous Waste Identification (ID) Numbers If you only handle hazardous waste on a one-time or infrequent basis, you need a temporary state ID (valid 90 days) through a separate online application rather than this form.4Department of Toxic Substances Control. Completing the Form

Download the current PDF from the DTSC website at dtsc.ca.gov/wp-content/uploads/sites/31/2018/06/GISS_FORM_1358.pdf and read the instructions page first. DTSC rejects incomplete or inaccurate applications outright, so there is no partial credit for getting most of it right.1Department of Toxic Substances Control. Permanent State ID Number Application (DTSC Form 1358) Instructions The form has 13 lines.

New Number or Change to an Existing One

Line 1 is for new permanent state ID numbers. Check whether you are applying as a generator, a transporter, or both, then select the reason: never had a number, business moved, or the legal business owner changed.

If you already have a state ID and just need to modify it, skip Line 1. Lines 2 through 5 cover updating mailing or contact information, inactivating a number, reactivating a previously inactive one, and changing the business name without an ownership change. When modifying an existing number, enter the full ID number, lettered prefix included, in the space provided.1Department of Toxic Substances Control. Facility and Business Information

Lines 6 through 12 collect your facility’s identifying details.

  • Line 6 asks for the site or facility name including any DBA, plus the business type: sole proprietor, corporation, partnership, LLC, or other.
  • Line 7 is the site location. It must be a physical street address, not a P.O. box. If no physical address exists, DTSC will accept latitude and longitude coordinates or an assessor’s parcel number.
  • Line 8 is for tax and filing numbers. Enter your Federal Employer Identification Number. Sole proprietors without a FEIN should write “sole proprietorship” or “N/A.” Provide your California Secretary of State filing or entity number and your CDTFA account number if applicable.
  • Line 9 is the mailing address. A complete address is required; writing “same as above” will get the application rejected.
  • Line 10 is the site contact: name, address, phone, and business email of a person at the site.
  • Line 11 is the legal business owner’s name and principal address. For corporations, use the company’s legal name, and match the principal address on file with the California Secretary of State.
  • Line 12 is the four-digit Standard Industrial Classification code that best describes your primary business activity.

Line 13 is the certification. The signer certifies under penalty of law that the information is true, accurate, and complete. The form requires a handwritten signature. Typed and electronic signatures are not accepted.1Department of Toxic Substances Control. Permanent State ID Number Application (DTSC Form 1358) Instructions

Why Accuracy on the First Try Matters

Getting the form right the first time has real financial stakes. Under California Health and Safety Code Section 25189.2, making a false statement in a manifest, application, or other compliance document can result in a civil penalty of up to $70,000 per violation, with continuing violations assessed per day.7California Legislative Information. California Health and Safety Code HSC 25189.2 The same ceiling applies to violations of Chapter 6.5 of the Health and Safety Code, the state’s entire hazardous waste management framework. A rejected application that delays your ID number can also leave you generating or shipping waste without valid identification, which is itself a violation. Read the instructions, double-check every line against your corporate records before signing, and keep proof of what you submitted.
