How to Complete and Submit Tennessee Form LB-0441: Report to Determine Status

Tennessee Form LB-0441, the Report to Determine Status and Application for Employer Number, is the registration filing every new employing unit submits to the Tennessee Department of Labor and Workforce Development so the state can decide whether the business owes unemployment insurance taxes.1Tennessee Department of Labor and Workforce Development. Instructions for Report to Determine Status Applications for Employer Number The state now directs new employers to register online through its Employer e-Services portal, though the paper form can still be mailed. Once the department reviews your submission, it either assigns you an eight-digit Tennessee Employer Account Number or notifies you that your business is not currently liable for coverage.

Do You Actually Have to File

Tennessee law requires every employing unit in the state to file this report so the department can determine whether the business qualifies as an “employer” for unemployment insurance purposes.1Tennessee Department of Labor and Workforce Development. Instructions for Report to Determine Status Applications for Employer Number Filing is the state’s way of making the call. You file first; the department decides second.

For most commercial employers, liability attaches the moment either of these is true:

  • You paid $1,500 or more in total gross wages during any single calendar quarter in the current or preceding calendar year.
  • You employed at least one person for any part of a day in each of 20 different calendar weeks, consecutive or not, during the current or preceding calendar year.2Justia. Tennessee Code 50-7-205 – Employer Defined

Different thresholds apply to several categories. A 501(c)(3) nonprofit becomes liable with four or more paid employees in each of 20 weeks in the current or preceding calendar year. A domestic (household) employer becomes liable at $1,000 or more in cash wages in any calendar quarter of the current or preceding year. An agricultural employer becomes liable at $20,000 or more in cash wages to farm workers in a quarter, or ten or more farm workers in 20 or more weeks of the current or preceding year.3Tennessee Department of Labor and Workforce Development. If you are not sure where you land, file anyway. The determination is the department’s to make.

What to Gather Before You Start

Pull these together before you open the form or the online screens. Missing items are the most common reason registration stalls:

  • Your Federal Employer Identification Number. If the IRS has not yet issued one, leave it blank and the department will send a letter requesting it after the state account is set up.1Tennessee Department of Labor and Workforce Development. • Your legal business name and any trade name or DBA you operate under.4Tennessee Department of Labor and Workforce Development. Report to Determine Status Application for Employer Number
  • Your Tennessee Secretary of State control number, required for corporations and LLCs.
  • The date you first paid, or will pay, wages in Tennessee.
  • The physical address where primary operations take place, not just a mailing address.
  • A specific description of what the business does, including products made or sold and services provided.

Filling Out the Form

Online registration and the paper LB-0441 ask the same questions in the same order.

Entity and Contact Information

The top of the form collects your FEIN, legal business name, trade name, and mailing address. You then select your form of organization from Individual, Partnership, Corporation, Limited Liability Company, Limited Partnership, or Other.4Tennessee Department of Labor and Workforce Development. Report to Determine Status Application for Employer Number Corporations and LLCs also provide the state of formation and the Secretary of State control number.

Operational Dates and Liability Questions

This section decides the outcome. You enter the date you first paid, or will pay, a worker in Tennessee, then answer yes-or-no questions about whether your payroll has crossed the $1,500 quarterly wage threshold, whether you employed someone in 20 different calendar weeks, and similar criteria tied to your entity type. A “Yes” to question 7(d) or any question in items 8, 9, or 10 means the business is liable for unemployment insurance coverage.1Tennessee Department of Labor and Workforce Development. Business Activity Description

Item 13 asks you to describe the major business activity of the account and list products manufactured or sold and services provided. The department uses this answer to assign an industry code. “Consulting” invites follow-up questions. “Information technology consulting for healthcare companies” does not.

If You Bought or Took Over an Existing Business

A business that was recently purchased, merged, or otherwise acquired from a previous owner has to provide the predecessor employer’s name, address, and account number on LB-0441.4Tennessee Department of Labor and Workforce Development. Report to Determine Status Application for Employer Number This matters because Tennessee law may transfer the predecessor’s experience rating, the record of past claims and premiums that drives your tax rate, over to the successor.5Justia. Tennessee Code 50-7-403 – Experience Rating for Employers

Where any common ownership, management, or control links the predecessor and successor, the transfer is mandatory. Common ownership includes situations where someone with at least a 10% interest in the old business has a relative with at least a 10% interest in the new one.5Justia. Tennessee Code 50-7-403 – Experience Rating for Employers Both parties must sign and file Form LB-0483, the Application for Transfer of Experience Rating Record, during the calendar quarter in which the acquisition occurs or the quarter immediately after.6Tennessee Department of Labor and Workforce Development. Application for Transfer of Experience Rating Record If you are mailing, put LB-0483 in the same envelope as LB-0441.1Tennessee Department of Labor and Workforce Development. Without common ownership, and if the successor is not already an employer, the predecessor’s reserve ratio and premium rate carry over for the quarter in which the acquisition takes place and stay in effect until the department recalculates them.5Justia. How to Submit

Online Through Employer e-Services

The state now routes new employers to register online. The older TNPAWS portal has been retired, and its login credentials do not work on the replacement.7Tennessee Department of Labor and Workforce Development. Unemployment Insurance Taxes To register:

  • Open the Employer e-Services homepage and click “Register my business.”
  • Create login credentials with a username, password, and security questions.
  • Work through every registration screen, answering each required question about the business.
  • Submit when you reach the end; the system then registers your new account.8Tennessee Department of Labor and Workforce Development. Employer Registration

Have everything from the gather-first list open in front of you. The portal does not reliably hold a half-finished registration for later.

What the Department Sends Back

Department specialists review your filing and issue a formal determination. If your business meets the coverage threshold, you receive a Notice of Employer Liability that includes your eight-digit Tennessee Employer Account Number. That number is your permanent identifier for every future tax filing and wage report. If you are found not liable, the notice confirms your exempt status and your report stays on file in case your circumstances change.

A new liable employer with no predecessor experience rating is assigned a standard new-employer premium rate. For 2026, the unemployment insurance taxable wage base, which is the maximum amount of each employee’s annual wages subject to the tax, is $7,000.9Tennessee Department of Labor and Workforce Development. UI Tax Rates Premiums apply only to the first $7,000 each employee earns during the calendar year.

If You Disagree With the Determination

You have 15 calendar days from the date of the determination to appeal, whether the department found you liable when you believe you are not or the other way around. Log in to your Unemployment e-Services account on Jobs4TN.gov, select the determination, and click “File Appeal.” If the appeal decision also goes against you, the next step is the Office of Administrative Review.10Tennessee Department of Labor and Workforce Development. Appeal an Agency Decision

The 15-day window is strict. Miss it and the determination usually becomes final, so note the deadline the day the notice arrives.

What Comes After Registration

The account number is the start of a reporting cycle, not the finish. A liable employer files quarterly premium and wage reports and pays unemployment insurance taxes. Reports are due the last day of the month after each quarter: April 30 for Q1, July 31 for Q2, October 31 for Q3, and January 31 for Q4.

Businesses that operate only part of the year can apply for Seasonal Employer designation on Form LB-3304, but only if they have not been delinquent on quarterly reports in the four preceding quarters, and the application window runs annually from September 1 through October 31.3Tennessee Department of Labor and Workforce Development.
