Gather Your Documents First

You need the original signed will and any codicils. Not a photocopy, not a scan. Check whether the will includes a self-proving affidavit signed by the testator and witnesses before a notary. You need complete heir information: full legal name, current mailing address, and adult-or-minor status for every heir at law. Georgia identifies heirs through its intestacy statute, which puts the surviving spouse and children first, then more distant relatives when no closer kin exist.4Justia. If you can’t locate an heir or don’t know an address, say so on the form and explain what you do know. The court can work with gaps. It can’t work with silence about them.

The opening paragraphs identify the decedent and the petitioner, whom the form calls the “propounder.” Enter the decedent’s full legal name, county of domicile at death, and date of death. The Heir List
For each heir, state the full name, age or adult status, mailing address, and relationship to the decedent. Verification and Prayer for Letters
The petition ends with a verification: a sworn statement that everything you’ve written is true. Sign it under oath in front of a notary or a probate court clerk. Without a proper oath, the petition is not legally valid. The form also closes with a prayer for issuance of Letters Testamentary, the formal request that the court grant you authority to act as executor.

Circulating these pages before you file is the single easiest way to speed things up. Every heir who signs is one fewer person the court has to formally serve, which saves you money and weeks of waiting. If family relations are cooperative, get the signatures early. For any heir who won’t sign or can’t be reached, the court handles service after you file.
Where to File and What It Costs
Submit the completed petition, the original will, the death certificate, and all signed acknowledgments to the probate court in the county where the decedent was domiciled at death.7Justia. Some counties accept electronic filing, though you still need to deliver the original will and supporting documents by mail or in person within 10 days of the e-filing.

What Happens After You File
Solemn form works because every interested party gets a chance to object, so any heir who didn’t sign an acknowledgment must be formally notified. How that happens depends on the heir’s location:

Once everyone has been served or has acknowledged service, the judge reviews the petition, the will, and the proof of execution. A self-proving affidavit stands in for live testimony.2FindLaw. Any heir or interested party can file a caveat, a formal objection, before the court enters its order. A caveat pushes the case into contested territory, where the propounder first has to prove capacity and free action, and if that showing is made, the objector has to prove their grounds.6Justia. Georgia Code 53-5-21 – Procedure If no caveat is filed or the propounder prevails, the court enters a final order admitting the will to probate in solemn form, and the court issues Letters Testamentary along with that order.
After Letters Testamentary Issue
The Letters are your proof of authority. Banks, brokerages, title companies, and government agencies all want to see them before they’ll deal with you on behalf of the estate. Request several certified copies. Most institutions want their own original.
The estate needs its own Employer Identification Number from the IRS before you open an estate bank account. The online application issues the EIN immediately at no cost.14Internal Revenue Service. Within 60 days of qualifying as executor, publish a notice to creditors in the county’s official newspaper. It runs once a week for four weeks. Creditors who fail to respond within three months of the last published notice lose their right to equal treatment with same-priority creditors who were paid earlier.16Justia. One boundary worth flagging: solemn form probate and year’s support run on separate tracks. A surviving spouse or the guardian of a minor child can petition for year’s support, a share of estate property set aside for family maintenance that takes priority over most other claims. The petition must be filed within 24 months of the decedent’s death and must describe the specific property, real estate by legal description, that the family wants set apart.17Justia. Finally, tax obligations. If the estate earns any income after death, from interest, rent, or asset sales, you may need to file Form 1041. Federal estate tax applies only to estates above the basic exclusion amount, which for 2026 is $15,000,000 per person.18Internal Revenue Service.
