New York Form IT-370-PF gives partnerships, LLCs taxed as partnerships, and fiduciaries of estates or trusts an automatic extension of time to file their New York State income tax returns. Who Files IT-370-PF

The form covers two groups, each extending a different return.

Deadlines and How Long the Extension Lasts

The original due date and the length of the extension depend on which return you’re extending.

For a calendar-year partnership, Form IT-204 is due March 15. Because March 15, 2026 falls on a Sunday, the deadline shifts to March 16, 2026. For a calendar-year estate or trust, Form IT-205 is due April 15, 2026. Fiscal-year filers use the 15th day of the third month (partnerships) or the fourth month (estates and trusts) after the close of the fiscal year, and enter the beginning and ending dates of that year in the boxes on the form.2New York State Department of Taxation and Finance. Filling Out the Form

Identification

Enter the entity’s federal Employer Identification Number and its legal name and address. For estates and trusts, the EIN and name must match the federal Form SS-4 used to obtain the number, followed by the fiduciary’s or firm’s address.1New York State Department of Taxation and Finance. Calendar-year filers can leave the fiscal-year date boxes blank.

Tax Calculation and Payment

Fiduciaries filing IT-205 must estimate the tax due for the year and calculate a balance. Partnerships filing IT-204 generally do not owe entity-level income tax because income flows through to the partners. But if the partnership has New York source income and nonresident partners, it has a separate estimated tax obligation, addressed below.

Nonresident Partner Estimated Tax

Partnerships with New York source income must make estimated tax payments on behalf of partners who are nonresident individuals or C corporations. Individual-partner payments are reported on Form IT-2658; corporate-partner payments on Form CT-2658. When you file IT-370-PF for a partnership, include any amount owed under these nonresident partner rules in what you remit. Underpayment carries its own penalty under Tax Law Section 685, calculated on Form IT-2659, and it compounds quickly across many nonresident partners.

How to Submit the Form

Electronic Filing

The New York State Online Services portal is the primary way to file IT-370-PF, and you can pay directly from a bank account or by credit card when you file.4New York State Department of Taxation and Finance. Preparers who handled documents for more than 10 different taxpayers in the prior calendar year and use tax software fall under New York’s e-file mandate, which explicitly covers extensions.5New York State Department of Taxation and Finance. Paper Filing

A paper envelope must be postmarked by the original due date. The address depends on whether you’re sending a payment:

Make checks or money orders payable to “New York State Income Tax” and write the entity’s EIN on the payment so the state can match it to the account.

Interest on Unpaid Tax

An extension to file is not an extension to pay. If the estate or trust owes tax and you don’t pay it in full by the original due date, interest runs from that date until you pay, regardless of the extension.6New York State Senate. Penalties If You Don’t File the Extension

Penalties differ by return type, and they add up fast.

Partnerships

A partnership that files IT-204 late without an extension owes $50 multiplied by the total number of partners subject to New York personal income tax during any part of the tax year, for each month or partial month the return is late, capped at five months.8New York State Department of Taxation and Finance. The penalty can be waived on a showing of reasonable cause and no willful neglect.

Estates and Trusts

A fiduciary that files IT-205 late without an extension owes 5% of the tax due for each month or partial month the return is overdue, capped at 25%.1New York State Department of Taxation and Finance. Filing IT-370-PF on time and paying what you owe by the original deadline eliminates this penalty entirely.

After You File

New York does not send an approval notice for automatic extensions. The extension takes effect the moment the form is filed on time. Keep a copy of the completed form and, if you e-filed, the electronic confirmation receipt. That receipt is your proof of timely filing if the state later questions it.

Use the added months to finalize K-1 allocations for partners or beneficiaries, resolve valuation questions in the estate, and reconcile New York source income. The return you eventually file should reflect the entity’s final numbers, not the estimates on IT-370-PF. If you overpaid with the extension, the excess is applied as a credit or refund when the return is processed.
