How to Complete the DBPR RE 16 Florida Real Estate Miscellaneous Transactions Form

The DBPR RE 16 form is a Florida Real Estate Commission form that a sales associate or broker sales associate uses for one of two things: adding or removing a business entity designation (PA, LLC, PL, or PLLC) on their license, or registering to work as active under an owner/developer rather than a traditional employing broker. The entity designation transaction costs $30; the owner/developer registration has no fee listed. Either way, you print the form, complete the right sections, and mail it to DBPR in Tallahassee.1Department of Business and Professional Regulation. DBPR RE 16 Miscellaneous Transactions

If you came here to transfer brokerages, go inactive, change your name, or update an address, RE 16 is the wrong form. Those transactions use RE 10, RE 11, or RE 12 depending on the situation, and submitting RE 16 for them will not accomplish what you need.2Florida Department of Business & Professional Regulation. The Two Transactions RE 16 Handles

Section I of the form has you check one box to tell DBPR which transaction you are filing.1Department of Business and Professional Regulation. DBPR RE 16 Miscellaneous Transactions

  • Add or remove PA, LLC, PL, or PLLC. Updates your license to include or drop a professional entity designation. Florida law allows sales associates and broker sales associates to be licensed under a professional association, limited liability company, professional limited company, or professional limited liability company rather than purely as an individual. Fee: $30.
  • Become active with an owner/developer. Registers your intent to perform real estate activities under a specific owner or developer of property instead of a traditional employing broker. No fee is listed on the form for this transaction.

Which Form You Actually Need if Not RE 16

Many licensees searching for RE 16 are really looking for a different form on the DBPR Real Estate Commission website:

  • Change of employer (brokerage transfer): RE 112Florida Department of Business & Professional Regulation. Florida Real Estate Home
  • Go inactive or become active: RE 113Florida Department of Business & Professional Regulation. Become Inactive (RE 11) – Licensing Portal
  • Name change (sales associate or broker sales associate): RE 10
  • Personal address change: RE 10
  • Company address change or company name change: RE 12

Florida Statute 475.23 requires licensees to notify the commission of a change of employer or business address within 10 days, so if one of those is your real situation, use the correct form and move quickly.4Florida Senate. Florida Statutes 475.23 – License to Expire on Change of Address

Adding or Removing a PA, LLC, PL, or PLLC

Under Florida Statute 475.161, the Florida Real Estate Commission can license a sales associate or broker sales associate under a professional entity, but only after the licensee provides authorization from the Florida Department of State. In practice, that means registering your entity with the Division of Corporations (Sunbiz) before filing RE 16.5Florida Department of Business & Professional Regulation. Sales Associate or Broker Sales Associate – Add/Remove PA, LLC, PL, or PLLC (RE 16)

You can select only one designation per submission from these four:

  • PA (Professional Association)
  • LLC (Limited Liability Company)
  • PL (Professional Limited Liability Company)
  • PLLC (Professional Limited Liability Company)

If you are switching from one designation to another, check “add” and select the new designation. You do not need to file separately to remove the old one first.1Department of Business and Professional Regulation. DBPR RE 16 Miscellaneous Transactions

Filling Out Section II

Section II is where the entity designation change is recorded. Enter your full legal name exactly as it appears on your current real estate license, your license number (SL for sales associate, BL for broker sales associate), whether you are adding or removing a designation, and the single entity type you want.

The $30 fee is paid by check made out to “DBPR” and mailed with the form. The fee applies whether you are adding or removing.1Department of Business and Professional Regulation. DBPR RE 16 Miscellaneous Transactions
