Who Can File and On What Grounds

  • Sold — the vehicle had been sold and was in the new owner’s possession when the toll was missed.
  • Stolen — the vehicle had been stolen and was not in your possession at the time.
  • Divorced — an ex-spouse was responsible for the vehicle at the time.
  • Deceased — the registered owner is no longer living.
  • Defective Technology — limited to I-PASS, E-ZPass, or Pay-by-Plate customers in good standing whose transponder or account malfunctioned.
  • Incorrect Registered Owner — you are not actually the registered owner of the vehicle.
  • Repossession — the vehicle was in a repossession company’s custody when the toll was missed.
  • Lease — the vehicle was leased and had been returned before the toll occurred.

If none of those fits, the form directs you to call 1-800-824-7277, and there is a blank space on the form to describe an unusual situation in writing.

What Is Not a Ground

Being someone other than the driver is not, by itself, a reason to dispute the toll. If You Rented the Car

Rental customers usually do not file this affidavit themselves. When a commercial lessor gets billed, it can escape liability by sending the Tollway a copy of the lease agreement within 30 days of the violation notice’s issue date, and the rental contract typically redirects the charge to the renter.3Illinois General Assembly. Documents You Have to Attach

The affidavit by itself is not enough. Every category requires specific proof, and reviewers compare the dates on your documents against the Tollway’s photo-surveillance records. Anything dated after the toll was recorded does you no good. Match your paperwork to your checked reason:

  • Sold — a signed bill of sale or a copy of the transferred title showing the sale closed before the violation date.
  • Stolen — a copy of the police report documenting the theft before the toll was recorded.
  • Divorced — a copy of the divorce decree or court order assigning vehicle responsibility to the other party.
  • Deceased — a copy of the death certificate.
  • Defective Technology — your I-PASS or E-ZPass account number and evidence the account was active and funded when the transponder malfunctioned.

  • Repossession — documentation from the repossession company confirming custody on the violation date.

Filling Out the Form

The form is two pages. Page one is what you complete; page two lists the required documentation for each category. First, confirm your name appears on the invoice. Enter your first and last name, the invoice number, license plate state, license plate number, and phone number. Check exactly one dispute-reason box. If your situation does not fit any of the eight, use the blank space at the bottom to explain it. Sign and date on the affirmation line, which states that everything on the form and in the attached documents is true under penalty of perjury. No notary is needed; the perjury declaration replaces notarization.

Keep copies of the whole packet. If the Tollway later says nothing arrived, your copies are the only proof you filed on time. Certified mail or another trackable method gives you a receipt with a delivery date.

The Deadline That Actually Matters

Disputed unpaid tolls must be received before the due date of the second notice.1Illinois Tollway. Affidavit of Nonliability for Toll That date is printed on the notice itself. Miss it and the account escalates into the violation process, where fines stack on top of the toll and fees.

The stage of notice you are holding tells you how much time and money is at stake. Invoices carry the original toll plus an invoicing fee. Notices of Violation and Final Orders of Liability carry an orange logo at the top and require payment of tolls, fees, and fines together.5Illinois Tollway. What Happens After You File

The Tollway reviews your affidavit and documents against its records. If the evidence holds up, the charge is dismissed. If You Ignore the Notice Instead

You sign this form under penalty of perjury. Making a false material statement in a sworn or certified document is a Class 3 felony in Illinois.6Illinois General Assembly.
