How to Complete the New Mexico PIT-RC Rebate and Credit Schedule

The New Mexico PIT-RC is the Rebate and Credit Schedule you attach to your PIT-1 state income tax return to claim up to seven refundable credits and rebates. Because every credit on this schedule is refundable, filing the PIT-RC can produce a refund even if you owe no state income tax. What You Can Claim on the PIT-RC

Seven credits and rebates live on this schedule. Not every filer qualifies for all of them, and several are tied to age, income, or county of residence.

Low-Income Comprehensive Tax Rebate

Under NMSA § 7-2-14, residents with modified gross income of $36,000 or less can claim this rebate. The amount depends on your modified gross income and your total exemptions, with two extra exemptions added if you are 65 or older and one more if you are blind. Dollar amounts in the rebate table are adjusted each year for inflation, so use the table from the tax year you are filing. You must have been physically present in New Mexico for at least six months during the tax year, and you cannot have been an inmate of a public institution for more than six months.2Justia. Property Tax Rebate for Persons 65 or Older

NMSA § 7-2-18 lets residents 65 and older recover property tax paid above a state-set threshold. You cannot be claimed as a dependent on someone else’s return, and the six-month presence rule applies here too. The income cap is $16,000 in most counties. Counties that have adopted a resolution under Subsection J of the statute use a higher threshold, which the Taxation and Revenue Department currently lists at $24,000 or lower for participating counties.3Justia. Additional Low-Income Property Tax Rebate

Residents of Los Alamos, Santa Fe, Doña Ana, or Bernalillo County may qualify for an additional property tax rebate beyond the standard one. If your PIT-1 mailing address is outside these counties but you own qualifying property in one of them, attach a copy of that property’s tax statement.

New Mexico Child Day Care Credit

NMSA § 7-2-18.1 provides a credit for day care paid to a caregiver in New Mexico. Expenses count only for periods when you (and your spouse, if filing jointly) were gainfully employed. School attendance without a job does not qualify. State regulations give the example of a single parent who attended school January through May and started work in June: only day care from June forward is claimable.5Legal Information Institute. Refundable Medical Care Credit for Persons 65 or Older

If you are 65 or older and paid at least $28,000 in unreimbursed medical expenses during the tax year, NMSA § 7-2-18.13 gives you a flat $2,800 credit. Qualifying expenses include doctor and hospital bills, prescription drugs, insulin, long-term care services, insurance premiums (including Medicare Part B), prescribed therapeutic devices, and care in a nursing home when the primary reason is medical treatment. Special Needs Adopted Child Tax Credit

This credit covers the adoption of a child classified as “difficult to place” under the Adoption Act. The first year you claim it for a given child, attach a certification from the Children, Youth and Families Department or a licensed child placement agency stating that the child meets the statutory definition — a physical or mental impairment or emotional disturbance that is at least moderately disabling.

Child Income Tax Credit

The Child Income Tax Credit is also claimed on the PIT-RC. Eligibility and amounts follow the current year’s PIT-RC instructions from the Taxation and Revenue Department.

Getting Modified Gross Income Right

Several credits on the PIT-RC use modified gross income as the eligibility test, and New Mexico defines it much more broadly than federal AGI. Under NMSA § 7-2-2, modified gross income includes essentially all income from any source, taxable or not on your federal return. Only four narrow items come out: payments made on your behalf for hospital, dental, medical, or drug expenses; the value of room and board provided based on financial need rather than compensation; direct government payments to third parties on your behalf, like housing vouchers tied to a specific invoice; and any credits or rebates already received under the Income Tax Act.8Justia. The upshot: do not copy a number off your federal return. The PIT-RC instructions walk the calculation line by line, and mishandling this figure is the fastest route to a denied credit.

What to Gather Before You Start

Documents depend on which credits you plan to claim. Pull them all together first.

  • Your completed federal return and your PIT-1, since the PIT-RC draws from both.
  • Records for every income category listed under modified gross income: pay stubs, Social Security statements, unemployment records, workers’ compensation awards, and any other payments received during the year.
  • For the low-income comprehensive tax rebate: exemption count from your PIT-1, plus proof of age 65 or older or blindness if you are adding exemptions.
  • For the senior property tax rebate: a copy of your property tax bill or receipt for your principal residence, and the county where it is located.
  • For the additional county property tax rebate: the property tax statement for the qualifying property, if it sits in a county other than the one on your mailing address.

Filling Out the Form

Start at the top with modified gross income. Work through every income category in the statute, not just the ones on your federal return, and subtract only the four narrow exclusions listed above. This number drives most of what follows.

For the low-income comprehensive tax rebate, enter your total exemptions (from the PIT-1, with age and blindness additions), then read your rebate off the table in the instructions. For the senior property tax rebate, enter the property tax due on your principal residence. A separate table in the instructions sets the maximum property tax liability at your income level. For the child day care credit, fill in the Child Day Care Credit Worksheet before the PIT-RC section. Enter qualifying days, the daily rate (no more than $8 per child per day), and multiply by 0.40 for the per-child credit. For the medical care credit, the math is binary. If qualifying unreimbursed expenses total $28,000 or more, enter $2,800. If they fall short, leave the section blank.

Once each section is done, transfer the credit totals to the corresponding lines on your PIT-1. The PIT-RC feeds directly into your refund or balance-due calculation.

Filing and Getting Your Refund

The PIT-RC cannot be filed on its own. It travels with your PIT-1, along with any supporting attachments: the Child Day Care Credit Worksheet, PIT-CG forms, property tax statements, and adoption certifications.

Filing electronically through the Taxpayer Access Point (TAP) portal is faster. Paper returns can take up to 12 weeks to process because the department has to image and manually key the data.10NM Taxation & Revenue Department. Refunds – Individuals

After filing, check status through “Where’s My Refund?” on TAP using your Social Security number or ITIN and the exact refund amount. Paper filers should wait the full 12 weeks before checking. Mistakes That Cost People Credits

Modified gross income is the top source of trouble. Filers routinely leave out workers’ compensation, public assistance, and gifts because federal AGI ignores them. Understate this number and the department will adjust or deny the credit.

Claiming day care during periods you were not working is the second common trap. The credit is strictly tied to gainful employment. Time off for school or any other reason does not count, even if you kept paying the caregiver.5Legal Information Institute. Missing attachments stall returns. Without the PIT-CG from every caregiver, or the property tax statement for an out-of-county property, your return waits until the department writes to you.

Finally, the six-month presence rule bars part-year residents who arrived late in the year from the low-income comprehensive rebate and the senior property tax rebate, regardless of income.
