To divide a pension with a QDRO in Maryland, you need a Qualified Domestic Relations Order drafted to the plan’s specifications, reviewed by the plan administrator, signed by a Maryland Circuit Court judge, and then delivered back to the plan. The divorce decree by itself does not move any money. Until the plan has a qualified order on file, the administrator is legally required to pay 100% of benefits to the employee spouse, no matter what the judgment of absolute divorce says.
A QDRO is the correct order for private-sector pensions and 401(k) plans governed by the Employee Retirement Income Security Act. If your spouse works for the State of Maryland, a county, or a public school system, the pension is almost certainly under the Maryland State Retirement and Pension System, which is not an ERISA plan. For MSRPS benefits you need an Eligible Domestic Relations Order (EDRO) that satisfies COMAR 22.01.03.03.1Legal Information Institute. Maryland Code of Regulations COMAR 22.01.03.03 – Eligible Domestic Relations Orders Submitting a QDRO to the State Retirement Agency, or an EDRO to a private 401(k) administrator, will get the order rejected. Military retirements use a separate process through the Defense Finance and Accounting Service, discussed below.
Why the Divorce Decree Alone Is Not Enough
This is the single most expensive misunderstanding in pension division. A paragraph in the settlement agreement awarding “50% of the marital portion of Husband’s pension” has no legal effect on the plan. The plan administrator takes direction only from a court order that satisfies the plan’s qualification rules.
While you wait, the participant may retire, take a lump sum, roll the account into an IRA, remarry, or die. Any of those events can wipe out the alternate payee’s share. IRA rollovers are especially dangerous: QDROs only reach employer-sponsored plans, so once money lands in an IRA, the QDRO cannot pull it back. Recovery usually means a contempt proceeding, and the money may already be spent.
Start the order during the divorce case, not after. The safest practice is to have the plan administrator review a draft before the judge signs the divorce judgment, so a qualified order can be entered immediately afterward.
How Much of the Pension Can Be Divided
Maryland Family Law §8-205 gives the court authority to transfer an interest in a pension, retirement, profit-sharing, or deferred compensation plan from one spouse to the other. Only the portion of the pension earned during the marriage is marital property. Service credits earned before the wedding or after the divorce belong to the employee alone. The court does not automatically split the marital portion 50/50; it weighs statutory factors including contributions to the family, length of the marriage, each spouse’s economic circumstances, and how the pension was accumulated.2Maryland General Assembly. Maryland Code Family Law 8-205
For a traditional defined benefit pension, Maryland uses a coverture fraction from the 1984 case Bangs v. Bangs. The numerator is the length of the marriage; the denominator is the participant’s total credited service at retirement. The alternate payee’s share is typically one-half of that fraction applied to each pension payment.3Justia. Bangs v. Bangs Because the denominator floats until the participant actually retires, additional years of post-divorce service dilute the marital share. Whether to let the denominator float or fix it at the divorce date is a drafting decision worth discussing with counsel.
Defined contribution plans like 401(k)s are usually simpler. The order assigns a dollar amount or percentage of the account balance as of a specified valuation date.
Shared Interest or Separate Interest
One drafting choice controls when the alternate payee can actually collect money.
Under a shared interest, the alternate payee gets a slice of each pension check the participant receives, but only when the participant starts collecting. If the employee works until 65, the former spouse waits until 65.4U.S. Department of Labor. QDROs – Drafting QDROs FAQs Payments also stop when the participant dies unless the order includes survivor protections. Maryland state pensions operate on a shared basis: the EDRO regulations require the alternate payee’s share to be paid “if, when, and as paid” to the member.1Legal Information Institute. Maryland Code of Regulations COMAR 22.01.03.03 – Eligible Domestic Relations Orders
A separate interest, available in many ERISA defined benefit plans, carves out the alternate payee’s share as an independent benefit. The alternate payee can start collecting at the plan’s earliest retirement age whether or not the participant has retired, and can choose their own payment form and beneficiary. Check the plan’s Summary Plan Description or model QDRO to see which structures the plan actually offers.
What the Order Must Contain
QDROs and EDROs get rejected for small technical problems: a misspelled plan name, a missing provision, a benefit option the plan does not offer. Federal law requires a QDRO to specify the names and mailing addresses of the participant and alternate payee, the amount or percentage of benefits assigned, the number of payments or time period covered, and the exact name of the plan.5Office of the Law Revision Counsel. 26 USC 414 – Definitions and Special Rules A QDRO cannot require the plan to pay a type of benefit it does not offer, provide more than the actuarial value of accrued benefits, or assign benefits already covered by an earlier QDRO.6Office of the Law Revision Counsel. 29 USC 1056 – Form and Payment of Benefits
Before drafting, request two documents from the plan: the Summary Plan Description and the plan’s model QDRO or model EDRO.7U.S. Department of Labor. Every order should carry:
- Full legal names and mailing addresses of the participant and the alternate payee
- Social Security numbers, filed on a separate confidential form consistent with Maryland court rules protecting private information in public filings9Maryland Courts. New Judiciary Rules Help Protect Private Information in Court Documents
- The exact legal name of the plan as it appears in the Summary Plan Description
- Marriage and divorce dates defining the marital portion
- The dollar amount, percentage, or formula assigned to the alternate payee
- The payment period the order covers
- Survivor benefit elections
For an MSRPS EDRO, add each type of plan benefit assigned, whether the member may elect an optional form of allowance, and how cost-of-living adjustments apply to the alternate payee’s share.1Legal Information Institute. Filing and Approval, Step by Step
Two separate gatekeepers must sign off: the plan administrator and the court. Doing them in the wrong order is a common and costly mistake.
First, draft the order using the plan’s model form and send it to the plan administrator for a preliminary review. Both private ERISA plans and the Maryland State Retirement Agency will usually review drafts and flag any non-qualifying language before you take the order to a judge. Fixing problems at this stage is cheap. Fixing them after a judge has signed is not.
Once the administrator approves the draft, file the final version in the Maryland Circuit Court for the county where the divorce was granted. A judge signs it, and the clerk makes it part of the court record. Obtain a certified copy; the Circuit Court fee is $5 plus 50 cents per page.10Maryland Courts. Deliver the certified copy to the plan administrator. The administrator then runs its formal qualification review; for ERISA plans, that means confirming the order meets the requirements of 26 U.S.C. §414(p).5Office of the Law Revision Counsel. 26 USC 414 – Definitions and Special Rules A qualifying order gets a written determination letter. The 18-Month Segregation Window
Federal law protects the alternate payee during the qualification review. The plan must set aside amounts that would be payable under the order while it decides whether the order qualifies.7U.S. Department of Labor. QDROs – The Division of Retirement Benefits Through Qualified Domestic Relations Orders
This protection lasts only 18 months from the first date a payment would have been required under the order. If the order qualifies within that window, the plan pays the alternate payee. If 18 months pass without a determination, or if the order is finally rejected, the plan pays the segregated money to whoever would have received it absent any order, usually the participant. Once that money leaves the plan, it is gone.7U.S. Department of Labor. QDROs – The Division of Retirement Benefits Through Qualified Domestic Relations Orders
Get a domestic relations order on file early, even an imperfect one. Filing starts the clock on the plan’s segregation duty.
Don’t Forget Survivor Benefits
If the participant dies before retiring and the order says nothing about survivors, the alternate payee’s share can vanish. ERISA requires most defined benefit plans to offer a Qualified Pre-Retirement Survivor Annuity (QPSA), a lifetime annuity for a surviving spouse if a vested participant dies before benefits begin.11Internal Revenue Service. Retirement Topics – Qualified Pre-Retirement Survivor Annuity (QPSA)
A QDRO can designate a former spouse as the surviving spouse for QPSA purposes, preserving survivor rights after the divorce.11Internal Revenue Service. Retirement Topics – Qualified Pre-Retirement Survivor Annuity (QPSA) Without that designation, a later remarriage can transfer the QPSA to the new spouse by default. For MSRPS, the EDRO must state whether the member must elect an optional allowance that includes a post-retirement survivor benefit and whether the alternate payee is the beneficiary of that allowance.1Legal Information Institute. Maryland Code of Regulations COMAR 22.01.03.03 – Eligible Domestic Relations Orders Silence on survivor benefits lets the participant pick a payment form with no survivor protection at all.
Who Pays the Taxes
When an alternate payee who is a spouse or former spouse receives a QDRO distribution, the alternate payee pays the income tax, not the participant. The IRS treats the alternate payee as the plan participant for that purpose. If the order directs payment to a child or other dependent, the participant pays the tax.12Internal Revenue Service. Retirement Topics – QDRO Qualified Domestic Relations Order
QDRO distributions are also exempt from the 10% early withdrawal penalty that normally applies to retirement distributions before age 59½.13Office of the Law Revision Counsel. 26 USC 72 – Annuities, Certain Proceeds of Endowment and Life Insurance Contracts The exemption only covers money paid directly from the plan under the QDRO. Roll the money into an IRA and later take an early withdrawal, and the penalty will apply to that withdrawal.
To defer tax entirely, roll the distribution into a traditional IRA or another eligible retirement plan. A direct trustee-to-trustee transfer avoids the mandatory 20% withholding that applies to indirect rollovers.12Internal Revenue Service. Retirement Topics – QDRO Qualified Domestic Relations Order
If the Pension Is Military
Military retired pay is not divided by QDRO. It is divided under the Uniformed Services Former Spouses’ Protection Act, and the order goes to the Defense Finance and Accounting Service rather than a plan administrator. Under the frozen benefit rule from the 2017 National Defense Authorization Act, for divorces finalized before the member starts receiving retired pay, the divisible amount is capped at what the member would have received based on pay grade and years of service at the time of divorce, with only cost-of-living adjustments afterward. DFAS requires orders to include specific variables including pay grade, years of creditable service at divorce, the high-36 month average, and the marital share formula, or it will reject the order.14Defense Finance and Accounting Service. NDAA 17 Court Order Requirements Maryland’s Bangs language does not translate directly; the order has to track DFAS requirements.
What It Costs
Professional drafting fees for a straightforward QDRO generally run from $500 to $2,000, with complex orders involving multiple plans costing more. Both family law attorneys and specialized QDRO preparation services handle this work. Add the Circuit Court certification fee of $5 plus 50 cents per page.10Maryland Courts. Summary of Charges, Costs and Fees of the Clerks of the Circuit Court Some plan administrators charge their own processing fee and some do not. Spell out in the settlement agreement who pays these costs, so a few hundred dollars does not become its own dispute on top of a pension worth many times more.
