A plea in absentia in Georgia lets you close out a misdemeanor charge without showing up to court. Your attorney submits a signed written plea — guilty or nolo contendere — along with a waiver of your trial rights, and the judge enters judgment based on the paperwork. Georgia’s Uniform Court Rules allow this in misdemeanor cases when the defendant has knowingly and voluntarily waived the right to be present.1Cherokee County. Uniform State Court Rules of Georgia The outcome is the same conviction and sentence you would get standing in the courtroom, so the paperwork has to be right the first time.
Which Cases Qualify
The procedure is limited to misdemeanors. Traffic citations under Title 40 are the most common use, along with municipal ordinance violations and other misdemeanor charges where the penalty is primarily a fine.1Cherokee County. Uniform State Court Rules of Georgia Felonies are excluded entirely; you have to appear in person for those.
Even on a qualifying misdemeanor, there is no automatic right to plead in absentia. The judge decides whether to accept it. Requests are commonly denied in DUI cases, with repeat offenders, or any time the judge wants to speak with the defendant directly before pronouncing sentence.
Guilty or Nolo Contendere
Before signing anything, you have to decide between a guilty plea and a plea of nolo contendere (no contest). Both produce a conviction and the same sentence on the charge in front of the court. The differences surface afterward.
A nolo plea cannot be used against you in a civil lawsuit as an admission of guilt. If the citation came from an accident, a guilty plea to the traffic charge becomes evidence the other driver’s attorney can wave in front of a jury; a nolo plea takes that off the table. Georgia law also shields a nolo plea from civil disqualifications tied to a conviction, so you keep your rights to vote, hold office, and serve on a jury.2Justia Law. Georgia Code 17-7-95 – Plea of Nolo Contendere
For traffic offenses, the big draw is that an accepted nolo plea keeps points off your driver’s license. A guilty plea to a moving violation puts them on. There are two catches. First, the judge has to agree to accept a nolo plea; it is not available on demand. Second, you can only use the nolo option on a traffic citation once every five years. If you entered a nolo plea on a traffic case within the past five years, the Department of Driver Services treats a second one as a guilty plea and assesses points anyway.3Athens-Clarke County. What You’ll Sign
Every court maintains its own forms, so your attorney will start by pulling the right template from the clerk’s office or the court’s website. The package has two main pieces: the plea form itself, which states whether you are pleading guilty or nolo and lists the charges and code sections, and a waiver of rights.
The waiver spells out the constitutional protections you are giving up by not going to trial. You acknowledge each one individually:
- The right to a trial before a judge or jury.
- The right to be presumed innocent until proven guilty.
- The right to confront and question the witnesses against you.
- The right to remain silent.
- The right to require the state to prove its case beyond a reasonable doubt.
- The right to appeal, with limited exceptions.
Most forms also carry an immigration advisement warning noncitizens that a conviction can affect their status. Both you and your attorney sign; the attorney’s signature certifies that they reviewed the charges with you, explained the consequences, and confirmed the plea is voluntary. Some courts also require the defendant’s signature to be notarized. A form with missing information or the wrong signatures gets rejected, and the case ends up back on a calendar you were trying to avoid.4Cobb County. Plea in Absentia (Misdemeanor Only)
How the Plea Gets Filed
Only an attorney can submit a plea in absentia. You cannot file one for yourself as a self-represented defendant.5Bryan County State Court. Pleas in Absentia The sequence usually looks like this:
- Your attorney contacts the solicitor-general or prosecutor to negotiate the sentence, which charges will stand, and any conditions like probation or a safety course.
- The attorney prepares the plea form and a proposed sentencing order on the court’s template, listing each charge and its disposition.
- Many courts require the package to go to the solicitor first for pre-approval, confirming the terms match what was negotiated.5Bryan County State Court. Pleas in Absentia
- With the solicitor’s sign-off, the attorney files the originals with the clerk along with proof of any completed conditions and the payment.
The judge reviews the documents to confirm the plea is voluntary and the waiver is properly executed, then enters judgment and sentence. The negotiated sentence is a recommendation, not a binding agreement; the court can impose any penalty within the statutory range.4Cobb County. Plea in Absentia (Misdemeanor Only) For standard misdemeanors, Georgia caps fines at $1,000 and jail time at 12 months.6Justia Law. Georgia Code 17-10-3 – Punishment for Misdemeanors Generally Mandatory surcharges push the total you actually owe above the base fine, so ask your attorney or the clerk for the full figure before paying.
If You Live Out of State
This is where a plea in absentia earns its keep. If you were cited while driving through Georgia and live hundreds of miles away, you can hire a Georgia attorney, sign the paperwork at home, and never make the trip back. You will usually need to sign the plea form in front of a notary in your home state and overnight the originals to your attorney. Some courts accept emailed copies for the solicitor’s pre-review, but the signed originals still have to reach the clerk for filing.5Bryan County State Court. Pleas in Absentia
Ignoring the citation does not make it go away. Georgia will suspend your privilege to drive in the state, and because most states share driver records through interstate compacts, your home state may suspend your license or hold up a renewal until the Georgia case is closed.
If You Skip Court Instead
Failing to appear without filing a plea triggers an automatic chain reaction. For a traffic citation, the Department of Driver Services suspends your license (or your Georgia driving privilege, if you are out of state) once the court reports the failure to appear. The suspension takes effect 28 days after DDS receives the notice.7Georgia Department of Driver Services. Failure to Appear (FTA)
The suspension does not time out. It stays in place until you appear, enter a plea, pay the fines, or get a reinstatement order. On top of resolving the underlying charge, you owe a $100 restoration fee to DDS, or $90 if you handle it by mail.8Justia Law. Georgia Code 40-5-56 – Suspension of License for Failure to Respond to Citation Resolve the case before the suspension takes effect and you avoid the restoration fee entirely.7Georgia Department of Driver Services. Failure to Appear (FTA) The court can also issue a bench warrant, and driving on a suspended license is a separate criminal offense with its own fines and potential jail time.
Changing Your Mind After You Sign
Timing controls your options. Before the judge pronounces sentence, you can withdraw a guilty plea and switch to not guilty as a matter of right.9Justia Law. Georgia Code 17-7-93 – Reading of Indictment or Accusation Your attorney has to notify the court before the judge acts on the package.
Once the sentence is imposed, the standard flips hard. You have to file a motion and prove that withdrawal is necessary to correct a “manifest injustice.”10Georgia Courts. Uniform Superior Court Rules – Rule 33.12 Plea Withdrawal Courts have recognized ineffective counsel, coercion, or newly discovered evidence of innocence as potentially meeting that bar, but it is a steep climb. A plea in absentia moves fast once filed: the attorney walks the package in, the judge may enter judgment the same day, and the window to walk it back is short. Think it through before you sign.
Points, Insurance, Jobs, and Immigration
Driver’s License Points and Insurance
A nolo plea on a traffic case keeps points off your license; a guilty plea does not. Your insurer sees the conviction either way on your driving record, and a guilty plea to a moving violation almost always triggers a rate increase. Some insurers treat a nolo plea more favorably because no points attach. If you have already used the nolo option in the past five years, you are stuck with a guilty plea and the points that come with it.3Athens-Clarke County. Pleading Guilty or Nolo Contendere
Employment Background Checks
A nolo plea protects you from civil disqualifications under Georgia law, but many employers do not draw the distinction. The Georgia Department of Public Safety, for example, treats a nolo plea the same as a conviction when screening applicants; a nolo plea to a DUI within the past five years is an automatic disqualifier.11Georgia Department of Public Safety. Employment Disqualifiers Private employers running background checks will see the plea on your record. The nolo-versus-guilty split matters most for civil liability and license points, not necessarily for hiring.
Immigration Consequences
If you are not a U.S. citizen, any criminal plea can affect your status, regardless of whether it is guilty or nolo and regardless of whether you entered it in person or in absentia. Certain misdemeanor convictions are deportable or make you inadmissible for future visa or green card applications. The Georgia plea forms carry an immigration warning, but a line on a form is not a substitute for an actual conversation with a lawyer who handles both criminal and immigration work.4Cobb County. Plea in Absentia (Misdemeanor Only) If you are in that category, raise it with your attorney before you sign anything.
