How to Fight a Restraining Order in California

To fight a restraining order in California, you file a written response on the Judicial Council form that matches the petition, serve it on the petitioner at least five court days before the hearing, and show up to that hearing with organized evidence that contradicts the allegations. The hearing usually lands within a few weeks of service, and a final order can last up to five years, strip your firearm rights, force you from your home, and reshape custody of your children.1Judicial Branch of California. Identify Which Type of Order You Are Facing

The type of order controls what the petitioner has to prove, and that is the first thing to pin down because it shapes your whole defense.

A Domestic Violence Restraining Order (DVRO) applies when the petitioner is a current or former spouse, dating partner, co-parent, or close family member. The petitioner only needs to show by a preponderance of the evidence that past abuse occurred — meaning the judge believes it is more likely than not.2Judicial Branch of California. A Civil Harassment Restraining Order (CHRO) covers people without a close relationship: neighbors, coworkers, acquaintances. Under Code of Civil Procedure section 527.6, the petitioner must prove harassment by clear and convincing evidence, and must show the conduct would cause a reasonable person substantial emotional distress rather than mere annoyance.3California Legislative Information. A separate Elder or Dependent Adult Abuse Restraining Order exists for petitioners 65 and older or who qualify as dependent adults, governed by Welfare and Institutions Code section 15657.03.4California Courts. Elder or Dependent Adult Abuse Restraining Orders in California

Do Not Miss the Hearing

If you do not appear, the judge can grant the order by default. The petitioner wins without proving anything to a contested courtroom, and a final order takes effect for up to five years. Once that happens, the order goes into California’s CLETS law enforcement database, triggers a federal firearms prohibition, and can drive custody decisions against you.5Judicial Council of California. CLETS-001 Confidential Information for Law Enforcement Undoing a default order later is far harder than contesting the petition the first time. Whatever else goes wrong in your preparation, be in the courtroom.

File Your Written Response on the Correct Form

When you are served, you will receive the petition and a Temporary Restraining Order (TRO), along with a Notice of Court Hearing — form DV-109 for a DVRO or CH-109 for a CHRO. Item 3 on that notice gives you the date, time, and location of your hearing.6Judicial Branch of California. Notice of Court Hearing (Domestic Violence Prevention) (DV-109)

Your written answer goes on form DV-120 (DVRO) or CH-120 (CHRO). This is where you deny the allegations and explain in your own words why the order should not be granted. If the petition involves your children, you also file DV-125 (Response to Request for Child Custody and Visitation Orders) and FL-150 (Income and Expense Declaration). Under the California Rules of Court, your response must be filed with the court and served on the petitioner at least five court days before the hearing.7Judicial Branch of California. You cannot serve your own paperwork. Someone over 18 who is not a party to the case must hand-deliver or mail it to the petitioner, then complete a Proof of Service that you file with the court. Missing the service deadline does not end the case, but it typically gets the hearing continued, and the TRO stays in place during any delay.

Asking for More Time

If you need more time to prepare, use form DV-115 (Request to Continue Hearing) in a DVRO case. Judges generally grant a first continuance when the respondent asks or when service went wrong. Anything beyond that requires good cause — a genuinely compelling reason such as an unavailable key witness or missing critical records. Any continuance extends the existing TRO for the length of the delay.

Fee Waivers

If filing fees are a problem, request a waiver using form FW-001. You qualify automatically if you receive Medi-Cal, CalFresh, SSI, or CalWORKs, or if your income is below the published thresholds.8Judicial Council of California. FW-001-INFO Information Sheet on Waiver of Superior Court Fees and Costs File it alongside your response, and the same waiver will cover a later appeal if you need one.

Build Evidence That Contradicts the Petition

A restraining order defense is won with documents more than with speeches. Testimony is brief; organized exhibits that directly contradict the petitioner’s timeline carry disproportionate weight. Gather text messages, emails, call logs, photographs, social media posts, financial records, and anything else that undercuts the petition’s claims.

Put every exhibit in a binder with a cover index and sequentially numbered tabs. Print complete conversation threads, not isolated screenshots — judges are openly skeptical of cherry-picked texts. Each printout should show the sender’s name or number, the date and time, and the full context around the message. For photos or video, include timestamps and any metadata showing when and where they were captured. Bring at least three copies: one for the judge, one for the petitioner, one for you.

If someone witnessed relevant events and is willing to testify, line them up early and tell them what to expect. If a necessary witness is reluctant, you can compel attendance with a Civil Subpoena for Personal Appearance (form SUBP-001) issued by the clerk and served by a third party with enough lead time to arrange their appearance.9Judicial Branch of California. What the Hearing Looks Like

The petitioner goes first because they carry the burden of proof. They will be sworn in, testify, and introduce their exhibits. When they are done, you get to cross-examine — this is your first real chance to damage their case. Focus on inconsistencies between the written petition and their live testimony, holes in the timeline, and any motive to fabricate.

Then you present your side. You will be sworn in, testify about your version of events, and move your exhibits into evidence. The judge may question you directly. Your witnesses testify after you and are subject to cross-examination by the petitioner.

Expect objections, particularly hearsay — a statement someone else made offered to prove the truth of what they said. Statements you introduce for a different purpose, such as a text used to show the petitioner’s state of mind rather than to prove what the text asserts, are generally not hearsay. After the evidence closes, both sides get brief closing remarks and the judge rules.

Surrender Any Firearms on Time

Firearm compliance runs on a clock that starts the moment you are served, and getting it wrong creates separate criminal exposure while you are still fighting the underlying order. Under California Family Code section 6389, service of a protective order prohibits you from owning, possessing, purchasing, or receiving any firearm or ammunition for the duration of the order.10California Legislative Information. California Family Code FAM 6389

  • If a law enforcement officer serves the order and firearms are present, you turn them over on the spot.
  • If no officer takes them at service, you have 24 hours to surrender them to local law enforcement or transfer them to a licensed dealer.
  • Within 48 hours of service, you must file the surrender receipt with both the issuing court and the law enforcement agency that served you. Failing to file the receipt is itself a violation of the protective order.10California Legislative Information. California Family Code FAM 6389

A final order after a noticed hearing also triggers the federal firearm ban under 18 U.S.C. § 922(g)(8), which applies to qualifying intimate-partner orders that either include a credible-threat finding or explicitly prohibit the use of physical force.11Office of the Law Revision Counsel. 18 U.S.C. 922 – Unlawful Acts Temporary ex parte orders generally do not trigger the federal ban, but any final California DVRO almost certainly does.

After the Judge Rules

If the Petition Is Denied

The TRO expires at the end of the hearing. If you surrendered firearms, confirm the dissolution is in the court record, then file the paperwork required by the court and by the agency or dealer holding them to start the recovery process.

If the Order Is Granted

Comply with every term the moment the judge announces the decision — no-contact provisions, stay-away distances, move-out orders, all of it. Violating any term is a misdemeanor under Penal Code section 273.6, punishable by up to one year in county jail and a fine of up to $1,000. A violation causing physical injury carries a 30-day minimum jail sentence and a $2,000 fine, and a second violation involving violence within seven years can be charged as a felony.12California Legislative Information. California Penal Code 273.6

Appealing

To challenge a granted order, file a Notice of Appeal (form APP-002) within 60 days of entry of the order. A 180-day window applies only if you were never formally served with notice of the judgment, so treat the 60-day deadline as the real one.13Judicial Branch of California. Step 2: File the Notice of Appeal The filing fee is $775 plus a deposit for the trial court record, and the FW-001 waiver covers appeals too.

An appeal does not pause the restraining order. The order stays fully enforceable throughout the appeal unless the appellate court grants a stay, which is rare. Appeals are decided on the trial record. There is no new hearing and no new evidence. The appellate court reviews whether the trial judge made a legal error, not whether a different judge might have weighed the same facts differently.

Modification or Early Termination

Circumstances change. Under Family Code section 6345, either party can move to modify or terminate the order before it expires, or both parties can file a written stipulation together. If you are the one filing, you must personally serve the protected party. If they cannot be located and served, the court must deny the motion without prejudice or postpone it until proper notice is given.14California Legislative Information. California Family Code 6345 Early termination is granted most readily when both parties agree, when significant time has passed without incident, or when the underlying circumstances have materially changed.

Why the Fight Matters Beyond the Order

If you share children with the petitioner, the stakes are higher than the restraining order itself. The judge can issue temporary custody and visitation orders in the same hearing, and under Family Code section 3044 a finding that a parent committed domestic violence within the past five years creates a legal presumption against giving that parent custody.15Judicial Branch of California. Domestic Violence and Child Custody In practice the other parent usually receives sole legal and physical custody, and any visitation you get may be supervised. The presumption is rebuttable, but overcoming it is an uphill fight.

The order will also appear in CLETS and surface in background checks run by employers, landlords, and licensing agencies.5Judicial Council of California. CLETS-001 Confidential Information for Law Enforcement The federal firearm ban alone disqualifies you from any job that requires carrying a weapon.11Office of the Law Revision Counsel. 18 U.S.C. 922 – Unlawful Acts A civil restraining order with no criminal charge attached can still follow you professionally for years, which is why contesting the petition properly at the first hearing matters far more than trying to repair the damage later.
