How to Fight a Writ of Execution in California: Exemptions and Deadlines

To fight a writ of execution in California, you have two basic moves: file a Claim of Exemption to protect specific property the sheriff is trying to take, or file a motion in the issuing court to quash, recall, or vacate the writ or the judgment behind it. Which one fits depends on whether the problem is the property being seized or the judgment itself. Either way, the deadline is short. If you were personally served with the notice of levy, you have 15 days to file a Claim of Exemption. If you were served by mail, you have 20.1California Legislative Information. The Deadline That Controls Everything

A writ of execution is a court order authorizing the sheriff to seize your property, including bank funds, wages, vehicles, and real estate, to pay a money judgment.2California Legislative Information. California Code of Civil Procedure 699.510 Once the levying officer serves the notice of levy, your window to protect that specific property opens and closes fast: 15 days from personal service, 20 days from service by mail.1California Legislative Information. California Code of Civil Procedure 703.520 Miss it, and the levying officer can release your funds to the creditor.

For personal debts, you can file a late Claim of Exemption, but the levying officer is not required to hold the money while your claim is pending.1California Legislative Information. California Code of Civil Procedure 703.520 The money can be gone by the time a judge hears you out. Treat the 15 or 20 days as hard.

Filing a Claim of Exemption

The Claim of Exemption is the primary tool for protecting property after a levy. The process is simple on paper and unforgiving on timing.

Fill out Judicial Council Form EJ-160. The form asks you to describe the property, cite the specific statute that exempts it, and give the facts supporting your claim.3Judicial Council of California. California Judicial Council Form EJ-160 – Claim of Exemption Certain exemptions also require a financial statement listing your income, expenses, and assets. Sign under oath.

Deliver the completed original plus one copy to the levying officer named on your notice of levy. Do not file it with the court. The levying officer keeps the original and forwards a copy to the judgment creditor.4California Courts. Make a Claim of Exemption for a Bank Levy

If the creditor does not oppose, the property is released. If the creditor opposes, the court sets a hearing and sends you a Notice of Opposition and a Notice of Hearing with the date, time, and location.4California Courts. What Property You Can Protect

California exemptions keep creditors from stripping you of what you need to live. Even when the judgment and writ are both valid, specific categories of property are off-limits.

Wages

Garnishment is capped at the lesser of 20% of your disposable earnings for the pay period, or 40% of the amount by which your disposable earnings exceed 48 times the state (or higher local) minimum hourly wage.5California Legislative Information. California Code of Civil Procedure 706.050 If what’s left after garnishment won’t cover your family’s basic needs, you can file a Claim of Exemption to reduce the amount being taken.6California Courts. Home Equity

The homestead exemption shields equity in your primary residence. The protected amount is the greater of the countywide median sale price for a single-family home in the prior calendar year (capped at $600,000 before adjustment) or a floor of $300,000. Both figures adjust annually for inflation using the California Consumer Price Index.7California Legislative Information. California Code of Civil Procedure 704.730 Check the current year’s published amount, because it changes each January.

Vehicles and Household Goods

You can protect up to $7,500 in combined equity across all motor vehicles you own.8California Legislative Information. California Code of Civil Procedure 704.010 If your only vehicle is sold at an execution sale, the first $7,500 of the proceeds is automatically exempt without any filing. Household furnishings, appliances, and personal effects reasonably necessary for daily life are also exempt. An unusually valuable item like a rare antique may not qualify.

Retirement Accounts

The protection splits in two. Employer-sponsored plans such as 401(k)s, pensions, and union retirement plans are fully exempt both inside the plan and after distribution. IRAs and self-employed retirement plans are weaker: they are exempt only to the extent necessary to support you and your dependents in retirement, taking into account your other available resources.9California Legislative Information. California Code of Civil Procedure 704.115 A creditor can argue that a debtor with substantial other assets doesn’t need all of the IRA funds for retirement. If an IRA is the main target, expect a fight over what “necessary for support” means in your situation.

Bank Account Minimums

Under Code of Civil Procedure Section 704.220, funds in your bank account up to the minimum basic standard of adequate care for a family of four are automatically exempt. You don’t have to file anything for that slice of money; the protection applies as soon as the levy hits. Anything above that threshold is not automatically protected, but you may still file a Claim of Exemption if the extra funds came from an exempt source such as wages or Social Security.

Attacking the Writ or the Judgment Itself

Exemptions protect property. If the real problem is that the writ shouldn’t exist, or the judgment behind it shouldn’t exist, you need a different move: a motion filed in the court that issued the judgment. The usual labels are motion to quash the writ, motion to recall the writ, or motion to vacate the judgment. You’ll prepare a Notice of Motion, a declaration setting out the facts, and a brief with your legal argument. Serve the motion on the judgment creditor; the court will set a hearing.

Common grounds include:

  • The judgment has already been satisfied. If you paid, gather receipts, bank records, or a filed acknowledgment of satisfaction of judgment.
  • The judgment is void because the court lacked jurisdiction or you were never properly served with the original lawsuit. A void judgment has no force regardless of how much time has passed.
  • The writ contains errors, such as being issued against the wrong person or for an incorrect amount. California law entitles a person whose property is wrongly targeted based on an incorrect identity to recover attorney’s fees and costs from the creditor.10Justia. California Code of Civil Procedure 699.510-699.560
  • The judgment has expired. A California money judgment is enforceable for 10 years from entry and must be renewed before that runs. If more than 10 years have passed with no renewal, enforcement is barred.11California Legislative Information. California Code of Civil Procedure 683.020

Vacating a Default Judgment

Many people first learn about a lawsuit when the sheriff shows up. If a default judgment was entered because you never received the complaint or missed the deadline through a genuine mistake, Code of Civil Procedure Section 473(b) lets you ask the court to set it aside for mistake, inadvertence, surprise, or excusable neglect.12California Legislative Information. California Code of Civil Procedure 473

The window is six months from the date the judgment was entered. File within it, show a legitimate reason for not responding, and the court has discretion to vacate the judgment. Once it’s vacated, any writ based on it becomes unenforceable, and you get to defend the original case on the merits. After six months, your options narrow, though a judgment that is truly void for lack of jurisdiction can be attacked at any time.

Using Bankruptcy to Stop a Levy

Filing for bankruptcy triggers an automatic stay that immediately halts most collection activity, including enforcement of a writ of execution.13Office of the Law Revision Counsel. 11 U.S. Code 362 – Automatic Stay The stay reaches any act to enforce a pre-existing judgment or collect a pre-existing debt.14United States Bankruptcy Court. Automatic Stay, What Is It and Does It Protect a Debtor From All Creditors A creditor who keeps pushing after being notified of the filing can face sanctions.

Bankruptcy isn’t a cure-all. The stay is temporary, and whether the underlying debt gets discharged depends on the chapter you file and the type of debt. Child support, most tax debts, and student loans typically survive. But for someone facing an imminent seizure of wages or bank funds, filing can buy critical time and often eliminate the debt. Talk to a bankruptcy attorney before the levy lands if you can.

When the Property Belongs to Someone Else

If the sheriff levies property that actually belongs to a roommate, spouse, business partner, or other third party, that third party files a claim with the levying officer describing their ownership interest, and may post an undertaking (a type of bond) to secure the property’s release while the dispute is resolved. The undertaking is generally twice the market value of the property or twice the creditor’s lien amount, whichever is less. To keep the levy in place after a third-party claim, the creditor must post a bond of their own, or the property is released.
