How to File a Change in Relationship Form in California

There isn’t one universal change in relationship form in California. When you marry, divorce, register or dissolve a domestic partnership, or lose a spouse, you file different paperwork with different agencies depending on who holds your benefits and what changed. For most people that means the CalPERS HBD-12 (if you’re a public employee), a Covered California special enrollment request (if you buy your own coverage), a Notice of Termination with the Secretary of State (if you’re ending a qualifying domestic partnership without court), and an SS-5 with the Social Security Administration (if your legal name changed). Nearly all of these carry a 60-day deadline from the date of the event.

Which Form Applies to Your Situation

Start by matching the event to the agency that controls what you’re trying to update.

If you have coverage through a private employer, the form will come from your HR department rather than CalPERS, but the documentation and deadlines generally follow the same pattern.

The 60-Day Deadline

The window is tight and it’s the same across most of these filings. CalPERS requires enrollment changes within 60 days of the qualifying life event.7California Public Employees’ Retirement System. Eligibility and Enrollment Covered California applies the same 60-day deadline for special enrollment after marriage, divorce, or a domestic partnership change.3Covered California. Special Enrollment The federal marketplace works the same way.8HealthCare.gov. Getting Health Coverage Outside Open Enrollment

Miss the window and you’re generally waiting for the next open enrollment to make changes to health coverage. For a new spouse or partner, that can mean months without coverage. Treat the 60 days as the organizing deadline for everything else.

Documents to Gather First

Every agency wants certified proof of the event before it will process the change. CalPERS lists the following by event type:1California Public Employees’ Retirement System. Health Benefits Plan Enrollment for Active Employees HBD-12 Instructions

  • Marriage: certified marriage certificate
  • Domestic partnership: Declaration of Domestic Partnership from the Secretary of State
  • Divorce: divorce decree
  • Domestic partnership termination: Notice of Termination filed with the Secretary of State
  • Death of a dependent: death certificate

Other benefit administrators ask for the same types of documents. Order certified copies from the county recorder where the event was recorded, or from the Secretary of State’s office for domestic partnerships. County offices can take several weeks to turn requests around, so request them the week the event happens rather than waiting until you sit down with the form.

If you’re adding a registered domestic partner to CalPERS health coverage, you’ll also need your partner’s Social Security number along with the Declaration of Domestic Partnership.9California Public Employees’ Retirement System. Enroll Family Members

Ending a Domestic Partnership Through the Secretary of State

You can end a California registered domestic partnership without going to court by filing a Notice of Termination of Domestic Partnership directly with the Secretary of State. There’s no filing fee.10Cornell Law Institute. California Code of Regulations 2 CCR 21922 But every one of the following conditions must be true at the time you file, or you have to go through Superior Court instead:4California Secretary of State. Terminating a California Registered Domestic Partnership

  • Both partners agree and both sign.
  • The partnership lasted fewer than five years.
  • No children were born to or adopted by the partners during the partnership, and neither partner is pregnant.
  • Neither partner owns any interest in land or buildings. A rental lease is allowed only if it has no purchase option and expires within one year of filing.
  • Community obligations (excluding car loans) total no more than $7,000.
  • Community property (excluding cars and loan balances) is worth less than $57,000, and neither partner’s separate property exceeds $57,000.
  • You’ve already signed a written agreement dividing assets and debts.
  • Neither partner wants financial support from the other beyond the property agreement.

Both signatures must be notarized.11California Courts. Summary Dissolution to End a Domestic Partnership Mail the original to the address on the form. The termination becomes effective six months after the Secretary of State files it, and your legal obligations to each other continue during that waiting period.

Updating CalPERS Health Coverage

If you work for the state or another CalPERS-covered employer, the HBD-12 is the form that adds a new spouse or partner, removes a former one, or records a death. You submit the completed form to your agency’s Health Benefits Officer, not directly to CalPERS.1California Public Employees’ Retirement System. Many agencies now accept the same changes through myCalPERS, where you can submit enrollment updates and upload documents electronically without the paper HBD-12.2California Public Employees’ Retirement System. Online Health Enrollment for Active Employees Check with your HR department before filling out the paper form. One important limit: the HBD-12 covers health plan enrollment only. Dental, vision, and other benefit changes go through separate forms your employer provides.

Covered California Changes

If you buy coverage through Covered California, marriage, divorce, legal separation, and dissolution of a domestic partnership all open a 60-day special enrollment period.3Covered California. Special Enrollment In that window you can enroll in a new plan, add or drop a dependent, or switch plans entirely. One or both members of a newly married or newly registered couple can use the window. After a divorce or dissolution, you can remove a former dependent, or sign up for your own plan if you lost coverage as someone else’s dependent.

Name Changes: SSA First, Then DMV

If you’re taking a new legal name, the order matters. Update Social Security first, because every other agency verifies your name against SSA records.

File Form SS-5 with the Social Security Administration along with documents proving your identity, your new legal name, and the event that caused the change (marriage certificate, divorce decree, or similar).5Social Security Administration. Once SSA has your new name, apply for an updated California driver’s license or ID. The DMV checks your information against SSA first and will deny the application if the names don’t match.6California Department of Motor Vehicles. Updating Information on Your Driver License or Identification DL/ID Card You can start online but must finish in person with your proof documents. For a REAL ID, bring proof of identity, your Social Security number, and two proofs of California residency. If you’ve had earlier legal name changes, bring documentation for each one.

Dividing a CalPERS Pension in a Divorce

California treats retirement benefits as community property, so your CalPERS pension can be divided when a marriage or domestic partnership ends. A former spouse’s share can run up to 50 percent of the benefit you earned during the relationship.13California Public Employees’ Retirement System. Divorce and Your Pension

You divide the benefit with a Qualified Domestic Relations Order (QDRO). Once CalPERS learns about the divorce, it places a hold on benefits until the community property claim is resolved. You and your former spouse draft a proposed QDRO and send it to CalPERS, which has 60 days to confirm the language is acceptable. After CalPERS approves the draft, you file the order with the court, then send the filed order back to CalPERS for a second 60-day review. Only after that second clearance does CalPERS lift the hold.13California Public Employees’ Retirement System. Divorce and Your Pension

Submit the draft QDRO to CalPERS before you sign any settlement agreement locking in the division terms. CalPERS will reject orders that don’t meet its requirements, and until the QDRO clears both reviews, neither party can touch the held benefits, no matter what the divorce decree says.

Tax Filing Status for the Year of the Change

Your marital status on December 31 sets your federal filing status for the whole year. The IRS considers you married until a court finalizes your divorce or separate maintenance decree, however long you’ve been separated.14Internal Revenue Service. Filing Taxes After Divorce or Separation Once the divorce is final, you file as single for that year unless you remarry before year-end or qualify for head of household.

Head of household takes three things: your spouse did not live in your home for the last six months of the year, you paid more than half the cost of keeping up the home, and a dependent child lived with you for more than half the year.14Internal Revenue Service.
