How to File a Colorado Amended Tax Return: DR 0104X Steps and Deadlines

To file a Colorado amended tax return, complete Form DR 0104X for the tax year you’re correcting and submit it through Revenue Online or by mail, along with every supporting schedule and any federal documentation behind the change. If the amendment stems from a change to your federal return, you have 30 days from the federal change to file with Colorado.1Justia Law. Colorado Code 39-22-601 – Returns

When an Amendment Is Required

Two situations force an amendment. The first is a federal change: if the IRS makes a final adjustment to your federal taxable income, or you file a federal Form 1040-X that changes income reportable to Colorado, state law gives you 30 days to file the Colorado amendment.1Justia Law. Colorado Code 39-22-601 – Returns Miss the window and penalties and interest attach to any additional tax.

The second is an error you discover on your own. Wrong income figure, missed deduction or credit, wrong filing status — Colorado requires the correction whether it increases your tax or produces a larger refund.2Colorado Department of Revenue. Amending an Individual Income Tax Return

How Long You Have to File

If You’re Claiming a Refund

You generally have four years from the return’s original due date, or three years from the date you last paid tax for that year, whichever is later.3Colorado Department of Revenue. Amended Individual Income Return Instructions For a net operating loss or investment tax credit carryback, the window is four years from the due date of the return for the year the loss or credit originated. One hard limit: Colorado will not issue a refund if you never filed an original return for that year within four years of when it was due.4Justia Law. Colorado Code 39-21-108 – Refunds

If You Owe Additional Tax

Colorado’s assessment period tracks the federal timeline plus one year, so the state can generally assess additional tax within about four years of the return’s original due date.5Justia Law. Colorado Code 39-21-107 – Limitation on Assessment of Tax When the amendment is triggered by an IRS change, the 30-day rule overrides that longer window.

Preparing the DR 0104X

The DR 0104X is the only form Colorado accepts for an individual amended return, and you must use the version for the tax year you’re correcting. A wrong-year form will not be processed.3Colorado Department of Revenue. Amended Individual Income Return Instructions

What to Gather First

Pull your original Colorado return and the documents behind whatever you’re changing. Then add:

  • A copy of your federal Form 1040-X, if the amendment involves a federal change.
  • The IRS revenue agent’s report and supporting schedules, if the change comes from an IRS audit.
  • A federal record of account supporting any change to federal taxable income.
  • Every original schedule and form from the return you’re amending, even those you aren’t changing, plus copies of any credit certificates.

Part-year residents and nonresidents also need a corrected Form 104PN.3Colorado Department of Revenue. Amended Individual Income Return Instructions

Filling It In

The form uses a side-by-side layout: original figures in one column, corrected figures in another. Enter zero on any line that doesn’t apply. Write out an explanation identifying each line you’re changing, the dollar amounts, and the reason. If an IRS adjustment drove the amendment, say so and attach the supporting documents.

Filing status changes carry their own rules. Switching from single or married-filing-separately to joint, list the taxpayer who filed the original single return first. If both spouses filed separately and you’re now filing jointly, either can be listed first, but note in the explanation that the original return used a different primary Social Security number. Switching from joint to separate requires the same kind of identification of the original primary filer.3Colorado Department of Revenue. Amended Individual Income Return Instructions

Account for payments already made and refunds already received for that tax year. The form nets your corrected liability against what’s already changed hands to produce the final balance due or overpayment.

Submitting the Return

Electronic filing through Revenue Online is free and covers tax years 2009 forward.2Colorado Department of Revenue. Amending an Individual Income Tax Return You can e-file even if your original return was on paper. E-filing reduces processing errors and typically turns around faster.6Colorado Department of Revenue. Amended Individual Income Tax Return

Paper filers should use one of two addresses:

  • With payment: Colorado Department of Revenue, Denver, CO 80261-0006
  • Without payment: Colorado Department of Revenue, Denver, CO 80261-0005

Attach every required schedule and supporting document before mailing.6Colorado Department of Revenue. Amended Individual Income Tax Return If a deadline is close, send it by certified mail with return receipt so you have proof of the filing date.

If You Owe: Penalties, Interest, and Payment Plans

Penalties and interest run from the original due date of the return, not the date you file the amendment. The longer you wait, the more the total grows.

The late payment penalty is the greater of $5 or 5% of the unpaid tax, plus an additional 0.5% for each full or partial month the balance stays unpaid, capped at 12%. Interest for 2026 is 8% annually if you pay before a notice of deficiency or within 30 days of receiving one; miss that window and the rate rises to 11%.7Colorado Department of Revenue. Can’t pay in full? Colorado offers monthly payment plans. Once you receive a bill from the Department of Revenue, you can set one up through Revenue Online. For current-year income tax debt, you can call the Collections Section at (303) 205-8291 after April 15 to arrange a plan before a bill arrives. Penalties and interest keep accruing during the plan, so shorter is cheaper. If the standard monthly payment causes genuine hardship, Form DR 6596 lets you request extended terms, though you have to keep making the regular payments while the request is reviewed.8Colorado Department of Revenue. What Happens After You File

Amended returns get manual review, so they take longer than originals. General processing estimates from the CDOR:

  • E-filed returns: 3 to 5 weeks
  • Paper returns: up to 3 months

Amended returns often sit at the longer end of those ranges.9Department of Revenue – Taxation. Refund Track status through Revenue Online, which shows the same information CDOR staff see. Expect possible follow-up letters requesting clarification or documentation. Answer them quickly. Ignoring correspondence turns a routine amendment into a months-long problem. Refunds come by direct deposit or paper check, depending on how you filed.

Amending for a Deceased Taxpayer

If the taxpayer died after filing the original return and the amendment claims a refund, attach Form DR 0102 (Claim for Refund Due Deceased Taxpayer) and a copy of the death certificate to the DR 0104X.3Colorado Department of Revenue. Amended Individual Income Return Instructions A surviving spouse filing an amended joint return with the deceased doesn’t need federal Form 1310. A court-appointed personal representative claiming a refund must include the court certificate showing appointment; a copy of the will alone is not accepted.11Internal Revenue Service.
