How to File a Garnishment Exemption Claim Form in Virginia

To file a garnishment exemption claim form in Virginia, complete General District Court Form DC-454, check every exemption that fits your situation, ask for a hearing on the form itself, and return it to the clerk of the general district court that issued the garnishment summons. Bring documents that tie the garnished money to a protected source. The court must give you a hearing within seven business days of filing.

Get the Form and Fill It In

The form is titled “Request for Hearing — Garnishment Exemption Claim,” numbered DC-454.1Virginia’s Judicial System. Form DC-451 – Garnishment Summons Instructions It should arrive attached to your copy of the garnishment summons, which the process server is required to mail to your last known address after serving your employer or bank.2Virginia Code Commission. Virginia Code 8.01-511 – Institution of Garnishment Proceedings If the form isn’t in the envelope, get one from the clerk’s office of the issuing court or download it from the Virginia Judicial System’s website.3Virginia Judicial System Court Self-Help. Copy the court name, case number, and party names directly off the summons. The center of the form is where you identify the legal exemptions you’re relying on. Check every one that applies; the section below runs through the choices. Make sure you check the box requesting a hearing, because that request is what puts you in front of a judge.

Before you file, pull together the paperwork that proves your claim. If your bank account was frozen and it holds Social Security money, that means bank statements showing the deposits plus your benefit award letter. For a wage garnishment dispute, gather pay stubs and any records showing what was withheld. The form itself is short. The documents behind it decide the hearing.

Which Exemptions to Claim

Virginia’s exemptions fall into a few categories. Some protect specific types of income wherever the money sits. Others cover property or a flat dollar amount.

Homestead Exemption

A Virginia householder can shield up to $5,000 in cash or personal property, or up to $10,000 if you are 65 or older, plus $500 for each dependent you support. The homestead exemption also protects real or personal property used as your principal residence up to $50,000 in value.4Virginia Code Commission. Virginia Code 34-4 – Exemption Created Veterans rated 40 percent or higher for a service-connected disability can exempt an additional $10,000 beyond the standard amounts.5Virginia Code Commission. Virginia Code 34-4.1 – Additional Exemption for Certain Veterans

For personal property and cash, the homestead exemption takes full effect only after you record a homestead deed with the circuit court in the city or county where you live.6Virginia Code Commission. Virginia Code 34-14 – How Set Apart in Personal Estate; Form to Claim Exemption You can still claim the exemption on the DC-454 without a recorded deed, but the recorded deed removes doubt at the hearing. See the section on homestead deeds below.

Protected Income Sources

Several categories of income stay protected even after they land in a bank account:

  • Social Security and SSI benefits
  • Veterans’ benefits
  • Unemployment compensation
  • Federal retirement and disability benefits, including civil service retirement
  • Workers’ compensation payments

These sources are exempt from most creditor garnishment, and the exemption claim form is where you assert them when frozen funds trace back to those deposits.7Virginia Code Commission. Virginia Code 8.01-512.4 – Notice of Exemptions from Garnishment and Lien

If your federal benefits arrive by direct deposit, your bank must also review the account for federal benefit deposits made during the previous two months and leave a “protected amount” equal to those deposits (or the balance, whichever is less) accessible without any paperwork on your part.8eCFR. 31 CFR Part 212 – Garnishment of Accounts Containing Federal Benefit Payments That happens automatically. The DC-454 is how you protect exempt funds the bank missed, older deposits, or amounts the bank calculated incorrectly.

Poor Debtor’s Exemption

Separate from the homestead exemption, the poor debtor’s exemption protects up to $5,000 in household furnishings (beds, appliances, cookware, and the like) and up to $1,000 in clothing without any recorded deed.9Virginia Code Commission. Virginia Code 34-26 – Poor Debtor’s Exemption; Exempt Articles Enumerated

Wage Garnishment Limits

For an ordinary debt, nothing can be garnished from a paycheck when weekly disposable earnings are $290 or less. Above that, the creditor takes the smaller of 25 percent of disposable earnings or the amount exceeding $290.10Virginia Code Commission. Virginia Administrative Code 16VAC15-21-30 – Calculation of Maximum Garnishment Amounts for an Ordinary Debt Employers usually apply these limits automatically. If yours didn’t, the exemption claim form is how you fix it.

When Exemptions Don’t Apply

Some debts pierce these protections, and it’s worth checking the reason for the garnishment before you build your claim around an exemption that won’t hold.

The homestead exemption cannot be claimed against debts for spousal or child support.11Virginia Code Commission. Virginia Code 34-5 – To What Debts Exemptions Shall Not Apply Federal benefits that are otherwise shielded — Social Security, veterans’ benefits, unemployment, federal retirement — can be reached by child support and alimony orders under federal law.12Office of the Law Revision Counsel. 42 USC 659 – Consent by United States to Income Withholding, Garnishment, and Similar Proceedings for Enforcement of Child Support and Alimony Obligations

IRS levies run on a separate track. The wage amount exempt from an IRS levy depends on your filing status, pay frequency, and dependents, and the IRS publishes the numbers each year in Publication 1494.13Internal Revenue Service. Publication 1494 – Tables for Figuring Amount Exempt from Levy on Wages, Salary, and Other Income Virginia’s homestead and wage-garnishment formulas don’t apply.

Filing the Form and the Hearing

Deliver or mail the completed DC-454 to the clerk of the general district court that issued the summons.7Virginia Code Commission. Virginia Code 8.01-512.4 – Notice of Exemptions from Garnishment and Lien You do not need to serve the creditor. The clerk notifies all parties of the hearing date, time, and location, along with the exemption you claimed.14Virginia Code Commission. Virginia Code 8.01-512.5 – Hearing on Claim of Exemption from Garnishment

You are entitled to a hearing no later than seven business days after filing.14Virginia Code Commission. Virginia Code 8.01-512.5 – Hearing on Claim of Exemption from Garnishment Bring everything: bank statements showing the source of deposits, benefit award letters, pay stubs, proof of dependents, and any document that links the frozen money to a protected source. The judge decides whether the garnished money qualifies for the exemptions you checked.

Until the court orders otherwise, the garnishment stays in effect while your claim is pending, and the employer or bank must keep complying with the summons until a written court order changes things.14Virginia Code Commission. Virginia Code 8.01-512.5 – Hearing on Claim of Exemption from Garnishment That’s why speed matters. Every day between the freeze and the hearing is a day you can’t touch the money. Missing the hearing risks losing both the exemption and the funds.

Recording a Homestead Deed

If your exemption claim rests on the homestead exemption for cash or personal property, a recorded homestead deed strengthens your position. The deed is a signed document that lists and describes each item you claim as exempt, assigns a value to each, and declares the exemption under Virginia law.6Virginia Code Commission. Virginia Code 34-14 – How Set Apart in Personal Estate; Form to Claim Exemption Virginia provides a statutory form with spaces for your name, address, dependents, property description and values, and any prior homestead deeds you have filed.

Record the deed in the deed book of the circuit court for the city or county where you live.15Virginia Code Commission. Virginia Code 17.1-227 – Documents to Be Recorded in Deed Books Recording fees vary by jurisdiction. Recording before any garnishment is best, but the statute allows you to set apart exempt property at any time before it is subjected to sale under creditor process. A properly recorded deed removes ambiguity about which assets you’re claiming and makes the exemption hearing more straightforward.

The poor debtor’s exemption for household furnishings and clothing does not require a homestead deed; that protection applies automatically.9Virginia Code Commission. Virginia Code 34-26 – Poor Debtor’s Exemption; Exempt Articles Enumerated For the broader homestead amounts covering cash, personal property, and your residence, the recorded deed is the mechanism that locks the protection in.
