If you live in another state but earned money in Rhode Island, you file a Rhode Island nonresident tax return on Form RI-1040NR, due April 15, 2026 for the 2025 tax year. You owe Rhode Island tax only on the income tied to the state, and your home state will generally credit you for what you pay here. Rhode Island has no reciprocity with Massachusetts, Connecticut, or New York, so commuters cannot skip the filing just because they live across the line.
Do You Actually Have to File
You have to file if you had any Rhode Island source income during the year and you were also required to file a federal return.1Rhode Island Division of Taxation. Individual Tax Filing Requirements – Section: Who Must File a Return – Nonresident Individual There is no dollar floor beyond that: a single day of wages earned in the state can be enough to trigger the return.
You are a nonresident if Rhode Island is not your domicile and you did not maintain a permanent place of abode in the state while spending more than 183 days there.2Rhode Island General Assembly. Rhode Island Code 44-30-5 – Resident and Nonresident Defined Residents owe tax on all their income from every source; nonresidents owe only on income connected to Rhode Island. Using the wrong form means paying the wrong amount.
What Rhode Island Can Tax
Rhode Island source income covers earnings tied to the state’s economy:
- Wages and compensation for work physically performed in Rhode Island, whether as an employee, independent contractor, or self-employed person.
- Rental income from Rhode Island property and gains from selling Rhode Island real estate or tangible personal property located there.
- Profits from a trade, profession, or business carried on in the state, including your share of partnership or LLC income attributable to Rhode Island operations.
- Winnings from the Rhode Island state lottery and from pari-mutuel betting at licensed venues in the state.3Rhode Island General Assembly. Rhode Island Code 44-30-32 – Rhode Island Income of a Nonresident Individual
Dividends, interest, and other investment income from intangible property generally are not Rhode Island source income unless the intangible property is used in a business you operate in the state.3Rhode Island General Assembly. Rhode Island Code 44-30-32 – Rhode Island Income of a Nonresident Individual A Connecticut resident with a brokerage account owes nothing to Rhode Island on dividends, even if a Rhode Island employer pays their salary. Military pay earned by someone not domiciled in Rhode Island is also excluded.
If your business operates in multiple states, you have to apportion the income under rules set by the tax administrator. Keep a workday log for every day you performed services inside Rhode Island. That record is the first thing the Division of Taxation will ask for if your allocation is ever questioned.
How the Tax Is Calculated
Rhode Island uses three brackets that apply to all filers. For tax year 2026 the inflation-adjusted brackets are:4Rhode Island Division of Taxation. Inflation-Adjusted Amounts Set for Tax Year 2026
- $0 to $82,050: 3.75%
- $82,050 to $186,450: $3,076.88 plus 4.75% of the amount over $82,050
- Over $186,450: $8,035.88 plus 5.99% of the amount over $186,450
Here is the part that trips people up. You calculate the tax on your entire federal adjusted gross income first, as if all of it were Rhode Island income. Then you multiply that tax by the Rhode Island percentage, which is your Rhode Island source income divided by your total federal AGI. The result is what you actually owe the state.5Rhode Island Division of Taxation. 2025 Rhode Island Nonresident Individual Income Tax Return Instructions
Example: your total federal AGI is $100,000 and $40,000 of it came from Rhode Island sources. Your Rhode Island percentage is 40%. You compute the tax on the full $100,000 using the bracket table, then pay 40% of that figure to Rhode Island.

Before you start, finish your federal return (you need the AGI), and pull together every W-2 showing Rhode Island withholding, 1099s for Rhode Island source income, and your workday records. The form and current instructions are on the Division of Taxation website.6Rhode Island Division of Taxation. Personal Income Tax Forms
You enter identifying information and your federal filing status, calculate your Rhode Island source income, compute the Rhode Island percentage, and apply it to the tax on your full income. From that figure you subtract Rhode Island withholding and any credits to arrive at a balance due or a refund. If you were a nonresident member of a partnership or LLC, pass-through withholding remitted on your behalf counts as a credit against your liability.7Legal Information Institute. 280 Rhode Island Code R. 280-RICR-20-25-7.7 – Filing Requirements for Members
E-filing through a state-approved vendor is the fastest route and gives you confirmation of receipt. You can also pay online through the Division’s portal by credit card or electronic bank transfer.
If you need more time, file Form RI-4868 for an automatic six-month extension to file.8Rhode Island Division of Taxation. Application for Automatic Extension of Time To File a Rhode Island Individual Income Tax Return The extension does not extend time to pay. Estimate your liability and send any balance by April 15 to stop interest and penalties from running. If you do not owe anything, you do not need to file the extension form at all.
Keeping Rhode Island Income From Being Taxed Twice
Rhode Island does not have a reciprocal agreement with any neighboring state. You will file the RI-1040NR and pay Rhode Island on your Rhode Island source income regardless of where you live.
Relief comes on your home state return. Almost every state with an income tax lets residents claim a credit for tax paid to another state on the same income. If you live in Massachusetts and paid Rhode Island on wages earned in Providence, you claim that Rhode Island tax as a credit on your Massachusetts return. The credit generally cannot exceed what your home state would have charged on the same income, so it reduces or eliminates the double hit without producing a refund of the difference. File the Rhode Island return first; you need the Rhode Island tax figure to complete the credit calculation at home.
If You File Late, Pay Late, or Underpay
Rhode Island charges separate penalties for failing to file and failing to pay, and they stack:
- Failure to file: 5% of the unpaid tax for each month the return is late, capped at 25%.
- Failure to pay: 0.5% of the unpaid tax for each month the payment is late, capped at 25%.
- Negligence: an additional 5% of any deficiency caused by negligent or intentional disregard of the rules.
- Fraud: 50% of the deficiency attributable to fraud, which replaces the failure-to-file and negligence penalties.
Interest accrues on top of the penalties. For calendar year 2026, the delinquent interest rate on personal income tax is 12% per year.9Rhode Island Division of Taxation. Annual Interest Rates Update Because the failure-to-file penalty dwarfs the failure-to-pay penalty, filing on time and paying what you can is always better than holding the return back because you cannot cover the full balance.
If your Rhode Island liability is expected to exceed your withholding and credits by $250 or more, you also owe quarterly estimated payments.10Rhode Island Division of Taxation. 2026 Rhode Island Resident and Nonresident Estimated Payment Coupons This often catches nonresidents with Rhode Island rental, business, or partnership income that is not subject to employer withholding. The 2026 due dates are April 15, 2026; June 15, 2026; September 15, 2026; and January 15, 2027. Underpaid installments carry interest of 12% per year for tax year 2025 returns, calculated by the days each installment ran short.11Rhode Island Division of Taxation. Underpayment of Estimated Tax by Individuals, Estates You can avoid the underpayment interest by paying in at least 80% of the tax shown on your current-year return.
Fixing a Return Later
If you find an error, amend your federal return, or receive an IRS adjustment, file Form RI-1040X to correct your Rhode Island return. For refunds you generally have three years from the original filing date or two years from the date you paid, whichever is later. If the IRS finalizes an audit that changes your taxable income, you have 90 days from that final determination to file the Rhode Island amendment. Complete the federal amendment first and work from the corrected numbers. Mail the signed form, with any additional payment, to the Rhode Island Division of Taxation, One Capitol Hill, Providence, RI 02908.
Keep copies of the filed RI-1040NR, every W-2 and 1099 reporting Rhode Island income, your workday logs, and any supporting schedules for at least three years from the filing date.12Legal Information Institute. 280 Rhode Island Code R. 280-RICR-20-55-4.10 – Record Retention Requirements Workday records are what will carry you through any question about how you divided income between Rhode Island and home.
