Watch for the First Check
Once your disability lasts at least eight days and is immediate and continuous, the carrier has 14 calendar days after the employer receives notice of the injury to either pay the first installment of disability benefits or deny the claim.4The Florida Legislature. Know What Your Wage Replacement Should Be
Your benefit rate is built on your average weekly wage, calculated from your gross earnings during the 13 weeks before the accident. Attorney fees on workers’ comp cases are capped by statute on a sliding scale tied to benefits recovered: 20 percent of the first $5,000, 15 percent of the next $5,000, 10 percent of the remainder secured during the first 10 years, and 5 percent of benefits secured after that.11The Florida Legislature. Don’t Miss the Two-Year Filing Deadline
Behind the 30-day reporting rule sits a two-year statute of limitations. You have two years from the date you knew or should have known the injury was work-related to file a petition for benefits.12The Florida Legislature. That tolling does not apply to disputes about compensability, the date of maximum medical improvement, or your permanent impairment rating, so even a worker who is actively being treated can lose the ability to fight over impairment if the two years slip by.
Two Traps That Sink Otherwise Valid Claims
The first is post-accident drug testing. A lump-sum settlement pays you a single amount in exchange for closing some or all of your benefits. The upside is immediate cash and finality. Keeping benefits open preserves medical care and partial wages for as long as you continue to qualify.
