How to File an HPD Violation Dismissal Request

To file an HPD violation dismissal request in New York City, complete the DR-1 form, attach the required supporting documents for any special violation types, include a certified check or money order for the correct fee ($250 to $1,000 depending on the building), and submit the package to the HPD Code Enforcement Borough Office for the borough where your building sits. HPD will then send an inspector to confirm the repairs before removing the violations from the record.

The process exists for owners who fixed the underlying conditions but missed the deadline to file a certification of correction, leaving violations stuck as “open” in HPD’s system.

When a Dismissal Request Is the Right Filing

The standard way to close an HPD violation is a certification of correction under Section 27-2115(f) of the NYC Administrative Code, filed within 14 days after the correction deadline for Class A and B violations, or 5 days for Class C.1American Legal Publishing. A dismissal request is what you file when that window has closed. It applies when the repair was physically completed but the certification paperwork was never submitted in time, or when an earlier certification was rejected for a technical defect or late filing. The violation still shows as open even though the condition is gone.

One boundary matters before you spend the fee: every defect on the original violation notice must actually be corrected. HPD will inspect. If the conditions are not fully remediated, the violations stay open and you lose your filing fee.

Check Your Open Violations First

Before filling out anything, look up your building on HPDOnline at hpdonline.nyc.gov. You can search by address, Borough-Block-Lot number, building identification number, or property registration number, and the system lists every open complaint and violation on the property.2NYC HPDOnline. Complete the DR-1 Form

The dismissal request form is officially the DR-1 (OHO/DCE Form). If you own a one- or two-family home that isn’t required to register because you live in it, or you’re a condo or co-op owner filing only for violations inside your own unit, you also complete the Dismissal Request Affidavit of Ownership included in the DR-1 packet.

Supporting Documents by Violation Type

Some violation orders require documentation beyond the form itself:

  • Orders 491, 494, 495, or 741 (illegal alterations): Department of Buildings-approved plans and permits if you legalized the alteration. If you removed the alteration and restored the space to its legal condition, no extra documents are needed.
  • Order 550 (mold), Class B or C issued after March 1, 2018: an Affidavit of Mold Assessment and Remediation. Additional documents may be required depending on who performed the work, as noted on the affidavit.
  • Order 780 (failure to register): file a current property registration form with HPD, which carries a $13 fee payable to the Department of Finance.

Fees and Payment

  • Private dwelling (1–2 units): $250
  • Multiple dwelling (3+ units) with 1–300 open violations: $300
  • Multiple dwelling with 301–500 open violations: $400
  • Multiple dwelling with 501 or more open violations: $500
  • Multiple dwelling active in the Alternative Enforcement Program: $1,000

Pay by certified check or money order made payable to the NYC Department of Finance. Write your property registration number on the check. Personal checks, cash, and credit cards are not accepted. Wrong amount or missing payment gets the whole package returned.

Use a mail service with tracking. If you hand-deliver, get a receipt. AEP filings go to a different address (see below).

Why HPD Rejects Filings

  • The building lacks a current or valid property registration.
  • There are unpaid emergency repair charges for work HPD performed on the building.
  • The owner, managing agent, or building is involved in pending HPD-related litigation.
  • The signature is missing, the fee is wrong, or violation numbers are incomplete.

Fix any registration or emergency repair charge problems before filing, and check every violation number against the original notices.

What Happens After You File

Once HPD accepts your package, an inspector will visit to confirm that every listed violation has been physically corrected. HPD states it will use best efforts to inspect within 45 business days for requests submitted between June 1 and September 30, and within 90 business days for requests submitted between October 1 and May 31. HPD makes a maximum of two inspection attempts. If access to the building or specific units isn’t provided both times, those violations will not be dismissed and remain open. You’ll get a report showing which violations were cleared and which stayed on the record. To try again on the ones that stayed, you fix any remaining problems and file a new dismissal request with a new fee.

Buildings in the Alternative Enforcement Program

Record Production Order Violations Use a Different Form

If the violations you want cleared are Record Production Orders — specifically orders 618, 619, and 620 — the DR-1 is not the right form. RPO violations relate to recordkeeping requirements rather than physical building conditions, and they use the RPO DR-1 form. No fee is required if you provide 10 consecutive years of adequate records including the current calendar year. If you can provide at least three consecutive years (including the current year) but not the full 10, HPD will notify you that $1,000 per missing year is owed. Do not send any payment with the initial RPO filing; wait for HPD’s instructions.
