Step 1: Pass the Means Test

Start by averaging your income over the six full calendar months before your filing date. Compare that average to the California median for your household size. For cases filed on or after April 1, 2026:

If you’re above the median, the test continues. You subtract allowable expenses using IRS National and Local Standards, along with secured debt payments and priority obligations like child support, to arrive at monthly disposable income. If that number multiplied by 60 hits certain statutory thresholds, the court presumes abuse and pushes you toward Chapter 13. One exception matters if it fits you: disabled veterans whose debts were incurred primarily on active duty or during homeland defense activity are exempt from the means test entirely.
Step 2: Choose a California Exemption System
California is unusual in giving filers two separate menus of property exemptions. You pick one. You cannot combine protections from both, and married couples filing jointly must choose the same set. The right choice usually comes down to whether you own a home with real equity.
CCP 704: Better for Homeowners
The exemptions in California Code of Civil Procedure § 704 revolve around a generous homestead. The protected amount is the greater of the countywide median sale price for a single-family home in the prior calendar year or a statutory floor, with both figures adjusted annually for inflation using the California CPI.5California Legislative Information. System 1 also protects vehicles, tools of the trade, and retirement accounts within specific limits, but it has no general wildcard.
CCP 703: Better for Renters and Non-Homeowners
The alternative under CCP § 703.140 caps the homestead at just $36,750, which makes it a bad fit if you have real home equity to protect. Its advantage is a wildcard: $1,950 that can be applied to any property, plus any unused portion of the $36,750 homestead. If you don’t own a home, that’s up to $38,700 in flexible protection you can spread across bank accounts, a car, a tax refund, or anything else.6California Courts. Without home equity to shield, the wildcard almost always protects more total property than the category-specific list under System 1.
Step 3: Complete Pre-Filing Credit Counseling
Every individual filer must finish a credit counseling session with an approved nonprofit agency within 180 days before filing. Skip it and the court will dismiss your case.7United States Department of Justice. Credit Counseling and Debtor Education Information The session covers a budget analysis and alternatives to bankruptcy, usually runs about an hour, and is available online or by phone from most providers. You’ll receive a certificate of completion to file with your petition. Narrow exceptions apply for people with disabilities who cannot participate and for those on active military duty in a combat zone.
Step 4: Gather Documents and Complete the Forms
Bankruptcy courts want a complete financial picture, and incomplete paperwork is one of the fastest paths to dismissal.
Pull together pay stubs and any other income proof, a full list of creditors with amounts owed and their mailing addresses, records of everything you own with approximate values, and your monthly expenses. You must give the trustee a copy of your most recent federal tax return at least seven days before the 341 meeting.8Office of the Law Revision Counsel. 11 U.S. Code 521 – Debtors Duties The trustee or another party can also request returns going back three years, so make sure any missing filings are caught up before you file.
The petition package uses standardized federal forms: the Voluntary Petition (Form 101), the Summary of Assets and Liabilities, and schedules covering property, claimed exemptions, secured and unsecured creditors, income, and expenses.9United States Courts. The trustee and creditors will read every line, and inconsistencies between your schedules and reality can trigger fraud allegations.
Step 5: File the Petition and Trigger the Automatic Stay
You file in the U.S. Bankruptcy Court for the federal district covering where you live. California has four:
- Central District (Los Angeles and surrounding counties)
- Eastern District (Sacramento and the Central Valley)
- Northern District (San Francisco and the Bay Area)
- Southern District (San Diego and Imperial County)

The instant your petition is docketed, the automatic stay takes effect. Creditors have to stop calling, filing lawsuits, garnishing wages, repossessing vehicles, and foreclosing. Step 6: Attend the 341 Meeting and Finish Debtor Education
Somewhere between 21 and 40 days after filing, you’ll attend the meeting of creditors, named for § 341 of the Bankruptcy Code.12United States Bankruptcy Court. What Is a 341(a) Meeting of Creditors Creditors rarely appear. The trustee runs it, not a judge, and it typically lasts about ten minutes. You’ll be placed under oath and asked whether your schedules are accurate, whether you listed everything, and whether you understand what you’re giving up. Bring a government photo ID and proof of your Social Security number.
After the meeting, complete the second required course: debtor education on personal financial management, taken from a different approved provider list than the pre-filing session.13United States Courts. What the Trustee Can Take
The trustee’s job is to find any non-exempt property, sell it, and pay creditors from the proceeds. In practice, most individual Chapter 7 cases in California are no-asset cases: the trustee decides everything is either exempt or not worth liquidating and files a report of no distribution.14United States Courts. Asset cases do happen when someone owns non-exempt property like a second vehicle, valuable collections, non-retirement investment accounts, or home equity exceeding the homestead. This is where your exemption choice from Step 2 matters most: the difference between $38,700 of wildcard flexibility and no wildcard at all can decide whether a bank account gets swept.
Reaffirmation for Secured Debt
Chapter 7 wipes out your personal liability on a debt, but it doesn’t erase a lien. To keep a financed car on the existing loan terms, you generally need to sign a reaffirmation agreement, which makes you personally liable again as if you never filed.15Office of the Law Revision Counsel. 11 U.S. Code 524 – Effect of Discharge It’s voluntary; nobody can force you to reaffirm, but lenders usually require it. The agreement has to be signed before discharge. If you have an attorney, they must certify no undue hardship and that you were fully advised. Without an attorney, the court holds a hearing and approves the agreement directly. Either way, you have 60 days after filing the agreement to rescind.
Reaffirm carefully. Fall behind later and the lender can repossess and pursue you for any deficiency, exactly as if bankruptcy had never happened.
Debts That Survive Bankruptcy

- Domestic support: child support and alimony are fully non-dischargeable.
- Most taxes: recent income taxes, and taxes tied to a fraudulent return or evasion, survive. Older tax debts can sometimes be discharged under specific conditions.
- Student loans: not automatically discharged. You have to file a separate adversary proceeding and prove undue hardship, which requires showing you cannot maintain a minimal standard of living, that your situation is likely to persist, and that you made reasonable repayment efforts.
- Debts from fraud: money, goods, or credit obtained through misrepresentation survives. - Drunk driving injuries: debts from death or personal injury caused by intoxicated driving cannot be discharged.
- Government fines and penalties: criminal fines, restitution, and most government penalties survive.
- Willful injury: debts for deliberate harm to a person or their property are non-dischargeable.
- Unlisted debts: if you leave a creditor off your schedules and they didn’t otherwise learn of the case in time to participate, their debt may survive.
If most of what you owe falls into these categories, Chapter 7 may not deliver meaningful relief and it’s worth weighing your options before spending the filing fee.
Timeline and the Eight-Year Bar
Assuming both courses are done and no one objects, the court enters your discharge roughly 60 days after the first date set for the 341 meeting.1United States Bankruptcy Court – Central District of California. The discharge permanently bars creditors from trying to collect any debt that was eliminated.18United States Courts. Federal law also limits repeat filings. You cannot receive another Chapter 7 discharge if you got one in a case filed within the preceding eight years.19Office of the Law Revision Counsel. 11 U.S. Code 727 – Discharge The clock runs filing date to filing date, so the practical wait, measured from when your first case actually closed, is slightly longer than eight years.
