To file Chapter 7 bankruptcy in Oklahoma, you start with a means test against state median income, take a required credit counseling course within 180 days before filing, prepare your petition and schedules using Oklahoma’s state exemptions, file in one of the three federal bankruptcy districts with a $338 fee, attend a meeting of creditors about three to six weeks later, complete a debtor education course, and receive your discharge roughly 60 days after that meeting. The whole process usually runs four to six months.
Confirm You Qualify
Eligibility turns on the means test. Add up your gross income for the six full calendar months before filing, divide by six, multiply by twelve, and compare the result to Oklahoma’s median for your household size. For cases filed between November 2025 and March 2026, the thresholds are $59,611 for one person, $75,229 for two, $84,618 for three, and $99,188 for four.1U.S. Trustee Program. Census Bureau Median Family Income By Family Size If you’re at or below the median, you pass and move on.
Over the median, the test continues. You subtract IRS-allowed living expenses along with actual secured debt payments and child support to find your “disposable income.” If that number is low enough that a Chapter 13 plan couldn’t meaningfully repay unsecured creditors, you still qualify. If it’s too high, the court will presume the filing is abusive and Chapter 13 may be your only route.
Two other gates: you cannot receive a Chapter 7 discharge if you got one in a case filed within the previous eight years,2Office of the Law Revision Counsel. 11 U.S. Code 727 – Discharge and you must complete pre-filing credit counseling.3Office of the Law Revision Counsel. 11 U.S. Code 109 – Who May Be a Debtor
Take the Credit Counseling Course
The pre-filing briefing has to come from a U.S. Trustee-approved agency and must happen within the 180 days before you file your petition.4United States Department of Justice. Credit Counseling and Debtor Education Information It reviews your budget and the alternatives to bankruptcy, and you get a certificate to file with your case. Skip it and the court can dismiss your petition.
Apply Oklahoma’s Exemptions Before You File
Oklahoma has opted out of the federal bankruptcy exemptions, so you use the state list to decide what property you can keep.5Justia Law. Oklahoma Statutes Title 31, Section 31-1 – Property Exempt From Attachment Anything not covered becomes part of the bankruptcy estate, and the trustee can sell it to pay creditors. Most Oklahoma Chapter 7 cases are “no-asset” filings where everything fits inside the exemptions, but confirm that before you file. There is no wildcard exemption, so you cannot shelter a stray valuable item under a general dollar amount.
Homestead
Your primary residence is protected with no cap on dollar value, provided the property doesn’t exceed one acre inside a city or town or 160 acres in a rural area.6Oklahoma Senate. Oklahoma Constitution Article XII – Homestead and Exemptions If more than 25 percent of the home’s square footage is used for business, the exemption drops to $5,000.
Personal Property
The main categories and caps:5Justia Law. Oklahoma Statutes Title 31, Section 31-1 – Property Exempt From Attachment
- Motor vehicle: up to $7,500 in equity in one vehicle.
- Household furniture and electronics, including personal computers for family use: fully exempt.
- Tools of the trade: up to $10,000.
- Clothing: up to $4,000.
- Wedding and anniversary rings: up to $3,000.
- Firearms kept for household use: up to $2,000.
- Professionally prescribed health aids: fully exempt.
- Retirement accounts, including 401(k)s, IRAs, Roth IRAs, and pensions: fully exempt.
If you own something that falls outside these categories or exceeds a cap, talk to a bankruptcy attorney about whether it’s at risk. Attorney fees for a straightforward Oklahoma Chapter 7 case generally run $1,000 to $3,500 depending on complexity.
Gather Your Documents
Every number on your petition should trace back to a document. Pull together:
- Pay stubs for the last six months, self-employment records, and your most recent two years of federal tax returns.
- A complete creditor list with account numbers, balances, and whether each debt is secured or unsecured.
- Real estate deeds, vehicle titles, bank and investment statements, and realistic values for significant personal property.
- A current picture of monthly expenses: rent or mortgage, utilities, insurance, food, transportation, and childcare.
One deadline catches filers off guard. You must give the trustee your most recent federal tax return or transcript at least seven days before the 341 meeting. If a required return isn’t filed yet, take care of it before you file the petition.
The official forms, including the petition, schedules of assets and liabilities, statement of financial affairs, and means test forms, are available on the U.S. Courts website.
File in the Right District and Pay the Fee
Oklahoma has three federal bankruptcy districts, and you file in the one where you’ve lived for the greater part of the last six months.7United States Bankruptcy Court. Oklahoma Counties by District – Where Do I File The Western District sits in Oklahoma City, the Northern District in Tulsa, and the Eastern District in Muskogee. The court’s website lists which district each county belongs to.
The filing fee is $338: a $245 case fee, a $78 administrative fee, and a $15 trustee surcharge. If you can’t pay the full amount up front, you can ask to pay in installments. A full waiver is available if your income is below 150 percent of the federal poverty guidelines and you can’t afford installments either. The waiver request is Official Form 103B. You can submit the petition in person at the clerk’s office, by mail, or electronically.
What Filing Does Immediately
The moment the petition is accepted, the automatic stay takes effect. It is a court order that stops most collection activity: calls, letters, wage garnishments, foreclosures, repossessions, and most lawsuits.8Office of the Law Revision Counsel. 11 U.S. Code 362 – Automatic Stay Creditors who violate it can be sanctioned. Criminal cases, domestic support enforcement, and certain family law matters continue despite the stay.
Attend the 341 Meeting of Creditors
Three to six weeks after filing, the U.S. Trustee schedules a meeting of creditors, usually called the 341 meeting.9Office of the Law Revision Counsel. 11 U.S. Code 341 – Meetings of Creditors and Equity Security Holders Creditors rarely attend. The bankruptcy trustee runs it, places you under oath, and asks questions about your income, assets, debts, and the information in your petition.10United States Department of Justice. Section 341 Meeting of Creditors
Bring government-issued photo ID and proof of your Social Security number. For straightforward cases the meeting lasts around ten minutes. If the trustee finds a problem — say your vehicle equity exceeds the $7,500 cap — expect follow-up. That is why the exemption work before filing matters so much.
Decide on Reaffirmation If You Want to Keep Secured Property
To keep property that secures a debt, such as a financed car, you may need to sign a reaffirmation agreement. Reaffirming means you stay personally liable for that debt even though your other debts are being discharged, and the lender lets you keep the collateral and keep paying.11Legal Information Institute. Federal Rule of Bankruptcy Procedure 4008 – Reaffirmation Agreement
The agreement must be filed with the court within 60 days after the first date set for the 341 meeting, though the court can extend that. It includes an income-and-expense statement showing you can afford the payments. If the numbers don’t support affordability, a presumption of undue hardship arises and the court may hold a hearing.
You can change your mind. Federal law lets you rescind a reaffirmation any time before discharge, or within 60 days after it is filed with the court, whichever is later.12Office of the Law Revision Counsel. 11 U.S. Code 524 – Effect of Discharge You rescind by notifying the creditor in writing.
Finish Debtor Education and Receive Your Discharge
After filing, you must complete a debtor education course, sometimes called a personal financial management course, from a U.S. Trustee-approved provider.4United States Department of Justice. Credit Counseling and Debtor Education Information This is separate from the pre-filing credit counseling. The provider issues a certificate that you file with the court. Without it, no discharge.
The discharge order usually arrives about 60 days after the 341 meeting, assuming no objections and your education certificate is on file.2Office of the Law Revision Counsel. 11 U.S. Code 727 – Discharge The order wipes out your personal liability for covered debts that existed on the filing date, and creditors are permanently barred from collecting on them.
Know Which Debts Won’t Go Away
Federal law carves out categories of debt that survive a Chapter 7 discharge:13Office of the Law Revision Counsel. 11 U.S. Code 523 – Exceptions to Discharge
- Child support and alimony.
- Most recent income tax debt, taxes where no return was filed, and taxes involving fraud. Older income tax may be dischargeable if the return was due more than three years before filing, any late return was filed at least two years before filing, and the assessment is more than 240 days old.
- Student loans, unless you prove undue hardship in a separate adversary proceeding within the case.
- Debts obtained through fraud or false financial statements.
- Debts from willful injury to another person or their property.
- Criminal restitution and most government fines and penalties.
- Debts you failed to list, if the creditor didn’t learn about the case in time.
- Luxury charges over $500 within 90 days of filing and cash advances over $750 within 70 days, which are presumed nondischargeable.
What to Expect on Credit and Refiling
A Chapter 7 bankruptcy can appear on your credit report for up to ten years from the date the order for relief is entered,14Office of the Law Revision Counsel. 15 U.S. Code 1681c – Requirements Relating to Information Contained in Consumer Reports and an accurate record can’t be removed early. The practical impact tends to fade sooner. Many filers see score improvements within a year or two as discharged balances drop to zero and they rebuild with secured cards or small installment loans.
If you ever need to file again, you cannot receive another Chapter 7 discharge until eight years after the filing date of the prior case.2Office of the Law Revision Counsel. 11 U.S. Code 727 – Discharge Chapter 13 remains available sooner, but the Chapter 7 door is closed for that full window.
