To file Chapter 7 bankruptcy in Virginia, you first pass a federal income test, complete a pre-filing credit counseling course, then submit a petition and schedules to the U.S. Bankruptcy Court for the Eastern or Western District of Virginia along with a $338 filing fee. A court-appointed trustee reviews your case at a Meeting of Creditors about a month after filing, and if everything checks out and you finish a second required course, your discharge order arrives roughly four to six months from the day you file. Virginia uses its own property exemptions rather than the federal list, so the details of what you keep depend on state law.
Do You Qualify to File
The Means Test
Chapter 7 is only available if your income is low enough. The means test compares your household’s average gross income over the six months before filing to Virginia’s median income for the same household size. For cases filed between November 1, 2025, and March 31, 2026, those medians are $76,479 for one earner, $98,577 for two people, $120,001 for three, and $141,113 for four, plus $11,100 for each additional person.1U.S. Department of Justice. Below the median, you pass and can file. Above it, the test moves to a second phase that subtracts allowed expenses to compute your monthly disposable income; if that number is high enough to fund a repayment plan, the court will push you toward Chapter 13 instead.
Prior Bankruptcies and Other Bars
The court will deny your discharge if you already received a Chapter 7 discharge in a case filed within the previous eight years, or a Chapter 13 discharge in a case filed within the previous six years.2Office of the Law Revision Counsel. 11 USC 727 – Discharge You also cannot file if a prior case was dismissed in the last 180 days because you violated a court order or voluntarily dismissed to dodge creditor action.
Credit Counseling
Every individual filer must finish a credit counseling course from a provider approved by the U.S. Trustee’s office within 180 days before filing.3United States Bankruptcy Court. Notice to All Debtors About Prepetition Credit Counseling Requirement The completion certificate goes in with your petition. Skip it and your case gets dismissed.
What You Can Keep: Virginia Exemptions
Chapter 7 is technically a liquidation: the trustee can sell non-exempt property to pay creditors. In practice, most Virginia cases are “no-asset” cases because exemptions cover everything the filer owns. Virginia opted out of the federal exemption system, so you must use Virginia’s own list.
The homestead exemption under Code § 34-4 protects up to $5,000 in personal property of your choosing (or $10,000 if you are 65 or older), plus up to $50,000 in equity in your principal residence. If you support dependents, add $500 per dependent. Veterans with a VA-rated service-connected disability of 40% or more get an additional $10,000 on top of the standard homestead amount.4Virginia Code Commission. Beyond the homestead, Code § 34-26 exempts specific categories of personal property, including up to $10,000 in a motor vehicle not used for work, up to $10,000 in tools, instruments, or vehicles necessary for your occupation, and household furniture, appliances, and clothing.5Virginia Code Commission. Retirement funds are protected to the same extent as under federal bankruptcy law. That covers 401(k)s, 403(b)s, and similar employer plans with no cap, and traditional and Roth IRAs up to a combined $1,711,975.6Virginia Code Commission. Documents to Gather Before You File
Pulling records together first saves time and prevents trustee objections. You need:
- Pay stubs for at least the last two months (six is better for the means test) and federal and state tax returns for the past two years.
- Statements, collection letters, lawsuit papers, and garnishment notices for every debt, with creditor names, account numbers, and balances.
- Real estate deeds, mortgage statements, vehicle titles, and bank, investment, and retirement account statements.
- A detailed breakdown of monthly living expenses: housing, utilities, food, transportation, insurance, and medical costs.
- Social Security award letters, pension statements, or disability payment documentation.
- Your pre-filing credit counseling certificate.
Self-employed filers also need profit and loss statements.
Filing the Petition
The Forms
The Chapter 7 forms are on the U.S. Courts website. You file the petition itself, schedules listing all assets and debts, a statement of financial affairs, a statement of your Social Security number, and the means test form (Official Form 122A). Accuracy matters. The trustee will check your schedules against your bank statements and tax returns, and omitting an asset or understating a value can cost you your discharge or lead to fraud charges. If you are unsure of a value, get an appraisal or use a defensible estimate and disclose your reasoning.
Where to File
File with the U.S. Bankruptcy Court for the Eastern District of Virginia or the Western District of Virginia, depending on where you live. The Filing Fee
The fee is $338, payable by money order, cashier’s check, or personal check. What Happens After You File
The Automatic Stay
The moment your petition is filed, a federal court order called the automatic stay stops most collection activity: lawsuits, wage garnishments, collector phone calls, bank levies, and foreclosure proceedings.9Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay Creditors who violate it can be held in contempt. The stay does not stop criminal proceedings, child support or alimony collection, or most tax audits. If you had a bankruptcy dismissed within the past year, the stay in a new case may last only 30 days without a court order extending it.
The 341 Meeting of Creditors
Roughly 20 to 40 days after filing, you attend a Meeting of Creditors run by a court-appointed trustee, not a judge. You testify under oath about your finances, your assets, and the accuracy of your petition.10United States Courts. Creditors have the right to attend but rarely do, and the meeting usually lasts five to ten minutes if your paperwork is clean. The Debtor Education Course
After filing (not before), you must complete a second, separate course on personal financial management from an approved provider. File the completion certificate with the court within 60 days after the first date set for your 341 meeting.12Legal Information Institute. Reaffirmation for Secured Debts
Chapter 7 wipes out your personal obligation on a debt but does not remove a lien. If you have a car loan, the lender still holds a security interest in the vehicle and can repossess it if you stop paying. To keep financed property, you may need to sign a reaffirmation agreement, which recommits you to pay that specific debt despite the bankruptcy. Reaffirmation agreements must be filed with the court before discharge and no later than 60 days after the first 341 meeting date. If you filed pro se, the court must hold a hearing and approve the agreement; if you had a lawyer, it takes effect on filing unless the court finds undue hardship.13United States Courts. Your Discharge and Debts That Survive
The discharge order typically arrives about 60 days after the 341 meeting, assuming your debtor education certificate is on file and no one objected.14United States Courts. Federal law carves out categories that do not go away:
- Child support and alimony survive in full.
- Most student loans stay unless you win a separate adversary proceeding showing undue hardship.
- Income taxes are generally non-dischargeable unless the return was due more than three years ago, was filed more than two years ago, and was assessed more than 240 days ago. Taxes from fraudulent returns or willful evasion never qualify.
- Debts from fraud, embezzlement, or willful and malicious injury to another person or property remain.
- Court-ordered restitution, criminal fines, and most government penalties remain.
- Credit charges over $900 to a single creditor for luxury goods within 90 days before filing are presumed non-dischargeable, as are cash advances over $1,250 within 70 days of filing. Debts you accidentally left off your schedules may also survive if the creditor did not learn about the bankruptcy in time to participate.
What It Costs Beyond the Filing Fee
The two required courses run roughly $10 to $50 each from approved providers. Attorney fees for a straightforward Chapter 7 in Virginia generally range from around $1,500 to several thousand dollars depending on complexity and location, and some attorneys offer flat fees and payment plans. Filing pro se is legal but risky: the schedules are detailed, exemption elections have real consequences, and a mistake can cost you property or your discharge. What Filing Does to Your Credit

Many filers see credit score improvements within a year or two because the discharge eliminates the debt load that was dragging their ratios down. You are eligible for an FHA mortgage as soon as two years after discharge, and conventional mortgages typically require a four-year waiting period. Secured credit cards and credit-builder loans are available almost immediately.
