How to File Chapter 7 in Florida Without an Attorney

You can file Chapter 7 in Florida without an attorney, and the courts call it filing “pro se.” The total court fee is $338, the process runs roughly four months from petition to discharge, and every step is one the court will hold you to the same standard as a licensed lawyer. Miss a deadline, leave a schedule incomplete, or claim the wrong exemption, and you can lose property you thought was safe or have your case dismissed. What follows is the full sequence, from the pre-filing course through discharge.

Confirm You Are Eligible to File

Complete Credit Counseling First

Federal law requires every individual filer to finish a credit counseling session before submitting a petition.1Office of the Law Revision Counsel. 11 USC 109 – Who May Be a Debtor The session has to come from a nonprofit approved by the U.S. Trustee’s office and reviews your finances to see whether an alternative to bankruptcy exists.2United States Trustee Program. Frequently Asked Questions – Credit Counseling Most people finish it online or by phone in under an hour, and fees run about $20 to $50.

You get a certificate at the end. It is valid for 180 days, so if you don’t file within that window, you’ll have to retake the course.3United States Bankruptcy Court. Notice to All Debtors About Prepetition Credit Counseling Requirement Some courts have held that finishing counseling on the same day you file doesn’t satisfy the rule, so complete it at least a day before. The certificate goes in with your initial paperwork.

Pass the Means Test

The means test decides whether your income is low enough for Chapter 7. Average your gross income over the six full calendar months before filing and compare it to the median for your household size in Florida. The U.S. Trustee updates the medians periodically. For cases filed between November 1, 2025, and March 31, 2026, the Florida figures are:4United States Department of Justice. Median Family Income Table – November 2025

  • One earner: $68,085
  • Household of two: $84,305
  • Household of three: $95,039
  • Household of four: $111,819
  • Each additional person: add $11,100

Below the median, you pass and can proceed. Above the median, you aren’t automatically disqualified, but you have to run a longer calculation on Official Form 122A-2 that deducts allowable expenses. If disposable income after that calculation is still high enough to repay a meaningful part of your debts, the court can presume filing Chapter 7 is abusive and push you toward Chapter 13. This second stage is where most pro se filers stumble; if your income is above the median, at least pay for an attorney consultation before going further.

Meet the Florida Residency Requirement for Exemptions

Florida has opted out of the federal exemption scheme, so you’ll use Florida’s own exemptions. To claim them, you must have lived in the state for at least 730 consecutive days before your filing date.5Office of the Law Revision Counsel. 11 USC 522 – Exemptions

Know What You Can Keep Under Florida Exemptions

A court-appointed trustee can sell your non-exempt property to pay creditors. Exemptions keep specific assets off the table, and claiming them correctly is one of the two or three most consequential things pro se filers do.

Homestead

Florida’s homestead protection is among the most generous in the country. It can shield the full equity in your primary residence with no dollar cap, as long as the property doesn’t exceed half an acre inside a city or 160 acres in an unincorporated area.6FindLaw. Florida Constitution Art X Section 4 One catch: if you acquired the property within 1,215 days (roughly three years and four months) before filing, federal law caps the exemption at $214,000.5Office of the Law Revision Counsel. 11 USC 522 – Exemptions Equity rolled over from an earlier Florida home you owned before that window also counts toward the unlimited amount.

Vehicle, Personal Property, and Wildcard

You can exempt up to $5,000 in equity in a single motor vehicle.7FindLaw. Florida Statutes 222.25 If you owe more on the car than it’s worth, there’s no equity for the trustee and the exemption becomes moot for that asset. Florida also gives you a $1,000 personal property exemption covering furniture, electronics, clothing, and similar items. If you don’t claim the homestead exemption, that personal property exemption grows to $4,000, which you can apply to any property you choose.8Online Sunshine. Florida Statutes 222.25 Renters often benefit significantly from that larger wildcard.

Retirement and Wages

Employer-sponsored plans like 401(k)s and pensions that qualify under federal ERISA rules are protected without a cap. Traditional and Roth IRAs are protected too, subject to a periodically adjusted dollar cap. These are federal protections, so they apply regardless of the state exemptions you use. Florida law fully protects the disposable earnings of a head of family who earns $750 per week or less.9Online Sunshine. Florida Statutes 222.11 Above that threshold, a head of family’s wages still can’t be garnished unless the debtor previously agreed to it in writing.

Understand What Chapter 7 Will Not Erase

Some debts survive Chapter 7 no matter what, and filing without knowing this can be a very expensive disappointment. The major non-dischargeable categories:10Office of the Law Revision Counsel. 11 USC 523 – Exceptions to Discharge

  • Domestic support obligations. Child support and alimony survive completely.
  • Most student loans. Discharge requires a separate lawsuit within your case proving “undue hardship,” a standard most courts read strictly.
  • Recent income taxes. Older income tax may be dischargeable if the return was due more than three years ago, was filed more than two years ago, and the tax was assessed more than 240 days before filing. Payroll taxes and fraud penalties are never dischargeable.
  • Debts from fraud or false pretenses, if a creditor proves you obtained money, property, or services through misrepresentation.
  • Debts from willful and malicious injury to a person or property.
  • Government fines and penalties, including traffic tickets, court fines, and criminal restitution.
  • Any creditor you fail to list. Unlisted debts aren’t bound by the discharge, which is why completeness on the schedules matters so much.

If most of what you owe sits in these categories, Chapter 7 may not give you much practical relief. Take an honest inventory of what’s actually dischargeable before you commit.

Gather Documents and Complete the Forms

Pull everything together before you touch the forms. You’ll need pay stubs, business receipts, or other income records for the full six months before filing, because they feed the means test. You’ll also need your most recent federal tax return, which must go to the trustee at least seven days before the 341 meeting; the IRS separately requires that returns for the four tax years before filing be on file.11Office of the Law Revision Counsel. 11 USC 521 – Debtor Duties Add bank statements, real estate deeds, vehicle titles, retirement account statements, and records for anything else of value. Pull your credit reports from all three bureaus and cross-reference them against your own records so no creditor is missing. Build a realistic monthly expense budget covering rent or mortgage, utilities, food, transportation, insurance, and medical costs.

Forms are free on the U.S. Courts website. Use the current official versions; the Florida courts will reject outdated forms or forms from other jurisdictions.12United States Bankruptcy Court. Filing a Chapter 7 Case The core documents:

  • Voluntary Petition (Form 101), which formally opens your case.
  • Schedules A/B through J, which lay out your property, the exemptions you’re claiming, every secured and unsecured creditor, all income sources, and a detailed monthly expense breakdown. This is where most pro se cases go wrong.
  • Statement of Financial Affairs (Form 107), covering property transfers, payments to creditors, lawsuits, and income for the past two years.
  • Means Test Form (Form 122A-1), comparing your current monthly income to the Florida median.
  • Statement of Intention (Form 108), for any secured debts such as a car loan or mortgage: surrender, reaffirm, or redeem.

Every form is signed under penalty of perjury. Deliberately misstating income, hiding assets, or omitting creditors can lead to criminal charges. If you make an honest mistake, you can amend your schedules after filing for $34 per amendment.

File in the Correct Florida District

Florida has three federal bankruptcy court districts: Northern (Panhandle and Big Bend), Middle (Orlando, Tampa, and Jacksonville regions), and Southern (from Fort Pierce to Key West). You file in the district where you’ve lived for the greater part of the last 180 days.13Office of the Law Revision Counsel. 28 USC 1408 – Venue of Cases Under Title 11

Pro se filers in Florida cannot file electronically. Deliver your completed petition and schedules to the clerk’s office in person or by mail.14United States Bankruptcy Court Middle District of Florida. Filing Without an Attorney

Filing Fees and Payment Options

The total court fee is $338. If you can’t pay it up front, you have two options. You can apply to pay in installments, up to four payments completed within 120 days of filing, extendable to 180 days for good cause.15Legal Information Institute. Federal Rules of Bankruptcy Procedure Rule 1006 – Filing Fee While you’re paying in installments, you can’t pay an attorney or any other service provider for bankruptcy-related help.

You can also ask the court to waive the fee entirely if your household income is below 150% of the federal poverty guidelines and you can’t afford installments.16Office of the Law Revision Counsel. 28 USC 1930 – Bankruptcy Fees Fee waivers are only available in individual Chapter 7 cases.

What Happens After You File

The Automatic Stay Takes Effect Immediately

The moment your petition is filed, a federal court order called the automatic stay stops most collection activity. Lawsuits, wage garnishments, collection calls, utility shutoffs for nonpayment, and foreclosure proceedings all pause.17Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay A creditor that keeps collecting after your case is filed is violating a federal court order. The stay does not stop criminal proceedings, child support or alimony collection, or most tax audits, and won’t prevent the IRS from sending a tax deficiency notice.

The 341 Meeting of Creditors

About four to six weeks after filing, you’ll attend a 341 meeting of creditors. It isn’t a court hearing and no judge attends. The trustee assigned to your case runs it, puts you under oath, and asks about your paperwork, property, income, and expenses.18United States Department of Justice. Section 341 Meeting of Creditors Creditors can attend and ask questions; in most consumer cases they don’t.

Almost all 341 meetings are now held over Zoom. Check the notice from the court and the trustee’s instructions for the exact format and login. Have a government-issued photo ID and proof of your Social Security number ready for the trustee, plus a copy of your filed schedules and statement of financial affairs. Missing this meeting is one of the fastest ways to get your case dismissed. Trustees can reschedule for a genuine emergency but have no obligation to; a dismissal means refiling and paying $338 again.

Choosing What to Do With Secured Property

If a debt is secured by property, such as a car loan, you can’t just discharge the debt and keep the item. You pick one of three paths and declare it on the Statement of Intention.

Surrender is the simplest: you return the property, the debt is discharged, and you owe nothing further. Reaffirmation is a new contract with the lender agreeing to remain personally liable as though you never filed.19Office of the Law Revision Counsel. 11 USC 524 – Effect of Discharge Terms usually stay the same, though negotiation is possible. Because you don’t have an attorney to certify that the agreement is in your best interest, the bankruptcy judge must personally approve every reaffirmation you sign, weighing whether the payments are affordable and whether reaffirming makes financial sense. If the numbers don’t work, the court can refuse to approve it. Redemption lets you keep personal property by paying the lender its current fair market value in a single lump sum, even if you owe far more.20Office of the Law Revision Counsel. 11 USC 722 – Redemption A car worth $4,000 on a $12,000 loan costs $4,000 to redeem, with the $8,000 balance discharged. Few filers have that cash on hand, which limits how often redemption gets used.

Debtor Education and Discharge

Before your debts can be discharged, you must finish a second course, the debtor education or “financial management” course, separate from the pre-filing credit counseling. It covers budgeting and managing finances going forward.21United States Courts. Credit Counseling and Debtor Education Courses Approved agencies offer it online, usually for $20 to $30. File the completion certificate with the court promptly.

If you don’t file that certificate, the court can deny your discharge entirely.22United States Courts. Discharge in Bankruptcy – Bankruptcy Basics The discharge itself typically arrives about 60 days after the first scheduled 341 date, assuming no creditor objections are pending and all required documents are on file. It’s a court order permanently wiping out your qualifying unsecured debts.

After Discharge: Credit and Taxes

A Chapter 7 stays on your credit reports for 10 years from the filing date.23Office of the Law Revision Counsel. 15 USC 1681c – Requirements Relating to Information Contained in Consumer Reports The score impact is sharpest in the first two years and fades gradually. Many filers qualify for secured credit cards within months and for conventional loans within two to four years, largely because their debt-to-income ratio is far better after discharge.

Debts discharged in bankruptcy are not taxable income. The bankruptcy exclusion means you won’t get a 1099-C creating a tax liability, unlike debt settled or forgiven outside bankruptcy.24Internal Revenue Service. About Form 982 – Reduction of Tax Attributes Due to Discharge of Indebtedness If a creditor does issue a 1099-C for a discharged debt, exclude the amount on your return using IRS Form 982.
