You can file for bankruptcy in California without a lawyer, and thousands of people do it every year. The process is called filing pro se, it follows federal rules administered by one of California’s four bankruptcy courts, and a Chapter 7 case costs $338 in court fees and runs about three to four months from filing to discharge. Every form is signed under penalty of perjury, so accuracy matters more than speed. Here is how the process actually works.
Pick the Right Chapter First
Almost every pro se filer in California uses Chapter 7. It wipes out qualifying unsecured debts, like credit card balances and medical bills, in exchange for potentially surrendering non-exempt property, and it wraps up in a few months.
Chapter 13 is a three-to-five-year repayment plan through a court-appointed trustee, designed for people with regular income who want to save property they’d otherwise lose, such as a home in foreclosure. To qualify, secured debts must be below $1,580,125 and unsecured debts below $526,700.1Office of the Law Revision Counsel. 11 USC 109 Chapter 13 is significantly harder to manage without an attorney because the repayment plan itself is complex, and most bankruptcy judges will say so directly. If Chapter 13 is your only realistic option, seriously consider hiring counsel. The rest of this guide covers Chapter 7.
Complete Credit Counseling and the Means Test
Two things must happen before you file.
First, take an approved credit counseling course from an agency on the U.S. Trustee Program’s list.2United States Department of Justice. Frequently Asked Questions – Credit Counseling It reviews your finances and looks at alternatives to bankruptcy. Do it within 180 days before you file. Most agencies offer it online for $25 to $50, and it takes about an hour. You’ll get a certificate of completion to file with your petition.3United States Bankruptcy Court. Second, take the means test. This compares your average monthly income over the six months before filing to the California median for your household size.4United States Department of Justice. Means Testing For cases filed on or after April 1, 2026, the medians are:
- Single earner: $79,253
- Household of two: $102,797
- Household of three: $116,541
- Household of four: $139,071
- Each additional person: add $11,100
Under the threshold, you pass and can proceed with Chapter 7.5U.S. Trustee Program/Dept. of Justice. Census Bureau Median Family Income By Family Size Over it, you complete a longer disposable-income calculation on Official Form 122A-2 that factors in allowed expenses.
Choose a California Exemption System
This is where pro se filers most often go wrong. Exemptions determine what property you keep and what the trustee can sell. California gives you two completely separate systems, and you must pick one. No mixing.
System 1 (CCP 703.140)
System 1 usually works better for renters or homeowners with little equity, because of its wildcard.
- Homestead: up to $29,275 in your primary residence6California Legislative Information. California Code CCP 703.140
- Motor vehicles: up to $7,500 in equity across all vehicles
- Wildcard: $1,550 plus any unused portion of the homestead exemption, applicable to any property
- Tools of trade: up to $8,725
- Jewelry: up to $1,750
If you don’t use the homestead exemption at all, the wildcard grows to $30,825 and can protect any combination of assets up to that value.
System 2 (CCP 704)
System 2 is generally better if you own a home with real equity. The homestead exemption starts at a $300,000 floor, adjusted annually for inflation, and goes up to the countywide median home sale price, capped at $600,000 (also adjusted for inflation).7California Legislative Information. Before you file, list every asset, assign each its current resale value (what a buyer would pay), and run the numbers under both systems. Whichever protects more property is the one to claim on Schedule C.
Gather Your Documents and Fill Out the Forms
The petition asks for full disclosure of your financial life. Pull together:
- Pay stubs or other proof of income for the past six months
- Your most recent federal tax returns
- Statements for all bank and investment accounts
- Titles for any vehicles you own
- Deeds or mortgage statements for any real estate
- A list of every creditor with name, address, and amount owed
The main document is the Voluntary Petition for Individuals Filing for Bankruptcy (Official Form 101). It comes with a stack of schedules: Schedule A/B (property and values), Schedule C (exemptions claimed), Schedule D (secured creditors), Schedule E/F (unsecured creditors), and Schedules I and J (current income and expenses). You’ll also file the Statement of Financial Affairs (Form 107), which covers recent payments, transfers, lawsuits, and income sources, plus the means test form (122A-1 or 122A-2). When you value property on Schedule A/B, use fair market value. For a car, that’s the private-party price in Kelley Blue Book or a similar guide, not the dealer retail number. For household goods, use garage-sale prices, not what you paid. Overvaluing is nearly as risky as undervaluing, because it can push assets past your exemption limits on paper when they wouldn’t actually be at risk.
File With the Right California District Court
California has four federal bankruptcy districts: Northern, Eastern, Central, and Southern.10Justia. California District Courts and Bankruptcy Courts File in the district where you’ve lived for the greater part of the last 180 days.
The Chapter 7 filing fee is $338, paid by money order or cashier’s check. Personal checks and credit cards are generally not accepted from pro se filers. If you can’t pay up front, apply to pay in installments (up to four payments over 120 days), or, if your household income is below 150 percent of federal poverty guidelines, request a full fee waiver on Form 103B.11United States Courts. You can submit your packet in person or by mail. Central District filers also have access to the Electronic Self-Representation (eSR) system, which walks pro se Chapter 7 and Chapter 13 filers through petition preparation and electronic submission.12United States Bankruptcy Court – Central District of California. Electronic Self-Representation (eSR) Bankruptcy Petition Preparation System for Chapter 7 and Chapter 13 Even with eSR, your Social Security number statement, creditor mailing list, and filing fee still go in by mail. The other three districts require paper filing. Once the clerk accepts your petition, you’ll get a case number and date-stamped copies.
What Happens After You File
The moment your petition is filed, the automatic stay kicks in. This is a federal court order that forces most creditors to stop collection activity immediately: wage garnishments halt, foreclosures pause, collection calls stop, and pending lawsuits are frozen.13Office of the Law Revision Counsel. 11 USC 362 Creditors who violate it can be sanctioned. The stay does not stop criminal proceedings, most child support or spousal support collection, or tax audits and deficiency notices. If you had a prior case dismissed within the past year, the new stay may be limited to 30 days or may not take effect at all.
Twenty to forty days after filing, you’ll attend the 341 Meeting of Creditors.14United States Department of Justice. Section 341 Meeting of Creditors The trustee, appointed by the court, asks questions under oath about your paperwork and finances. Creditors may attend and ask questions, though in most consumer cases few or none do.15Office of the Law Revision Counsel. 11 US Code 341 – Meetings of Creditors and Equity Security Holders Bring a government-issued photo ID and proof of your Social Security number, such as your Social Security card or a W-2. If your paperwork holds up, the meeting is often over in 5 to 10 minutes. If something is missing, the trustee will continue it and give you time to fix the issue.
You have one more requirement after the 341 meeting: a debtor education course on personal financial management from an approved provider.16United States Courts. Credit Counseling and Debtor Education Courses This is different from the pre-filing credit counseling and cannot be taken at the same time.17United States Department of Justice. Credit Counseling and Debtor Education Information File the certificate with the court. Skip it and the court will close your case without granting a discharge.
If there are no objections, the discharge order enters roughly 60 to 90 days after the 341 meeting. It permanently eliminates your personal liability on qualifying debts, and creditors who try to collect on discharged debts can be held in contempt. You cannot receive another Chapter 7 discharge if you got one within the eight years before your current filing date.18Office of the Law Revision Counsel. 11 USC 727
Debts That Do Not Go Away
Chapter 7 is powerful, but it doesn’t erase everything. Federal law excludes several categories from discharge:
- Child support and alimony (all domestic support obligations)
- Most student loans, unless you file a separate lawsuit within your case and prove undue hardship, a standard that remains extremely difficult to meet
- Certain tax debts, particularly recent income taxes and taxes tied to fraudulent or unfiled returns
- Debts obtained through fraud or a materially false financial statement
- Debts for death or injury caused by driving under the influence
- Debts you failed to list, if the creditor didn’t learn about the case in time to file a claim
Recent luxury purchases and cash advances also carry a presumption against discharge: consumer debts over $500 for luxury goods incurred within 90 days of filing, and cash advances over $750 taken within 70 days.19Office of the Law Revision Counsel. 11 US Code 523 – Exceptions to Discharge Running up credit cards right before filing is exactly what trustees look for.
Reaffirmation Agreements If You Want to Keep a Financed Car
If you’re paying on a car loan or other secured debt and want to keep the property, the lender may ask you to sign a reaffirmation agreement. It’s a new contract on the same terms that survives your discharge. Without reaffirmation, the lender can eventually repossess but can’t come after you for a deficiency. With reaffirmation, you keep the property while paying, but you’re personally liable again if you fall behind.
For pro se filers, the court must approve any reaffirmation agreement and find it doesn’t impose undue hardship. If the judge sees a budget that can’t support the payments, the agreement is rejected. You can also cancel within 60 days after it’s filed or before your discharge is entered, whichever is later.20Office of the Law Revision Counsel. 11 USC 524 Before you sign, compare the balance you owe to the property’s current market value. If the loan is underwater, reaffirmation locks you back into a debt that bankruptcy could have wiped out.
Mistakes, Amendments, and the Line Where the Court Stops Being Forgiving
Pro se filers are held to the same standard as filers with lawyers. Honest mistakes, like forgetting a creditor or miscalculating a value, can usually be fixed by amending your schedules. Repeated errors, though, damage your credibility with the trustee at the 341 meeting.
Deliberate dishonesty is a different problem. Concealing assets, lying about income, or hiding property transfers are federal crimes under 18 U.S.C. ยง 152, punishable by up to five years in prison, fines up to $250,000, or both.21Office of the Law Revision Counsel. 18 USC 152 The court can also deny your discharge if you transferred or concealed property with intent to defraud creditors within a year before filing, destroyed financial records, or made false statements in the case.18Office of the Law Revision Counsel. 11 USC 727
A case dismissed for bad faith can bar you from refiling for 180 days or longer, and in extreme cases the court can permanently bar you from discharging the same debts in a future case. The threshold is deliberate abuse, not paperwork error, but the line between careless and suspicious is thinner than most pro se filers realize. When in doubt, disclose. Trustees are far more forgiving of over-disclosure than of gaps.
If You Want Help but Can’t Afford an Attorney
A bankruptcy petition preparer is a non-lawyer authorized under federal law to type up your forms.22Office of the Law Revision Counsel. 11 USC 110 They cannot give legal advice, explain exemption strategy, or represent you in court. They enter what you tell them. The catch is that the highest-stakes decisions in a pro se case, including which exemption system to choose and how to value your assets, are legal judgment calls a preparer isn’t allowed to help with. Courts in California’s Northern District cap preparer fees at $150. Any fee must be disclosed to the court, and the court can order it returned if it exceeds the value of services provided.
