You can file a Chapter 7 bankruptcy in Illinois without a lawyer by completing a pre-filing credit counseling course, passing the means test, preparing the federal petition and schedules with Illinois property exemptions, paying the $338 filing fee (or applying to defer or waive it), attending a meeting of creditors about a month later, and finishing a second financial management course before the court enters your discharge. Thousands of Illinois residents do this each year. The process is legally open to you, but it is unforgiving: everything you file is signed under penalty of perjury, and a single missed deadline or misclaimed exemption can cost you property or your whole case.
Know What You’re Taking On
The Northern District of Illinois, the busiest bankruptcy court in the state, tells pro se filers directly that “it is difficult to proceed pro se in bankruptcy cases” and that court staff cannot explain rules, help complete forms, or advise you on what information to include.1United States Bankruptcy Court. Filing Without an Attorney – Northern District of Illinois You are held to the same procedural standards as a licensed attorney, and the judge cannot coach you.
The spots where self-represented filers most often slip are exemption planning, the means test calculations, and reaffirmation agreements. A mistake in any of them can mean losing property you could have kept, having your case thrown out, or staying personally liable for a debt you thought was gone. If your situation involves a home with significant equity, a small business, recent lawsuits, or allegations of fraud, the complexity jumps sharply, and you should think hard about hiring counsel.
Free help exists. The Northern District runs a Bankruptcy Help Desk staffed by volunteer attorneys who can answer basic questions, and if an adversary proceeding is filed against you inside your case, you can ask the judge to appoint a volunteer lawyer at no cost.1United States Bankruptcy Court. Take the Credit Counseling Course First
Federal law bars you from filing until you have completed a credit counseling briefing within the 180 days before your filing date.2Office of the Law Revision Counsel. 11 USC 109 – Who May Be a Debtor The briefing must come from a nonprofit agency approved by the U.S. Trustee Program. Most approved agencies offer the session online or by phone for roughly $15 to $50, and they must waive or reduce the fee for anyone whose household income falls below 150% of the federal poverty guidelines.3U.S. Department of Justice. Credit Counseling and Debtor Education Information For a single person in 2026, 150% of the poverty line is $23,940.4U.S. Department of Health and Human Services. 2026 Poverty Guidelines
When you finish, the agency issues a certificate. File it with your petition. Without it, the court will almost certainly dismiss your case.
Pass the Means Test
Chapter 7 is only available if you pass the means test. The first step compares your household’s average monthly income over the six months before filing against the median income for an Illinois household of your size.5U.S. Department of Justice. Means Testing For cases filed between November 1, 2025 and March 31, 2026, the Illinois medians are:
- One earner: $71,304
- Two-person household: $91,526
- Three-person household: $110,712
- Four-person household: $134,366
- Each additional person: add $11,100
These figures change in April and November each year, so verify the current numbers on the U.S. Trustee’s website before you file.6U.S. Department of Justice. Median Family Income Table – November 2025 If your income falls below the median, you pass automatically. If it exceeds the median, a second calculation subtracts allowed living expenses from your income to see whether you still qualify. If you don’t, Chapter 13, which involves a repayment plan, may be your only option.
Use Illinois Exemptions to Protect Your Property
This is where pro se filers get hurt most often, and the mistakes are the hardest to undo. In a Chapter 7 case, a court-appointed trustee looks at everything you own and asks what can be sold to pay creditors. Exemptions are the legal shield for the property you keep. Illinois has opted out of the federal bankruptcy exemptions, so you must use the Illinois state list.7Illinois General Assembly. 735 ILCS 5/12-1001 – Personal Property Exempt
As of January 1, 2026, the key Illinois exemptions are:
- Homestead: up to $50,000 in equity in your primary residence, doubled to $100,000 if two owners file together.
- Motor vehicle: up to $3,600 in equity in one car or truck.
- Wildcard: $4,000 that can be applied to any property. The first $1,000 is an automatic exemption for money in a bank account. The wildcard can be stacked on top of other exemptions, so a car with up to $7,600 in equity could be fully protected by combining the vehicle and wildcard amounts.
- Household goods: furniture, appliances, clothing, and electronics are exempt unless a single item has a resale value above $5,000.
- Jewelry: one piece worth up to $5,000.
- Tools of the trade: up to $2,250 in work-related tools, books, or equipment.
- Personal injury awards: up to $22,500 from a bodily injury settlement or judgment.
These amounts are equity values, not purchase prices. If your car is worth $10,000 but you owe $8,000 on the loan, your equity is $2,000, which falls within the $3,600 vehicle exemption.7Illinois General Assembly. 735 ILCS 5/12-1001 – Personal Property Exempt Anything that exceeds your exemptions is non-exempt, and the trustee can sell it. Vacation homes, large cash savings, and valuable collections are the usual casualties.
Gather Documents and Fill Out the Forms
The bankruptcy petition is a packet running to dozens of pages. Before you start filling anything in, gather pay stubs covering the 60 days before your filing date, your most recent federal tax return, bank statements, loan documents, and a complete list of every creditor you owe money to, including each one’s name, mailing address, account number, and current balance.
The main forms are:
- Official Form 101, the Voluntary Petition for Individuals Filing for Bankruptcy, the lead document.8United States Courts. Voluntary Petition for Individuals Filing for Bankruptcy
- Schedule A/B, a complete inventory of everything you own.
- Schedule C, the exemptions you are claiming for each item.
- Schedule D, creditors with secured claims such as your mortgage lender or car lender.
- Schedule E/F, creditors with unsecured claims including credit cards, medical bills, and personal loans.
- Schedule I, your current income from all sources.
- Schedule J, your monthly living expenses.
- Statement of Financial Affairs, a detailed questionnaire covering recent property transfers, lawsuits, and payments to creditors.
- Forms 122A-1 and 122A-2, the means test forms.
All of these are free on the U.S. Courts website. Every number must be consistent across the schedules. If Schedule I shows $3,200 in monthly income and Form 122A shows $3,800, the trustee will notice, and the inconsistency will create problems. Everything is signed under penalty of perjury.
The Creditor Matrix
Along with the petition, you must file a creditor mailing matrix: a formatted list of every creditor’s name and address the court uses to send notices. Each Illinois bankruptcy district sets its own formatting rules for the matrix, including font size, column layout, line limits per creditor, and character limits per line. Check your district’s local rules or clerk’s office website before preparing it. If the matrix is formatted wrong, the clerk’s office may reject your filing.
File in the Right Illinois District
Federal law requires you to file in the district where you have lived for the greater part of the 180 days before filing.9Office of the Law Revision Counsel. 28 USC 1408 – Venue of Cases Under Title 11 Illinois has three federal bankruptcy districts:
- Northern District: Cook, DuPage, Lake, Will, Kane, and surrounding counties in the Chicago metropolitan area.
- Central District: Springfield, Peoria, Champaign-Urbana, and the central portion of the state.
- Southern District: the southern third of Illinois, including East St. Louis.
If you recently moved between districts, file in whichever one you lived in for the longer portion of the 180-day window. Filing in the wrong district doesn’t destroy your case, but it causes delays while the case is transferred.
Pay, Defer, or Waive the Filing Fee
The Chapter 7 filing fee is $338, normally due when you submit your petition. You have two options if you can’t pay upfront.10Legal Information Institute. Federal Rules of Bankruptcy Procedure – Rule 1006 Filing Fee
First, you can pay in installments using Official Form 103A. The court can split the fee into up to four payments spread over 120 days from the filing date, extendable to 180 days in unusual circumstances.10Legal Information Institute. Federal Rules of Bankruptcy Procedure – Rule 1006 Filing Fee
Second, you can request a full fee waiver using Official Form 103B if your household income is below 150% of the federal poverty guidelines. For 2026, that threshold is $23,940 for a single person and $32,460 for a two-person household.4U.S. Department of Health and Human Services. 2026 Poverty Guidelines Submit the fee, the installment application, or the waiver application with your petition packet. Pro se filers in Illinois generally file in person at the clerk’s office or by mail, along with any copies required by local rules.
What Happens After You File
The Automatic Stay
The moment the clerk accepts your petition, the automatic stay takes effect. It forces most creditors to stop all collection activity, including phone calls, collection letters, lawsuits, wage garnishments, and foreclosure proceedings.11Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay It does not stop criminal proceedings, most tax audits, or collection of domestic support obligations like child support and alimony. If you had a previous bankruptcy case dismissed in the past year, the stay in your new case may last only 30 days or may not take effect at all.
The Trustee
Shortly after filing, the court appoints a trustee to administer your case. The trustee reviews your petition and schedules, examines your exemption claims, and decides whether you have non-exempt property worth selling. You will need to provide copies of your most recent tax return and recent pay stubs. In most consumer cases the trustee finds nothing worth pursuing and the case is classified as a “no-asset” case. If you own property that isn’t fully covered by exemptions, the trustee has the power to sell it.
The 341 Meeting of Creditors
About 30 to 45 days after filing, you must attend the meeting of creditors, called the 341 meeting. It is not a court hearing and no judge is present. The trustee conducts the meeting, places you under oath, and asks questions to verify the information in your forms.12U.S. Department of Justice. Section 341 Meeting of Creditors The trustee is also required to confirm that you understand the consequences of a discharge, your ability to file under a different chapter, and the implications of reaffirming any debts.13Office of the Law Revision Counsel. 11 USC 341 – Meetings of Creditors and Equity Security Holders Creditors can attend and ask questions, but rarely do in routine consumer cases. Bring a government-issued photo ID and your Social Security card.
Reaffirmation Agreements if You Want to Keep a Car or Home
If you have a car loan or other secured debt and want to keep the property, you may need to sign a reaffirmation agreement. This is a new contract: you agree to remain personally liable on the debt despite the bankruptcy, and in exchange, the lender agrees not to repossess as long as you keep paying. The agreement must be filed with the court before your discharge is entered.14Office of the Law Revision Counsel. 11 USC 524 – Effect of Discharge
Being pro se creates an extra hurdle here. When a debtor has a lawyer, the attorney signs a declaration that the agreement doesn’t impose undue hardship. When you don’t, the court must hold a hearing where the judge personally finds that the agreement is in your best interest and doesn’t create an undue burden.14Office of the Law Revision Counsel. 11 USC 524 – Effect of Discharge If the judge concludes the deal is bad for you, the court can refuse to approve it. You can also cancel any reaffirmation within 60 days after it is filed, or before your discharge is entered, whichever is later.
The alternative is to keep making payments without signing a new agreement. Some lenders accept this and leave the vehicle alone. The risk is that without a contract, the lender can repossess at any time, even if you’re current. The upside is that if you later can’t pay, you can surrender the car without owing a deficiency balance, since the underlying debt was discharged.
Debts Bankruptcy Cannot Erase
Chapter 7 wipes out most unsecured debt, but federal law carves out categories that survive the discharge no matter what.15Office of the Law Revision Counsel. 11 USC 523 – Exceptions to Discharge The main ones:
- Child support and alimony cannot be discharged.
- Student loans survive unless you file a separate adversary proceeding within your case and prove undue hardship, which most courts evaluate under a three-part test looking at your minimal standard of living, whether the hardship is likely to persist, and your good-faith efforts to repay.
- Recent income taxes generally survive. To be dischargeable, the return must have been due at least three years before filing, actually filed at least two years before filing, and assessed at least 240 days before filing. Taxes involving fraud or willful evasion are never dischargeable.
- Debts obtained through fraud or false pretenses survive if the creditor proves them.
- Consumer debts over $500 for luxury goods incurred within 90 days of filing, and cash advances over $750 taken within 70 days of filing, are presumed non-dischargeable.15Office of the Law Revision Counsel. 11 USC 523 – Exceptions to Discharge
- Government fines, penalties, and criminal restitution cannot be discharged.
- Debts arising from intentional harm to another person or their property survive.
- Any debt you fail to list in your schedules may survive if the creditor didn’t learn about the case in time to participate.
That last one is a particular trap. If you forget a creditor or list the wrong address, that creditor may never receive notice, and the debt could outlive your bankruptcy. Check every listing before filing.
Finish the Debtor Education Course
After filing, you must complete a second course called debtor education or personal financial management. This is separate from the pre-filing credit counseling and must come from a different approved provider or at a different time.3U.S. Department of Justice. Credit Counseling and Debtor Education Information It covers budgeting and using credit responsibly. File the certificate with the court promptly; without it, the court cannot enter your discharge.16United States Courts. Credit Counseling and Debtor Education Courses
If everything goes smoothly, the discharge order is typically entered about 60 to 90 days after the 341 meeting, roughly three to four months after your original filing date. The discharge permanently eliminates your personal liability for all covered debts.
If Your Case Gets Dismissed
Dismissal is the worst outcome short of having a discharge denied altogether. If the court dismisses your case for a missing credit counseling certificate, missing documents, or failure to appear at the 341 meeting, the automatic stay lifts immediately and creditors resume collection. Your debts remain intact. To try again, you refile a new petition, pay the fee again, and may face a limited automatic stay in the new case.
If you previously received a Chapter 7 discharge, you must wait eight years from the date that earlier case was filed before you can receive another one.
