To file for maternity leave in California, give your employer advance notice, then file a Disability Insurance claim with the Employment Development Department (EDD) between the 9th and 49th day after your pregnancy-related disability begins. When you’ve recovered from delivery, the EDD will send you a separate Paid Family Leave claim form to cover your bonding time. Both claims can be done online through SDI Online or on paper using Form DE 2501.
The filing itself is not complicated. What trips people up is timing, the identity verification step, and the handoff between the disability claim and the bonding claim. Work through the steps in order.
Step 1: Give Your Employer Notice
Tell your employer before you file anything with the state. If your leave date is foreseeable, give at least 30 days’ advance notice. California law doesn’t require the notice to be in writing, but writing it down protects you if there’s ever a dispute about what you said or when. Cover the reason for the leave (pregnancy-related disability, bonding, or both), the approximate start date, and how long you expect to be out. If you plan to take bonding leave intermittently, say so, since your employer will need to plan coverage. Step 2: Set Up Your Account and Gather Documents
Do this before your due date. Filing online is faster and available around the clock, but before you can file you’ll need to create a myEDD account and verify your identity through ID.me, which can take a few days.3Employment Development Department. The main form is the Claim for Disability Insurance Benefits (Form DE 2501). It has two parts: your statement and your healthcare provider’s medical certificate. Your doctor or midwife submits the medical certificate directly to the EDD, covering the start date of your disability, the expected duration, and enough medical detail to support that you can’t perform your usual work.4Employment Development Department. Have this information ready when you fill out your part:
- Your Social Security number and California Driver License or ID card number
- Your employer’s name, address, and phone number
- The last day you worked before your disability began
- Your medical provider’s name and contact information
- Information about any wages you expect to receive during your leave (sick pay, vacation, employer-paid disability)
To qualify for benefits at all, you need to have earned at least $300 in wages subject to SDI deductions during your base period, which covers earnings from roughly 5 to 18 months before your claim begins.5Employment Development Department. Disability Insurance Eligibility FAQs
Step 3: File the Disability Claim in the Right Window
The window is strict. Wait at least nine days after your disability starts before filing, and file within 49 days of when your disability begins. Filing too early can delay your claim, and filing too late can disqualify you entirely.6Employment Development Department. Filing Online Through SDI Online
Log in through your myEDD account and submit your claim in the SDI Online portal. You’ll get a receipt number. Give that number to your healthcare provider so they can submit the medical certification portion of your claim directly to the EDD tied to your file.
Filing by Mail
Order a paper DE 2501 form online, pick one up from your doctor or employer, visit an SDI office, or call 1-800-480-3287.4Employment Development Department. The Seven-Day Waiting Period
Before any SDI payments begin, you serve an unpaid seven-day waiting period, counted in calendar days from when your disability starts. Your first payable day is the eighth day of your claim.7Employment Development Department. Step 4: Switch to the Bonding Claim After Delivery
You don’t file the bonding claim yourself from scratch. When you’ve recovered from delivery and the EDD sends your final disability payment, they’ll automatically mail you a Claim for Paid Family Leave Benefits — New Mother (Form DE 2501FP) to start your Paid Family Leave bonding claim.8Employment Development Department. PFL bonding provides up to eight weeks of partial pay and does not have a separate seven-day waiting period when you’re transitioning directly from a pregnancy disability claim.10Employment Development Department. Paid Family Leave
How Much You’ll Be Paid and How Soon
SDI and PFL use the same formula. If your highest-quarter wages are 70 percent or less of the state average, you receive about 90 percent of your weekly pay. Most benefit payments arrive within about two weeks after the EDD receives a properly completed claim.13Employment Development Department. A typical disability period for a normal delivery runs about six to eight weeks, longer for a cesarean section. After that you transition to bonding leave, which must be used within one year of your child’s birth.14Civil Rights Department. PDL Baby Bonding Quick Reference Guide
If Your Claim Is Denied
If the EDD determines you’re not eligible, they’ll mail a Notice of Determination explaining why. You have 30 days from the date on that notice to file an appeal using the Appeal Form (DE 1000A) that comes with the denial letter.15Employment Development Department. If the EDD doesn’t reverse the denial on review, your case goes to the California Unemployment Insurance Appeals Board, where an administrative law judge holds a hearing. You and an SDI representative each present your side. Missing the hearing means your appeal gets dismissed. If you miss the initial 30-day appeal window, you can still file late, but you’ll need to explain the delay, and a judge will decide whether your reason qualifies as good cause.15Employment Development Department. Filing With the EDD Is Not the Same as Job Protection
The EDD claims described above give you the money. They do not, on their own, protect your job. Job protection comes from two separate laws with their own eligibility rules: Pregnancy Disability Leave (available from your first day at any employer with five or more employees) and the California Family Rights Act for bonding (which requires 12 months of employment, at least 1,250 hours in the prior year, and an employer with five or more employees).1California Civil Rights Department. You can still collect PFL benefits even if you don’t meet CFRA’s eligibility requirements, but in that case your employer isn’t legally obligated to hold your position.10Employment Development Department.
